Margaret has been appointed as the manager of the Stilfontein Gold Mine. Her responsibilities include overall management of the mine in accordance with the Mine Health and Safety Act, including commissioning and decommissioning operations, appointing managers and representatives, ensuring a safe work environment, developing health and safety policies and programs, and ensuring training and risk assessments are conducted. She is responsible for planning and implementing various safety, health, and environmental management systems and programs. Margaret must also ensure compliance with all applicable legislation and company standards.
1. MANAGER MARGARET WATER COMPANY
1) APPOINTMENT RESPONSIBILITIES
a) APPOINTMENT AS EMPLOYER REPRESENTATIVE IN TERMS OF SECTION 7.2
Responsible for the overall management of the mine and the responsibilities of the Mine
Health and Safety Act, and without detracting from the above, your duties in terms of the
said Act will include the following:
Duties in terms of Chapter 2; Section 2, 3, 4, 5, 6 & 7:
Commissioning, operation, decommissioning of a mine Appointment of mine managers
appointment of employer representatives ensure healthy and safe mine environment ensure
supplies of PPE staffing of a mine
Section 8 - preparation of health and safety policy
Section 9 - preparation of voluntary and or prescribed Codes of practice
Section 10 - ensure training
Section 11 - ensure programme of risk assessment
Section 12 ensure programme of occupational hygiene assessments
Section 13 to 20 - ensure programme/administration of medical surveillance
Chapter 3 - ensure collective agreements/system of representatives and
committees
Your duties will include the following:
1.planning and implementing a SHEQ management system
2.implementing / participating in SHEQ audits
3.incident investigation and (trend) analysis
4.change management procedures (including corrective and preventative action)
5.SHEQ implications in purchasing systems
6.PPE supply and distribution systems
7.occupational health and hygiene programmes
8.environmental management programmes
9.quality management programmes.
You are to take all reasonably practicable measures, within your area of responsibility, to
ensure the general safety and health of persons, and the enforcement of health and safety
requirements as may be imposed by the company, the applicable Government Department or
the mine health and safety legislation.
You are to maintain a good working knowledge of the provisions of the mine health and
safety legislation, as may be amended from time to time, as well as other legislation which
may have relevance for your responsibilities, and ensure the same are implemented and
adhered to.
You are to ensure that you are familiar with all company health and safety standards. This
will include, but not be limited to instructions, codes of practice, safe working procedures
and general health and safety rules. Where standards and instructions are issued by the
employer, you are to make yourself conversant with these, and ensure the same are
implemented and adhered to.
You are to ensure that you are familiar with all permits, permissions and exemptions, as may
be imposed by external authorities, including, but not limited to, the Department of Minerals
and Energy. You shall ensure that, as may be applicable, the same documents are at ail
times kept up to date.
2. b) APPOINTMENT IN TERMS OF SECTION 3(1) OF THE MINE HEALTH AND
SAFETY ACT NO. 29 OF 1996 ("THE ACT")
In terms of Section 3(1) of the Act you are hereby appointed as the manager of Stilfontein
Gold Mine, ("the mine").
You will be responsible for the day to day management of the mine and in addition, you are
required to carry out any responsibilities which may be placed on managers in terms of the
Act.
It is important to note that the Act includes any schedules, the regulations, and any condition,
suspension notice, order, instruction, prohibition, authorisation, permission, consent,
exemption, certificate or document determined, given, issued, promulgated or granted by or
under the Act by the Minister, the Chief Inspector, an Inspector, or any other person who has
been authorised in terms of the Act.
You are also appointed in terms of Section 7(2) of the Act to perform the functions of the
employer in terms of the Act. Without limiting the general nature of your duties you are
required, to the extent reasonably practicable to:
1. Take all steps to ensure that all persons under your charge are fully conversant with
the provisions of applicable mine health and safety legislation as amended or
replaced from time to time.
2. Observe and enforce any codes of practice; any instructions, procedures, directives,
permissions, exemptions etc issued by the employer, the Department of Mineral and
Energy or any other person who is authorised to do so.
3. Be responsible for the discipline of all persons under your charge.
4. Provide and maintain a working environment that is safe and without risk to the
health of employees within your area of responsibility.
5. Identify relevant hazards and assess the related risks within your area of
responsibility, to which persons who are not employees may be exposed, and
ensure that persons who are directly affected by activities within your area of
responsibility are not exposed to any hazards to their health and safety.
6. Consider an employee's training and capabilities in respect of health and safety
before assigning tasks to that employee,
7. Provide proper and adequate health and safety training.
8. Provide employees within your area of responsibility with any information,
instruction, training or supervision that is necessary to enable them to perform
their work safely and without risk to health.
9. Report any contraventions of the Act or Regulations, Codes of Good Practice,
instructions, exemptions, etc.
10. You are required to ensure that the aims and objectives of the Act are achieved
by complying with the following broad principles:
a. the implementation of a risk identification and assessment programme;
b. providing adequate and proper training;
c. providing adequate and proper supervision;
d. the creation of systems; and the establishment of effective and proper
enforcement mechanisms.
e. You are also responsible in terms of the National Environment
Management Act No. 107 of 1998 to be responsible for the protection of
the environment against damage from any mining activities at Stilfontein
Gold Mine.
11. You are further appointed in terms of the National Water Act No. 36 of 1998, for
the conservation and management of water at Stilfontein Gold Mine.
12. If you, for any reason, are unable to discharge your responsibilities in terms of
this appointment, you are to bring this to the attention myself.
13. You are further required to bring to my attention the need to appoint a person
to assume your responsibilities in instances where you are going to be absent
from the mine, or on leave.
a. I however draw to your attention the fact that the appointment of
persons to assist you, or to assume your responsibilities in your

relieve you of any accountability or responsibility for the proper
discharge of your functions.
2) LEGAL ENGINEERING RESPONSIBILITIES
a) Weekly conveyance inspection
b) Weekly humble hook inspection

d) Weekly winder trip inspection
e) Monthly shaft examination
f) Weekly rope examination
g) Monthly NDT testing of structures
h) Monthly dynamic tests and level 1 audits
i) Monthly electromagnetic rope testing
j) Yearly drum, brakes and gearbox examinations
k) Yearly rope cutting and analysis
3) DESCRIPTION OF POSITION REQUIREMENTS
a) have full supervisory control over MWC employees
b) Direct representative capable of making sound decisions on behalf of MWC.
c) must possess good administrative, public relations and maintenance skills necessary
to enhance overall operations
d) Plan, lead organise and control the total business plan of MWC
e) Produce a financial budget and control it completely
f) Establish procedures and policies for MWC
g) Will be the MWC representative in dealing with all regulatory bodies.

i) Ensure adequate financial records and internal controls to provide timely and
accurate financial statements.
ii) Ensure that the company’s assets are adequately safeguarded from loss.
iii) Prepare all budgets and financial projections.
iv) Perform in-depth financial analysis and promptly address financial problems.
v) Plan for the company’s financial future, financing needs, future profitability, etc.
c) Marketing
i) Prepare comprehensive marketing plans and market potential.
ii) Ensure that the company is effectively presented to customers and its local
market.
iii) Use the marketing function to build long-term stability for the company.
iv) Monitor and work to improve customer service levels.
d) Operations
i) Efficiently and effectively organize the company’s operations to maximize
profitability.
ii) Identify and address operational problems in a timely fashion.
iii) Plan for the company’s ongoing operational needs, including technology,
facilities, and equipment.
e) Human resources
i) Establish personnel policies and procedures that are effective and support the
company’s values.
ii) Ensure adequate employee training, evaluation, safety, and personnel systems.
iii) Monitor all personnel and plan for improvement as needed.
f) Planning and leadership
i) Ensure adequate planning for the company’s future
ii) Provide leadership by communicating well, maintaining good business
