set in place. Recovery plans have been put into place to help our animals and
plants replenish. While doing this, exemptions can and do occur. If there is a
project to be done within a habitat of a listed species, then the ESA must notify the
FWS and National Marine Fisheries Service. Once listed species reached a level of
stable existence again, they were delisted. As of 2011, fifty one species had been
delisted. Any kind of harming, wounding, or killing is considered to be a violation.
Violations of these laws have a variety of penalties. The maximum fine is up to
$50,000 or a year of imprisonment, possibly both. I do absolutely believe this law
has improved our societies and environments due to helping original life to be
sustained. These animals and plants were created to be on this earth. They did not
choose to be here and did not choose to be killed for human pleasure. This law has
given these listed species another chance.

Throughout the beginning of the 1900 s, Roosevelt became immensely favored and
adored by the majority of United States citizens. After Theodore Roosevelt served his
terms of presidency from 1901 1909, he declared that he would not accept a
renomination for another term. With being in control of the Republican Partyand also
becoming quite favored, Roosevelt was able to name who his successor would be.
With having being so popular and trustworthy, Roosevelt commanded the Republican
Party to stay loyal to his ways by nominating and supporting Roosevelt s secretary of
war, William Howard Taft. When Roosevelt left office, he stated,
I have the profound satisfaction of knowing that he [Taft] will do all in his power
to further every one of the great causes for which I have fought and that he will
persevere in every one of the great governmental policies in which I most firmly
believe (6).
However, when election time came around, many Americans were not impressed by
the actions that Taft had taken and the way he carried himself. Many Americans
were against Taft and believed that he was not competent enough to take on the job.
When Taft ran for his second term in 1912, his opposers, betrayal of the Republican
Party and his seemingly lack of political knowledge and training cost him the election.
Mid way through his first term, Taft had changed his motives and wanted to remove

Trop was born in the United States. Trop abandoned post without permission,
specifically a stockade in Morocco, and planned to not return.
The following day he surrendered to an Army officer and was found guilty. As
punishment he was sentenced to three years of punitive prison labor, forfeiture of
pay, and a dishonorable discharge.
Trop applied for a passport in 1952. The application was denied due to the
Nationality Act of 1940 which states that members of the armed forces who deserted
during time of war would lose their citizenship. Trop filed in the federals courts to

Opinion/Reasoning
Since the case involves the questioning of United States citizenship, the Supreme
Court has jurisdiction. Even though the desertion happened in French Morocco, Trop
did not break any laws there or effect Morocco.
Just like the the Perez v. Brownell case, the power to remove citizenship is not in
the hands of the National Government. The only way Trop s citizenship could get
revoked would be if he relinquished it or through conduct to which the revocation
would be appropriate. The courts agreed he did not give up his citizenship or join the
enemy.
The courts decided that this case violated the 8th amendment because it would leave
Trop stateless. To leave one stateless would cause possible future harm because one
would not belong to any country. This punishment was ruled cruel.

Already in 1958, Modigliani and Miller have pointed the discussion of capital
structure towards the cost of debt and equity. According to their first proposition, in
a world of no corporate taxes and with perfect markets, financial leverage has no
effect on a firm s value. In their second proposition, they state that the cost of equity
equals a linear function defined by the required return on assets and the cost of debt
(Modigliani and Miller, 1958).
As negative aspects of debt, e.g. personal tax loss and bankruptcy costs however do
exist in reality, Miller (1977) elaborates that leverage will either have no or a
negative effect on the firm s value, hence untaxed firms should favor equity.
Nevertheless, firms have used leverage even before corporate taxes have been
introduced (Maris and Elayan, 1990). This implies the existence of some market
imperfections, which benefit the use of debt financing, thus enable a trade off of the
cost and benefits of debt resulting in an optimal capital structure, where marginal cost
