“
• Facts of the case: Mr. Mpoy was granted a provisional Special Education
Teaching Certificate and recruited by The New Teacher Project for the 2007-
2008 school year. During that year he claims he was asked to change grades,
standardized test scores, and alter achievement reports for students, to
which he refused. He states he was investigated, harassed, threatened, and
suspended, then terminated for not changing the records per his
administrators’ requests. The next year he filed a federal claim with the U.S.
District Court regarding violation of his First Amendment Right among other
claims.
He sued for six different counts based on his wrongful termination, lack of
financial assistance for education, and inability to secure meaningful
employment based on his termination.
• Questions: Was Mpoy terminated for his refusal to alter students’ records?
Is there proof that he was terminated for these actions?
• Ruling: The courts ruled that Mpoy had no proof or factual matter that the
defendants were liable for the misconduct. Also, his claim that the contract
he signed was for four years was really not.
• Rationale: The court’s rationale for the ruling was that he could be terminated
at any point under his provisional status, and that it was actually irrelevant as to
why he claimed to have been terminated. There is no public policy to prove his
claim.
• Implications: Emotional abuse is considered abuse when an average child
of ordinary intelligence would have comprehended that the acts were
improper, not just the particular child’s perceptions.
•In other words, if it would not be considered mistreating an “average
student” then is can’t be construed as mistreating a student with special
needs.
•Implications: Know your state laws. You will have to choose your own
ground and stand by it. Ultimately you live with your own ethical choices.
•Personal Code of Ethics!!!
