The parties, both the Plaintiffs and Defendants, are urged to
seek remedial action through Alternative Dispute Resolution.
Both Judge Cahill and Judge Kurren have been charitable by
temporarily enjoining Plaintiffs and Defendants from proceeding
and thereby granting the parties a “cooling off” period - a time for
reflection, introspection and possible voluntary resolution.
The voter approval of the Maui GMO Moratorium must be
retained and preserved. Approval communicated the wide spread
concerns of the community and health conscious consumers.

For the proponents of GMO the approval of the Maui GMO
Moratorium was an awakening to the power of the people.
“Hawaii ain’t the same as the Mainland.” To be able to resolve
differences through open discussion and to seek pathways using
knowledge-based and innovative processes is the Hawaiian-Style of
promoting and being involved in healthy business and community
relationships.
Having the Judiciary order and mandate direction may be
acceptable as a pathway. The Law is unemotional – just the facts,
the evidence and past precedent.
In my previous Facebook post I urged Monsanto to “keep the
powder dry and holster its guns.”
The Maui Plaintiffs pulled the trigger in anticipation, fired the
first shot and drew first blood. Monsanto and Dow AgroSciences
filed suit in reaction.
Respectfully, we humbly and sincerely urge and encourage the
parties to this litigation set an agenda for meetings to outline areas
of agreement and disagreement, develop positive actions and
strategies to address and resolve areas of disagreement and to
finalize a course for continued overview and analysis.
Litigation protracts and extends conflict, contentiousness, and
disharmony. Once healthy, vibrant and productive relationships
among businesses, in the community and among individuals, co-workers,
friends and families are placed on uneven keel and
stressed to points of severance.
Diplomacy is preferred as a path to continue in the direction to
develop and reach mutual accord and agreement.
We request you take example of our world leaders by their
diplomatic missions to develop agreement on issues and matters of
far reaching benefit for all people.
