2. Instructions

juvenile delinquency.

★ Present it to the class.

3. What’s considered Juvenile Delinquency?
It is all criminal act committed
by a minor, a person under 18
years old, like theft, murder,
etc.

4. This can be caused by a bad environment
with conflicts, crimes and drugs, lack of
attention of the family, and because of
social maladjustment and the poor employment
opportunities in addition of the mediocre education.
This makes the child think that he need to steal
because he doesn’t know how to earn money from
another way. A minor with this problems can’t be
integrated to the society easily, because he was not
socially educated.
Factors that provokes it

5. Chilean Law against delinquency
The government have the Reforma
Procesal Penal, it’s the best
structural change in the chilean
Criminal Justice ever. It was a
change in the way how the judicial
system sentences the criminals.
It meant the end of the inquisitorial
system.

6. The way to penalize a minor in cases of
crimes in Chile consist in many facts,
there are points to have in mind when a
minor commit a crime:
● If you commit a crime and you are 14 years old or more, you will
be judged like an adult. Also exist divisions of punishments
depending of the crime you commit from communitary service,
citations, jail, probation, etc.
● Social reintegration: this fact apply to minors who commit many
crimes and don't have the possibilities to change because they
have a poor environment to develop them skills.
● The maximum penalty for criminal acts in a minor is 5 years of
prison, and the minimum is 60 days.

7. Entities involved
CONACE:
This organization (in spanish means National Council for the
Control of Narcotics) wants prevent and reduce drug use, and
warn what drugs provoke. To achieve this objective, CONACE
develop prevention programs (familiar, school, labor,
community and marginality
It also gives information to other entities to block the drug
traffic, and it wants to rehabilitate and reintegrate people
affected by the drugs.
Besides, it keeps relations with international organizations to
exchange information about the topic.

8. The Government of Chile
It proposes to the President regulations
and actions to keep the public order, security, and social peace;
and it applies that rules.
INJUV
In spanish National Institute of The Youth, this organization
have as objective to solve the problems of the youth, especially
of the most vulnerable groups, with different public politics.
They study the situation of the youth, and they give suggestions
to the president to improve
the situation.

9. CESC
Center for Studies on Public Safety in spanish, is an
organization of the Institute of Public Affairs of the University of
Chile, that is dedicated to the research, discussion and
dissemination of socio-cultural topics of the chilean society.
It wants to make a multidisciplinary community (respect to the
laws), and improve the knowledge of the society.

10. Civil Peace
It’s a foundation that study and make statistics of the conduct
of the population against the delinquency, they prevent at the
society with investigations, diagnostics and projects to avoid the
criminal conducts.
They also make forums, meetings, seminars and roundtables
with specialists to discuss and reflect about different problems
in the society, like juvenile delinquency.

11. Cases of Juvenile Delinquency abroad
In Peru, by the year 2014, two students of 14 year old tried to kill a
schoolmate with a pistol for the love of a girl in the school Micaela
Bastidas de Piura. The students were detained by the police and
taken to them parents, thanks to an assistant of the school, who
saw the intentions of the students, and called the police.
The minors were not sanctioned with the law,
but the police thought they could be part of a
criminal band.

12. In 2013, in Buenos Aires, Argentina, a 15 year old teenager
attacked a pizzeria called La Plaza with a knife, but the clients
captured and hit him, and he started to cry. His accomplice, who
was 18, escaped but other people captured too him.
The owner of the pizzeria was angry, but she was amazed
because of the youth of the delinquent. She scolded him and
said “You have all a life in front of you, you can’t be a criminal”.
The younger delinquent was released because
he was legally immune thanks to him age; the
older, known as “El Caralinda” had criminal
history, so he was taken to the police station.

13. Juvenile Delinquency in Chile: The case of
Cisarro
“Cisarro” is a popular young criminal that
could never be integrated into the
society. He have a long criminal record:
armed robbery, robbery with violence,
etc. He has been arrested since age 11, and now he’s 17 years old.
His family tried to change of city, change of environment, but he
continued stealing because the penalties for this criminal acts are
too low in the chilean law, and he and other delinquents know it,
they take advantage of that.
He doesn't go to school, entities like SENAME have tried to help
him, without success.
