Foundations of Islamic Economics
{writeup/video: http://bit.ly/AZfoie1} This talk explains how we can create an Islamic Economic system in Pakistan. The first part of the talk explains that one of the main obstacles to this project is the vast number of misunderstandings created by orthodox economic theory. In particular, a critical misconception is the idea that capitalism can be converted to an Islamic economy by minor modifications, such as setting interest rate to zero. Interest is integral to financial capitalism and cannot be set to zero without major modification in other economic areas. The second part of the talk explains that to create a zero interest economy, we must first create a zero inflation economy. Both are possible within a theoretical framework given by Modern Monetary Theory. This provides the policy prescriptions needed to create full employment and zero inflation, together with a zero interest rate. These are very close to an Islamic Economy ideals, which provides equal opportunities, basic needs and economic justice for all members of the community. The talk also discusses practical steps that we need to take in Pakistan, to achieve economic independence, as a first step towards an Islamic Economy.

During World War 2, the U.S. government forcibly relocated people of Japanese descent to internment camps, violating Fred Korematsu's civil rights. Korematsu challenged this action in Korematsu v. United States, arguing it violated his 14th Amendment protections. The Supreme Court ultimately ruled 6-3 in favor of the government, agreeing the need to protect against espionage outweighed the civil rights of Japanese Americans. While some supported the ruling out of wartime fears, others were troubled the government could override constitutional protections.

In particular, a critical misconception is the idea that capitalism can be converted to an Islamic economy by minor modifications, such as setting interest rate to zero. Interest is integral to financial capitalism and cannot be set to zero without major modification in other economic areas. The second part of the talk explains that to create a zero interest economy, we must first create a zero inflation economy. Both are possible within a theoretical framework given by Modern Monetary Theory. This provides the policy prescriptions needed to create full employment and zero inflation, together with a zero interest rate. These are very close to an Islamic Economy ideals, which provides equal opportunities, basic needs and economic justice for all members of the community. The talk also discusses practical steps that we need to take in Pakistan, to achieve economic independence, as a first step towards an Islamic Economy.

The state of Maryland imposed taxes on the Baltimore branch of the Second Bank of the United States in 1818, which the cashier James W. McCulloch refused to pay. McCulloch took the case to the Supreme Court, arguing that the Maryland tax was unconstitutional because Congress had established the national bank. The Supreme Court ruled 7-0 in favor of McCulloch, finding that Congress had the power to incorporate the bank and that Maryland could not interfere with the national government's powers through taxation. The decision established Congress's supremacy over the states.
marbury v madison
New justice positions were created before President Adams left office. He appointed justices with a federal ideology, but the appointments were never fully approved by Congress. One appointee, William Marbury, sued after being denied his position. In Marbury v. Madison, the Supreme Court ruled that while Marbury had a right to his appointment, the court could not force its issuance due to limits on its jurisdiction set by the Constitution. This established the Supreme Court's ability to declare acts of Congress unconstitutional.
Gibbons v ogden
The Supreme Court ruled in favor of Ogden, finding that the Commerce Clause gives the federal government exclusive power to regulate interstate commerce such as navigation between states. The case established that any interstate commerce falls under federal jurisdiction rather than state control, setting an important precedent for federalism.
Swann v
The Supreme Court unanimously ruled in Swann v. Charlotte-Mecklenburg County Schools that the federal government could oversee and enforce desegregation of schools, allowing it to establish quotas and consequences for states that did not desegregate, as the Charlotte-Mecklenburg County Schools had failed to desegregate nearly 20 years after the 14th Amendment and Brown v. Board of Ed prohibited segregated schools.
Texas v
Gregory Lee Johnson burned an American flag as a protest against Reagan administration policies. He argued this was protected under the first amendment. The Supreme Court ultimately ruled in 1989 that burning the flag was a form of expression protected by the first amendment and that the government could not criminally punish flag desecration to preserve it as a national symbol. Johnson had originally been sentenced to a year in prison and fined $2,000 for burning the flag.

The United States v. Lopez case involved a high school student who brought a concealed weapon to school in violation of the Gun Free School Zone Act of 1990. The Supreme Court ruled 5-4 that Congress exceeded its powers under the Commerce Clause to enact the law, as possession of a firearm near a school did not qualify as interstate economic activity. This case established limits on Congress's ability to regulate non-economic intrastate activities under the Commerce Clause.
Roe v. Wade
Norma McCorvey (known as "Jane Roe") was pregnant during the Roe v. Wade Supreme Court case about abortion rights. She had claimed to be raped to qualify for an abortion, though this was later found to be false. Henry Wade, a Texas lawyer, argued against abortion rights before the Supreme Court. The Court decided in 1973 that illegal abortion violated a woman's right to privacy under the 14th Amendment and was a fundamental right. This legalized abortion nationwide.
Schench v US
Schenck mailed circulars urging draftees to oppose the draft, claiming it was a monstrosity. He was charged with conspiracy to cause insubordination. The Supreme Court ruled 9-0 against Schenck, finding that speech considered free during peacetime can be interpreted differently during war when it could incite violence and harm, as Congress has the power to prevent. The ruling meant Americans could not speak out against the draft in such a manner during wartime.
