4. The Food Safety Act was first published in 2013 by the
Ministry of Food, Government of the People’s Republic
of Bangladesh.
It is the Act no. 43 of 2013.
An Act to make provisions for the establishment of an
efficient and effective authority and for regulating,
through coordination, the activities relating to food
production, import, processing, stock, supply, marketing
and sales etc.
To ensure the rights toward access to safe food through
appropriate application of scientific process
5. It contains 13 chapters. Such as:
Preliminary
Institutional Structure of Food Safety System

Fund, Budget and Accounts Audit
Prohibitions related to Food Safety Management System
Special Responsibilities of Food Business Operators
Food Analysis and Testing
Inspection and Seizure of Food

Administrative Inquiry and Fine
Miscellaneous
6. There are 90 sub chapters within the 13 chapters.
These are title, definition, explanation of the chapter etc.
There is also a schedule on
a) Sections
b) Description of offences
c) Impossible penalty for the offences committed first time
d) Imposable penalty for repetition of offences
7. Chapter I: Deals with the definition of the act,
explanation of some specific terms like
insecticide or pesticide residue, food, Food
Court, food production, food laboratory, Food
Analyst etc.
Chapter II: Deals with the institutional structure
of Food Safety System, council members, their
activities, their qualifications etc.
Chapter III: Formation of Central Food Safety
Management Coordination Committee,
meetings of the Coordination Committee and
technical committee etc.
8. Chapter IV: deals with how the authority
manages their funds, final budget and
account audit etc.
Chapter V: defines prohibitions related to
Food Safety Management System like use
of poisonous elements, radioactive, heavy
metals etc. in excess of acceptable limit.
Chapter VI: recognizes the special
responsibilities of Food Business Operators
9. Chapter VII: defines Food Analysis and Testing
includes appointment of Food analysts and
assigning duties, food testing etc.
Chapter VIII: implies Inspection and Seizure of
Food includes duties of a inspector, implement
of power to seize the adulterated food from
market.
Chapter IX: deals with the punishment for the
violation of any provision of this Act, Violation of
provisions or committing offence by a company
etc.
10. Chapter X: Designation of Food Court, its power
and jurisdiction.
Chapter XI: There shall be no legal bar for any
affected person or food consumer to institute a civil
suit in a competent court claiming civil remedies
against a person who is prosecuted for any activity
against this Act.
Chapter XII: deals with Power of the Authority to
conduct administrative inquiry fine.
Chapter XIII: deals with miscellaneous topics like
Cooperation of the concerned Ministries, Divisions
and organizations, preservation of confidential
information etc.
11. As soon as, after the commencement of this
Act, the Government by notification in the
official Gazette, established an Authority to
be called the Bangladesh Food Safety
Authority to carry out the purposes of this
Act.
The Authority is a body corporate having
perpetual succession and a common seal
with power, subjects to the provisions of this
Act.
12. Offences Penalties for repetition of offences
To use or include any chemical or its ingredients
or substance, insecticides or pesticides or food
colour or flavouring matter, in any article of food
which my cause injury of toxicity to human
health
Imprisonment for five years or a fine of Taka
twenty lac, or with both.
To use or include any radioactive or irradiated
matter or naturally or otherwise occurring similar
matter or heavy metal
Imprisonment for four years or a fine of Taka
sixteen lac, or with both.
With an intention to sell, to produce, or import,
process, store, supply or sell any adulterated
article of food or food ingredient.
Imprisonment for three years or a fine of Taka
twelve lac, or with both.
To produce or import, process, store, distribute
or sell any article of food or food ingredient which
is of sub-standard for human consumption
Imprisonment for three years or a fine of Taka
twelve lac, or with both.
