DFARs Part #253
The Defense Acquisition Regulations Part 253 Forms is currently one of the DFARS Shortest Parts and has gotten
dramatically shorter since 2014.
This shortening has done a disservice to Government Contractors. Before the DFARS had listed selected
illustrated forms by name under “Illustration of Forms.” No longer.
Therefore, a contractor is well served by looking at an earlier version of the DFARS Part 253 and then cross
referencing with the current DFARS Part 253. The current FAR PART 253 at SUBPART 253.3 —ILLUSTRATION OF
FORMS lists every DoD form whether related or unrelated to Government contracts.
Fortunately, the earlier DFARS live on in the web even on DOD websites. See

Accordingly, the court declines to find that no meeting of the minds occurred simply because the Army
Corps utilized an expired, but materially identical, version of DD Form 1155. See Penn–Ohio Steel
Corp. v. United States, 354 F.2d 254, 267 (Ct.Cl.1965) (holding that when a Government official has
approved a contract, but not filled out a “pro forma approval and a formal document,” a contract is
nonetheless formed, and that to hold otherwise “would exalt form over substance” (internal quotation
marks omitted)).

The awardee's failure to submit pricing for data items on the Contract Data Rights List (CDRL), DD
Form 1423, with its best and final offer for the contract does not adversely affect the acceptability or
price of the proposal or the government's rights under the contract, where the awardee submitted
acceptable CDRL pricing data with the initial proposal, since CDRL pricing data is not part of the
contract, the cost of data items is included in contract line item prices, and the purpose for obtaining
such data prices is to evaluate the cost of data items in terms of their management or product or
engineering value to the government.
