SUMMARY
An ordinance canvassing the returns and declaring the results of a Special Election held on May
1, 2021.
BACKGROUND
On February 8, 2021, Council ordered a special election for the voters to consider the Proposition
A: the reauthorization of local sales and use tax at the rate of one-half of one percent to continue
providing revenue for maintenance and repair of municipal streets. The City of Alamo Heights
contracted Bexar County to conduct all election activities. The election was held on Saturday,
May 1, 2021 for all precincts 3020, 3025 and 3026.
The official returns show 1,446 ballots cast which resulted in 25.32% of the 5,712 registered
voters.
POLICY ANALYSIS
Election Code 67.002 mandates a canvass of the election results to make officiate results. The
governing body is the local authority to canvass election results.

ORDINANCE CANVASSING ELECTION RETURNS AND
DECLARING THE RESULTS OF THE MAY 1, 2021,
SPECIAL ELECTION FOR REAUTHORIZATION OF A
ONE-HALF OF ONE PERCENT LOCAL SALES AND USE
TAX IN THE CITY OF ALAMO HEIGHTS, TEXAS, FOR
CONTINUED MAINTENANCE AND REPAIR OF
MUNICIPAL STREETS; AND SETTING AN EFFECTIVE
DATE.
WHEREAS, the City Council of the CITY OF ALAMO HEIGHTS, TEXAS (the "City") on
February 8, 2021, ordered a Special Election to be held in the City on May 1, 2021, on
PROPOSITION A, to determine if the local sales and use tax for maintenance and repair of
municipal streets should be reauthorized per Section 327.007 of the Texas Tax Code, hereinafter
stated (the "Election"); and
WHEREAS, the City Council submitted to all residents, qualified electors of the City for
their action thereupon at the Special Election the following proposition:
PROPOSITION A
THE REAUTHORIZATION OF LOCAL SALES AND USE TAX IN THE
CITY OF ALAMO HEIGHTS AT THE RATE OF ONE-HALF OF ONE
PERCENT TO CONTINUE PROVIDING REVENUE FOR MAINTENANCE
AND REPAIR OF MUNICIPAL STREETS. THE TAX EXPIRES ON THE
FOURTH ANNIVERSARY OF THE DATE OF THIS ELECTION UNLESS
THE IMPOSITION OF THE TAX IS REAUTHORIZED.
WHEREAS, the City Council has investigated all matters pertaining to the Special
Election, including the ordering, giving notice, officers, holding and making returns of the
Special Election; and
WHEREAS, the election officers who held the Special Election have duly made the
returns of the result thereof, and said returns have been duly delivered to the City Council; and
WHEREAS, the City Council hereby canvasses the returns of the Special Election,
during which the following votes were cast "For" and "Against" Proposition A stated above:

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALAMO HEIGHTS, TEXAS, THAT:
1. FINDINGS. The City Council officially finds and determines that the Election was
duly ordered; proper notice of the Special Election was duly given; proper election officers were
duly appointed prior to the Special Election; the Special Election was duly held; the City has
complied with the Federal Voting Rights Act and the Texas Election Code; due returns of the
result of the Special Election have been made and delivered; and the City Council has duly
canvassed said returns, all in accordance with law and the Ordinance calling the Special Election.
2. SALES TAX PROPOSITION CANVASS. The City Council officially finds and determines
that the following votes were cast at the Special Election on the submitted PROPOSITION A by
the resident, qualified electors of the City who voted at the Special Election:

3. ELECTION RESULTS. The City Council officially finds, determines, and declares the
result of the Election to be that the PROPOSITION so submitted has received a favorable
majority vote in all respects and has carried.
4. RECITALS. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a
part of the judgment and findings of the City Council.
5. All Ordinances or parts thereof, which are in conflict or inconsistent with any
provision of this Ordinance are hereby repealed to the extent of such conflict, and the provisions
of this Ordinance shall be and remain controlling as to the matters resolved herein.
6. It is officially found and determined that the meeting at which this Ordinance is
adopted was open to the public and public notice of the time, place, and subject matter of the
public business to be considered at such meeting, was given, all as required by Chapter 551,
Texas Government Code.
7. This Ordinance will become effective immediately upon its passage by the City
Council.
