INTRODUCTION
 The National Trust is a statutory body of the Ministry of Social Justice and
Empowerment, Government of India, set up under the “National Trust for the
Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple
Disabilities” Act (Act 44 of 1999)
 An Act to provide for the constitution of a body at the national level for the
Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple
Disabilities and for matters connected therewith or incidental thereto.
VISION OF THE NATIONAL TRUST
 An inclusive society which values human diversity and enables and empowers full
participation of Persons with Disability to live independently with dignity, equal rights
and opportunities.
 The National Trust’s vision statement reflects a very changed India for all Indians and is
based on human rights, i.e. UNCRPD, approach. The vision statement focuses NT as
being a leader in the disability sector in India. As laws focusing on Persons with
Disability are changing, focused leadership needs to be established. Working through
local and regional registered organizations and local level committees, the National Trust
must make its vision and focus clear throughout the country.
MISSION OF THE NATIONAL TRUST
 The National Trust works towards providing opportunities for capacity development of
Persons with Disability and their families, fulfilling their rights, facilitating and
promoting the creation of an enabling environment and an inclusive society.
The National Trust’s mission, or fundamental purpose, is to create an enabling
environment, i.e. providing opportunities for Persons with Disabilities through
comprehensive support systems which can also be done by collaborating with other
Ministries, etc., which will lead towards development of an inclusive society.
OBJECTIVES OF THE ACT
 This Act provides for the constitution of a national body for the Welfare of Persons with
Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities. Such a national body
will be a trust whose objects shall be as under:
 (a) to enable and empower persons with disability to live as independently and as fully as
possible within and as close to the community to which they belong;
 (b) to strengthen facilities to provide support to persons with disability to live within their
own families;
 (c) to extend support to registered organization to provide need based services during the
period of crisis in the family of persons with disability;
 (d) To deal with problems of persons with disability who do not have family support;
 (e) To promote measures for the care and protection of persons with disability in the
event of death of their parent or guardian;
 (f) To evolve procedure for the appointment of guardians and trustees for persons with
disability requiring such protection;
 (g) To facilitate the realization of equal opportunities, protection of rights and full
participation of persons with disability; and
 (h) To do any other act which is incidental to the above said objects. The Act received the
assent of the President on 30th December, 1999 and extends to the whole of India.
DISABILITIES UNDER NTA
 The National Trust works for the welfare of persons with any of the following four disabilities
 Autism: means a condition of uneven skill development primarily affecting the communication and social
abilities of a person, marked by repetitive and ritualistic behavior;
 “cerebral palsy” means a group of non-progressive conditions of a person characterized by abnormal motor
control posture resulting from brain insult or injuries occurring in the prenatal, prenatal or infant period of
development;
 “Mental retardation” means a condition of arrested or incomplete development of mind of a person which
is specially characterized by sub normality of intelligence;
 “multiple disabilities” means a combination of two or more disabilities. These are blindness, low vision,
leprosy cured, hearing impairment, locomotors disability, mental retardation and mental illness;

 FINANCE
 Grants by the Central Government - The Central Government may, after due
appropriation made be Parliament by law in this behalf, make to the Trust a one-time
contribution of rupees one hundred crores for a corpus, the income whereof may be
utilized to achieve the objects of the Trust under this Act. 22.
 Fund
1. There shall be constituted a Fund to be called National Trust for the Welfare of Persons with Autism, Cerebral Palsy,
Mental Retardation and Multiple Disabilities Fund and there shall be credited thereto-
(a) all moneys received from the Central Government;
(b) all moneys received by the Trust by way of grants, gifts, donations, benefactions, bequests and transfers;
(c) all moneys received by the Trust in any other manner or from any other source.
2. All moneys belonging to the fund shall be deposited in such banks or invested in such
manner as the Board may, subject to the approval of the Central Government, decide.
3.The Funds shall be applied towards meeting the administrative and other expenses of the
Trust including expenses incurred in the exercise of its powers and performance of duties by
the Board in relation to any of its activities under section 10 or for anything relatable thereto.
 Conclusion
 The National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental
Retardation, and Multiple Disabilities Act is an important piece of legislation in
India that provides for the welfare of persons with disabilities. The act recognizes
that persons with disabilities have the right to live with dignity and have access to
education, employment, and other opportunities. The act also recognizes that
persons with disabilities have the right to participate in all aspects of society,
including social, cultural, and recreational activities. The act has had a significant
impact on the lives of persons with disabilities in India and has helped to ensure
that they are not discriminated against and are provided with equal opportunities
to participate in society.

  • 5. MISSION OF THE NATIONAL TRUST  The National Trust works towards providing opportunities for capacity development of Persons with Disability and their families, fulfilling their rights, facilitating and promoting the creation of an enabling environment and an inclusive society. The National Trust’s mission, or fundamental purpose, is to create an enabling environment, i.e. providing opportunities for Persons with Disabilities through comprehensive support systems which can also be done by collaborating with other Ministries, etc., which will lead towards development of an inclusive society.
  • 6. OBJECTIVES OF THE ACT  This Act provides for the constitution of a national body for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities. Such a national body will be a trust whose objects shall be as under:  (a) to enable and empower persons with disability to live as independently and as fully as possible within and as close to the community to which they belong;  (b) to strengthen facilities to provide support to persons with disability to live within their own families;  (c) to extend support to registered organization to provide need based services during the period of crisis in the family of persons with disability;
  • 7.  (d) To deal with problems of persons with disability who do not have family support;  (e) To promote measures for the care and protection of persons with disability in the event of death of their parent or guardian;  (f) To evolve procedure for the appointment of guardians and trustees for persons with disability requiring such protection;  (g) To facilitate the realization of equal opportunities, protection of rights and full participation of persons with disability; and  (h) To do any other act which is incidental to the above said objects. The Act received the assent of the President on 30th December, 1999 and extends to the whole of India.

DISABILITIES UNDER NTA  The National Trust works for the welfare of persons with any of the following four disabilities  Autism: means a condition of uneven skill development primarily affecting the communication and social abilities of a person, marked by repetitive and ritualistic behavior;  “cerebral palsy” means a group of non-progressive conditions of a person characterized by abnormal motor control posture resulting from brain insult or injuries occurring in the prenatal, prenatal or infant period of development;  “Mental retardation” means a condition of arrested or incomplete development of mind of a person which is specially characterized by sub normality of intelligence;  “multiple disabilities” means a combination of two or more disabilities. These are blindness, low vision, leprosy cured, hearing impairment, locomotors disability, mental retardation and mental illness;

  • 12.  FINANCE  Grants by the Central Government - The Central Government may, after due appropriation made be Parliament by law in this behalf, make to the Trust a one-time contribution of rupees one hundred crores for a corpus, the income whereof may be utilized to achieve the objects of the Trust under this Act. 22.  Fund 1. There shall be constituted a Fund to be called National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Fund and there shall be credited thereto- (a) all moneys received from the Central Government; (b) all moneys received by the Trust by way of grants, gifts, donations, benefactions, bequests and transfers; (c) all moneys received by the Trust in any other manner or from any other source.

All moneys belonging to the fund shall be deposited in such banks or invested in such manner as the Board may, subject to the approval of the Central Government, decide. 3.The Funds shall be applied towards meeting the administrative and other expenses of the Trust including expenses incurred in the exercise of its powers and performance of duties by the Board in relation to any of its activities under section 10 or for anything relatable thereto.
