Bill Welch has been a bid protest litigator for the past 32 years. Bill has
litigated protests at the GAO, the Court of Federal Claims, the Federal Aviation
Administration (FAA), the Small Business Administration Office of Hearings and
Appeals (OHA) (including size protests and NAICS code protests), and Service-
Disabled Veteran-Owned Small Business (SDVOSB) protests. He also has
experience arguing appeals from these venues in the Court of Appeals for the
Federal Circuit. His clients include federal contractor entities and organizations from
across the nation and around the world involved in directly performing prime
contracts with the U.S. Government or serving as a subcontractor at any tier on
such projects or programs.
Mr. Welch joined Reston Law Group, LLP as Partner, when McMahon,

FEDERAL PROCUREMENT DATA SYSTEM
• FAR 4.6 – Requires Federal Procurement Officials to Report Contract Award Data to the Federal
Procurement Data System (“FPDS” or “FPDS Next Generation”).
• FPDS provides near real-time data of contract awards going back, supposedly, to 1979 (DoD
award announcements are usually delayed 90 days)
• Procurement Officials are required to report contract data to FPDS
• Anyone can access the information through www.fpds.gov. Users may access standard reports
for awards and agency spending or may create their own reports
• Excellent source for information on Agency awards over a select period
• Especially important for public information on competitor identity performing within agencies, size
of competitor awards over the last few years, and identifying potential teaming partners
performing within an agency.

FEDERAL PROCUREMENT DATA SYSTEM (con’t)
• The Senior Federal Procurement Official and Head of the Procuring Activity are
responsible for reporting all agency Contract Actions (except for classified
procurements).
• Reportable Contract Actions include any action that results in the purchase, rent, or
lease of supplies or equipment, services, or construction using appropriated dollars
over the micro-purchase threshold, not including grants or real property leases among
others.
• Includes reporting on indefinite delivery contracts, Government Wide Acquisition
Contracts (GWACs), FSS awards, BPAs and Basic Ordering Agreements (BOAs)
• Does not include subcontracting data, contract accounting data, or funding data.

SAFEGUARDING CLASSIFIED INFORMATION TO CONTRACTORS
(NISP)
• Agencies must follow the National Industrial Security Program (NISP),
which safeguards Federal Government classified information released to
contractors (as opposed to use of classified information within
Government Agencies).
• The National Industrial Security Program is administered through the
National Industrial Security Program Operating Manual (NISPOM).
• Administered primarily by the Department of Defense

REPORTING EXECUTIVE COMPENSATION AND SUBCONTRACTOR
DATA
• FAR Subpart 4.14 requires contractors to meet FAR 52.204-10’s
requirement to report the contractor’s Executive Officers’, Managers’,
and/or Partners’ compensation if the contractor is awarded a contract
over $30,000.
• It also requires contractors to disclose information regarding the prime
contractor’s first-tier subcontractors including the award date, the
subcontract value, a description of the products and services being
provided, and executive compensation of the first-tier subcontractor.

SYSTEM FOR AWARD MANAGEMENT (SAM REGISTRATION SYSTEM )
• The Government is required to maintain a database of federal contractors referred to as the System for
Award Management or “SAM” system.
• The Government originally intended SAM to facilitate locating sources for supplies or services for
government acquisition.
• Any contractor submitting an offer, bid, or quote to the Government must be registered in SAM. The
registration has to be complete, current, and accurate and monitored and updated by the contractor.
• The Government is not allowed to make an award to a contractor not included in the SAM system or who
has an expired registration.
• SAM has a history of serious administration problems that have impacted prospective contractors.
• New joint ventures created for limited purposes must meet the same SAM registration requirements.
