Open Data: Barriers, Risks, and OpportunitiesSlim Turki, Dr.
Despite the development of Open Data platforms, the wider deployment of Open Data still faces significant barriers. It requires identifying the obstacles that have prevented e-government bodies either from implementing an Open Data strategy or from ensuring its sustainability.
This paper presents the results of a study carried out between June and November 2012, in which we analyzed three cases of Open Data development through their platforms, in a medium size city (Rennes, France), a large city (Berlin, Germany), and at national level (UK). It aims to draw a clear typology of challenges, risks, limitations and barriers related to Open Data. Indeed the issues and constraints faced by re-users of public data differ from the ones encountered by the public data providers. Through the analysis of the experiences in opening data, we attempt to identify how barriers were overcome and how risks were managed. Beyond passionate debates in favor or against Open Data, we propose to consider the development of an Open Data initiative in terms of risks, contingency actions, and expected opportunities. We therefore present in this paper the risks to Open Data organized in 7 categories: (1) governance, (2) economic issues, (3) licenses and legal frameworks, (4) data characteristics, (5) metadata, (6) access, and (7) skills.

2017 Born Digital Legal Deposit Policies and PracticesFrederick Zarndt
In 2015, three of the authors (Zarndt, McCain, Carner) surveyed the born digital content legal deposit policies and practices in 18 different countries and presented the results of the survey at the 2015 International News Media Conference hosted by the National Library of Sweden in Stockholm, Sweden, April 2015.
As a first step, the authors reviewed previous surveys about legal deposit and digital preservation. The authors updated and streamlined the 2015 survey in order to assess progress in creating or improving national policies and in implementing practices for preserving born digital content. The current survey consists of as many as 20 questions; which questions are asked depends on the respondent’s previous answers.
More than 50 countries and states in Australia, Germany and USA, participated in the survey. The survey closed at the end of November 2017. The authors expect to repeat the survey periodically in order to assess progress in developing born digital legal policy and implementing the policy in practice.
Risk management and the release of microdata: Sonia Whiteley
Effective management of microdata acknowledges that there is no ‘single fix’ that will adequately address all of the potential risks associated with releasing unit record information. It is also the case that different methods used to maximise data security have different risks and all data confidentialisation methods limit the usefulness of the underlying data [1]. We have developed an approach to data management and release that takes a
balanced view of potential re-identification or disclosure threats and prioritises data utility while actively addressing more probable risk scenarios.
This balanced approach to risk management will be discussed in relation to the Australian Early Development Census (AEDC) which is conducted every three years to measure children’s development as then enter their first year of formal schooling. AEDC data is collected through a teacher-completed, online checklist that measures five areas of early childhood development. Issues relating to risk and the research community, data management risk mitigation strategies, microdata access modalities and the implications of sharing the risk between academics and the data custodians will be explored.

Governments and public authorities across the world are launching Open Data initiatives. Public administration officials are now beginning to realize the value that opening up data can have. For instance, the direct impact of Open Data on the EU27 economy was estimated at €32 Billion in 2010, with an estimated annual growth rate of 7%.
However, very few governments are taking the right measures in realizing the economic benefits of Open Data. This report examines the reasons behind this tendency, drawing on an analysis of 23 select countries across the world.

Introduction
This study focuses on the openness of judiciary branch data and its
impact in Argentina, Chile and Uruguay. It is also oriented to address
how the information is used by key stakeholders.
Even though judiciaries provide information related to rulings, statistics
and budget, they still do not use open formats. Openness has created
more transparent judicial environments but has not led to judicial
accountability yet.
Research Question: What are the most important changes that have resulted from the publication of judicial data?
Do judiciaries publish their information in open formats?
Method
The methodology was divided into 4 stages:
Conclusions
• Judicial information does not yet comply with all requirements for being considered as open data.
• Proactive data publication took place because of a belief in the obligation to make the justice service more
transparent, rather than for reasons of efficiency.
• Despite the efforts made, there is still a lack of balance between the supply and demand of judicial data.
• The will of judicial branches to implement open data is crucial, notwithstanding the openness at other levels of
government. While Uruguay shows a more enabling country context, it ranks at the bottom in judicial open data.
On the contrary, Argentina´s judicial branch has a wider information policy compared to its country context.

Evidence and findings
• Judicial officers in Uruguay and Argentina did not know about the concept of
open data. In Chile some of them did. Users had more information about open
data.
• All three countries got the highest scores in the non-discrimination standard.
One flaw was the need of licenses for the use of software.
• The three countries have high results on accessibility. The information was
available as a whole, without cost, and ready for downloading.
• Argentina ranked on top for reusability, followed by Uruguay and then Chile.
The three countries use data formats that do not allow it to be easily exported.
• The three countries provide updated information, indicating a trend towards
the sustainability of this policy.
• Users and officials interviewed agreed that the quantity of information should
increase. They also agreed that the information is not systematically used to
design public policy and to promote accountability. They said that the public
at-large does not know how to use the information.
