The Ethics of Whistle-Blowing: A Case Study of the NSA and Snowden
The right to privacy is an emotive aspect of public life across American society. The significance of the right gained added importance in the face of the government crackdown on terrorism. The so-called War on Terror that began in the aftermath of the September 11 terrorist attacks in the United States included government collection of massive information relating to its citizens and abroad. The global surveillance adopted by U.S security agents permeated the private sphere of American citizens raising a critical question on government overreach in the fight against terrorism. While the essence of privacy was not in question, the debate has often surrounded the ethics of collecting private data on millions of Americans without their knowledge. The 2013 global surveillance disclosures by Edward Snowden, a former employee of the NSA raised fundamental ethical questions on the role of whistle blowing and its implications for the whistle blower. Equally important is the conflicting view on the morality of Snowden’s action given the security implications for disclosing such a large amount of information touching on the country’s security. Although the United States Constitution does not expressly state the right to privacy, the Fourth Amendment alludes to this fact stating:
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized" [CITE]
Whistle blowing refers to the decision to call attention to misconduct within an organization by its current or former employee. The Government Accountability Project elaborates on the different ways an employee can whistle-blow. An employee may choose to report the wrong doing directly to state authorities. Alternatively, employees may report misconduct to a superior or refuse to participate in the unethical behavior. Snowden discovered that the Unites States government was actively engaged in activities that grossly violated ethical and legal provisions. The former employee decided to leak the massive information to the media creating unprecedented domestic and diplomatic crisis that threatened to injure the standing of the country in the international community. Although the U.S government termed the action of Snowden as an illegality and opened criminal proceedings against him, many have termed the act as appropriate because it reflected the interests of the public.

Reform the Nation’s Prison and Sentencing Laws?

Representative Goodlatte, of the Sixth District of Virginia, was first elected to the U.S.
House of Representatives in 1992. He was the District Director for then-Representa-
tive Caldwell Butler (VA-R) from 1977 to 1979 and a practicing attorney from 1979 to
1992. He chairs the Judiciary Committee and also sits on the Agriculture Committee.
The following is from the May 22, 2018, House floor debate on H.R. 5682, the FIRST
STEP (Formerly Incarcerated Reenter Society Transformed Safely Transitioning Every
Person) Act.
I rise in strong support of H.R. 5682, the FIRST STEP Act. The bipartisan bill before us
is a meaningful, historic criminal justice reform measure. The FIRST STEP Act places
a new focus on rehabilitation.
While we recognize criminal behavior needs to be punished and criminals need
to be incarcerated, we must also acknowledge that our prison population needs to be
rehabilitated to the greatest extent practicable.
The bill establishes a risk and needs assessment as the basis of both an effective
recidivism reduction program and an efficient and effective Federal prison system. The
FIRST STEP Act will incentivize prisoners to participate in evidence-based recidivism
reduction programs, productive activities, and jobs that will actually reduce their risk
of recidivism.
We know that over 90 percent of all prisoners within the Bureau of Prisons will be
released someday. That is an indisputable fact. We also know that without programming
and intervention, which can train prisoners to be better citizens, not better criminals,
prisoners are more likely to recidivate.
Rather than allowing the cycle of crime to continue, this legislation takes a practical,
intelligent approach to rehabilitation. By using a focused approach for each prisoner, we
can lower the risk of recidivism. That is what H.R. 5682 does. Fewer recidivists means
fewer prisoners in the future. It means greater savings to the American taxpayer. More
importantly, it means safer communities, fewer crimes, and, of course, fewer victims.
It also means greater opportunities for people once they leave prison.
This bill is important because when prisoners who have received intervention and
rehabilitation are released, they are less likely to commit crimes. When that happens,
our streets are safer and innocent civilians are less likely to be victimized. Rehabilitated
prisoners are more likely to leave the life of crime behind, become productive members
of society, and contribute to their c.

According to Legal Information Institute (n.d.), “Affirmative Action is a set of procedures designed to eliminate unlawful discrimination among applicants, remedy the results of such prior discrimination, and prevent such discrimination in the future. Applicants may be seeking admission to an educational program or looking for professional employment. In modern American jurisprudence, it typically imposes remedies against discrimination on the basis of, at the very least, race, creed, color, and national origin” (para. 1).
The 1960’s Civil Rights Movement created an outcome that would forever change racial equality based on a person’s race, creed, sex and national origin. The term “separate but equal” was a falsehood regarding these class members, particularly with race and how they were treated. The movement would prompt legislation in the form of Executive Order 10925 that would make it illegal to discriminate based on these classes and signed into law by President Kennedy in March of 1961 (United States Department of Labor, n.d.).

Hawaii County Mayor Mitch Roth is asking the state if he can publish a list of travelers who
are supposed to be in quarantine. Roth, a former county prosecutor, says there's not enough
quarantine enforcement and he believes too many rule breakers are out in public ― potentially
spreading COVID. He said last month more than 100 people flew to Hawaii Island and had to
quarantine because they couldn't prove they were vaccinated or had a negative COVID test.
The ACLU of Hawaii said publishing the list does pose potential concerns.
“These include the inherent concerns about health privacy regardless of whether someone
is demonstrably ill, concerns about possible vigilantism against people whose names
appear on the list, concerns about violations of privacy stemming from such publication,”
said Executive Director Joshua Wisch, adding that there are also general concerns about
unintended consequences.

ANY PERSON violating any rule of the governor or mayor prescribed and promulgated
pursuant to this chapter and having the force and effect of law, shall, if it shall be so stated in
the rule, be guilty of a misdemeanor. Upon conviction, the person shall be fined not more
than $5,000, or imprisoned not more than one year, or both.
ANY PERSON who intentionally, knowingly, or recklessly destroys, damages, or loses any
shelter, protective device, or warning or signal device, shall if the same was installed or
constructed by the United States, the State, or a county, or is the property of the United States,
the State, or a county, be fined the cost of replacement, or imprisoned not more than one year,
or both. The governor or mayor, may, by rule, make further provisions for the protection from

EQUAL JUSTICE FOR ALL
PROSECUTORIAL DISCRETION - CITE AND DIVERT
It's different than “cite and release” which allows someone to avoid going to jail, but still
comes with a criminal charge. Divert means there is no arrest, no jail time and no criminal
charge on someone's record if they follow the plan. “The major benefit to the Cite and
Divert Program is that it provides an opportunity to stay out of the criminal justice system
and keep the criminal record clean,” the sheriff's office statement said. “Rather than going
to jail and having a case filed, a person will meet with a prosecutor from the Criminal
District Attorney's Office who may recommend an appropriate course of diversion.”
The program will give law enforcement officers an additional option when they think a
warning is not enough, but jail time is too harsh. The sheriff's office said cite and divert
was discussed about a year ago with no action, but with the current COVID-19 outbreak
among jail inmates and staff, it was decided by law enforcement administrators that it
would be best to move forward with it now. The anticipated launch date is Sept.1.

I believe in having a transparent government. I agree with the governor's initial suspension
of the open government laws for a limited time and limited purpose as decisions needed to
be made quickly when the emergency first started. This action was taken to allow
government operations to continue while ensuring that quarantine procedures to protect the
health and safety of state residents and visitors were capable of being complied with.
However, now that the pandemic has gone on for several months, I believe we should look
to other avenues of allowing the public to have notice and access to open meetings and
public records. Roth has served as the prosecuting attorney for Hawai`i County since
November 2012. Prior to that, he served as the deputy prosecutor in Hilo for 13 years, and
as the deputy prosecutor for the City & County of Honolulu for five years. “It was a
difficult decision, leaving as prosecutor, but, on the other side of that, I see that if we go
upstream, we can solve more problems before they get to the prosecutor's office,” Roth
said. Mayor Roth described that the pandemic also exposed the need for infrastructure and
the need to bring them back to a “decent standard.”
