Maĥer pertains to two states jurisdicĕons viz. Delhi and Bihar for the
same cause of acĕon. Delhi High Court has pronounced Judgment on
the ground of the Cerĕfied copy of Bihar Court. It also pertains to life
or liberty of a ciĕzen and freedom of movement across the Indian
Territory of a ciĕzen. First Appellate Authority has declined to
acknowledge the First Appeal u/s 19(1) of RTI Act 2005. Hence, request
was made through online RTI
from central Authority CPIO Department of Legal Affairs, Government
of India to forward the same to the Public Authority under secĕon 6(3)
(i)(ii) of RTI Act, 2005 to which the subject maĥer is more closely
connected. However, online RTI request is declined by the central
Authority, Government of India and returned it back to the applicant to
file before concerned State PIO .
Upon refusal of CPIO Department of Legal Affairs Govt of India to
transfer RTI applicaĕon u/s 6(3)(i)(ii) of RTI Act 2005, the applicant has
filed CIC complaint u/s 18 of RTI Act 2005 against Department of Legal
Affairs Government of India vide RC/UG/16/1350631kk dated
16.08.2016.
It is perĕnent to note here that CIC decision Order dated 25.09.2014 in
Om Prakash Poddar Vs Department of Legal Affairs has not been
replied back and complied by the Department of Legal Affairs as on
date for the same cause of acĕon.
