Essay 2
The purpose of this project is to see if you are able to apply the theories we have learned in this
class to gain a perspective on/explains a phenomenon in the world. Or, to put it another way: to
see “general” processes in your “particular” case study.
For this project, the case study you will analyze will have something to do with sports. It can be
about the career of a person, it can be about a particular sport (or a comparison of sports), it
could be about the business of sports, it could be about a level of sports (recreational, high
school, collegiate, professional), it could be about who gets to participate in sports. It could be
something happening on the FIU campus or here in Miami or anywhere. Basically anything
sports-related that you can reasonably cover in 8-10 pages. I will take an extremely broad
definition of sports: including competitive video games, marching band, professional wrestling,
dance, fitness, etc…
The proposal and presentation (detailed below) are steps you take on the way to producing a
final paper. This paper will consist of three parts (plus a bibliography), each about roughly 1/3
of the total length of your paper:
1. The presentation of the case: In this section, you will introduce your topic. You will
include what it is about, who is/was involved, where it took place and when. You
should also include what other people have thought/said about it. In this section, you
must have at least 8 “data sources” – although a few more than that is probably
preferable (but no need to go overboard). The easiest is to use Google News or some
other news search engine (for example, the library website will let you search old issues
of Sports Illustrated, New York Times, Miami Herald, etc.). It would be great if you used
something like Web of Science (accessible via FIU Library Website) to find some
sources in peer-reviewed academic journals -- but some topics may not have anything
on them written in journals, so this is not a hard and fast requirement. You are also
welcome to conduct interviews, observe/take field notes to get information, particularly if
your topic is located in South Florida or impacts South Florida. Citations must be
included and properly formatted in a style of your choosing. The goal of this section is
to demonstrate that you have a good grasp of the nuances of the topic, and have
examined multiple perspectives on it.
2. The summarization of two theorists from the course: In this section, you will
introduce two theorists/writers from the course whose theory you think will be applicable
to an analysis of the topic. They MUST be from this course, not other courses you have
taken. Authors covered on Thursdays will be easier to work with, because the “general”
point of their readings is clearer. You will begin by summarizing the reading from the
first author, highlighting its particular topic (e.g. prisons, Lesotht ...

You should select three of the following questions and respond to them honestly and reflectively.
1. Could you ever relate to the above meme of the dog writing? If so, explain why? Reflect on when you felt like you had “no idea what you’re doing” as a writer. Provide a couple of examples of things that you now know about writing and some that you still do not know.
2. Consider the role of critical thinking and the use of evidence (logos) in your writing. Discuss at least one example of using evidence in your final research paper that strengthened the essay and explain why.
3. What does the message of “just keep writing” mean to you? Does it mean do not give up? Does it mean write through your writing struggles and you will get to the end? Does it mean that if you write frequently your writing will improve? What else might it mean to you? Explain.
4. Writing is hard. What were some strategies that you have found that make writing easier for you? Consider the way the Research Proposal, the Annotated Bibliography, drafting the research paper, peer reviewing it, breaking it down into parts or outlining it worked to make the process of writing the Research Paper less difficult. Discuss whether any of these parts of the process helped ease the writing of an eight-page paper and if they did, which ones, and how did they help?
5. What are some ways that work best for you when starting to write an essay? Be specific. Do you start with the thesis, the introduction, a supporting point, an outline, a free write, a “garbage draft,” or something else? Explain why you think this is the best way for you to “just start.”
6. Do you agree that an essay can be finished within one night? Do you believe that a quality essay can be begun and completed in one night? Explain why or why not. What are some aspects of the writing process that we’ve practiced that might make it difficult to start and complete a strong essay in one night? For example, think about using credible sources to establish ethos and to employ logos in the essay, peer reviewing, etc.
COURSE OVERVIEW
The forces of globalization have increased the permeability of traditional boundaries around countries, economies and industries. These forces include the expansion of international trade and investment, the growth of multinational corporations (MNCs), the ability of information and communication technology to span time and distance, and the shift of the world’s economic center of gravity from the West to Asia. Because of globalization, the environment of business is now more complex, more dynamic, more uncertain, and more competitive than ever before.
This course examines the opportunities and challenges that firms face when conducting business across national borders. Its main objective is to develop an understanding about the complex dynamics at play that shape the changing global business environment within which nations and firms compete. Special attention will be given to explo ...

PHI 2604 CREATING YOUR OUTLINE
A good practice before you write your paper is to create an outline. This should include 1) your thesis statement (main argument), 2) an outline and 3) a works cited page.
Follow the MLA style unless otherwise clarified with the professor.
The outline should be more detailed than just noting a) Introduction, b) argument, c) conclusion. This is too superficial to be helpful for you. Instead consider the main concepts that you will explain, or the main argument you will make and how each of the elements of the paper fit together.
In developing your outline, it may be helpful to keep the following in mind regarding philosophy papers:
"A philosophy paper presents a reasoned defense of some thesis. So a philosophy paper typically does at least one of the following:
• Defends a thesis by offering plausible reasons to support it
• Defends a thesis by showing that arguments against it are unconvincing
• Criticizes a thesis by showing that the arguments for it are unconvincing
• Contrasts two or more views on a given issue and argue for one view over the other."

Negative Consequences: Single Use Plastic and Its Detriment to the Greater Good
Environmental pollution is detrimental to non-human well-being and one of the major contributors is the creation of single use plastic, much of which ends up in the oceans. We have all seen the disturbing images of turtles with plastic bags around their necks or whales, sharks and dolphins whose post-mortems reveal stomachs full of plastic debris (Hastings, 209). However, single use plastic is also detrimental to human well-being because, I argue, human health and happiness is only possible within a thriving and healthy environment. In other words, single use plastic is a moral concern. In this paper, I review single use plastic according to the utilitarian principle that we ought “to act according to the greater good for the greater number,” (Bentham, 205) and that we ought to do our utmost to reduce suffering in both human and non-human species. I also consider Bentham’s claim that “one only counts as one” and argue that from a utilitarian perspective, we should dissuade the production of single use plastic.
Outline
I. Thesis (see above)
II. Explanation of plastic pollution and its impact on the oceans and sea life. Include details of human suffering as a “Cascade Effect” of plastic pollution. Include statistics from a valid source and relevant quotes.
III. An explanation of Utilitarianism and how it can be used to argue for the banning of single use plastic. You can explain the framework and how it was developed to guard against ethical egoism and the self-interest of the wealt.

RESEARCH PAPER OUTLINE (Graded)
Complete and submit to Week 5 Assignment dropbox.
This Assignment will assist you in preparing your Week 7 Assignment Research Paper.
Instructions: Go to the Week 7 Assignment for the Research Paper and read the Instructions for the paper thoroughly. Then complete each item below by answering each question in the space provided. Save this as a WORD Document using your name and Assignment. Example: JonesWk5ResearchOutline.docx. Submit this completed outline to the Week 5 Assignment dropbox by Sunday night of Week 5 (11:59 pm ET).
The maximum point value for each item is stated in parentheses. Actual points will be awarded by your instructor with feedback.
****
1. (5 pts) State the name of the company you have selected for your Week 7 Research Paper.
Purdue Pharmaceutical -The paper will major the discussion on the Opioid lawsuits concerning ethic and business laws.
2. (5 pts) The company you have chosen to write about (no. 1 above) made a business decision --chose a course of action – which adversely affected others as well as the company.
The company was faced with an ethical dilemma. As you have learned, an ethical dilemma is a conflict between alternatives where neither alternative is desirable. Choosing either one will compromise something. Each choice will have its downside: it could compromise ethics, cause ethical problems, cause harm, raise difficult questions, or otherwise lead to an undesirable situation. Ideally, the decision maker would do both acts or neither, but he cannot. He has to choose and can only choose one. The dilemma is being confronted with these undesirable choices and having to choose one. In a single, well-crafted sentence, state the ethical dilemma that was presented in your chosen company’s situation.
Purdue Pharmaceutical is in a dilemma to decide the continuation of its Purdue production—stopping production would stop the alleged deaths and addiction but still paint a picture of being the real cause of the issues, a perspective that the company denied alleging the problem to customer drug misuse
3. (5 pts) Name and briefly define the ethical framework you will discuss in your Research Paper as an alternative to Milton Friedman's free market ethics.
The common good ethical approach—According to this theory, any firm, whether commercialized or not, should base their decision making on their implication to the direct and most vulnerable clients.
4. (15 pts) List the three (3) additional legal topics you will discuss in your Research Paper with respect to your selected company. Remember, none of these should relate to ethics, antitrust or consumer protection issues. Be specific. Simply stating “torts,” for example, does not define a topic. Which type of tort?
1. Tort on labour and employment
2. Tort on bankruptcy
3. Tort on healthcare insurance

MY MAJOR IS COMPUTER SCIENCE Career Documents: Phase One: Job Advertisement AnalysisOverview
For this assignment you will be creating Career Documents for a specific position you can currently apply for or will be qualified to apply for in the near future (such as one to two years out). This assignment will ask you to seek out advertisements for available positions and to write to the qualifications for one, current plausible position.
You will be using the database, Ohio Means Jobs (Links to an external site.), a site that consolidates career-path advice, information, jobs, and job fairs. It is also a site that you can recommend to others, such as a high school relative who may be interested in studying for certifications or applying for internships.
Note: Although this site is Ohio-based, the jobs are not bounded in only Ohio.
The following video is a tutorial on how to navigate the site: Getting Started (Links to an external site.).
Background:
On average, Americans change job positions 14 times within their life span. It may be infeasible to retrain each time you apply for a new job, so what does this mean for you? Knowing how to translate your skills and experiences from one context to the next is one of the most important thing you might learn from this course.
By the end of this project you should have a working template that you can revise to submit to future job positions. More importantly, you will understand the concepts and approaches that you can use for future job/work contexts.
Parameters/Process:
Phase One
Once you have explored and created an account with Ohio Means Jobs. Choose one job advertisement that you believe that you may be competitive in acquiring, given your current credentials or the credentials you will have in one to two years out. That is, you want to be realistic enough about your credentials so that you are able to create effective career documents.
I encourage you to use advertisements for positions you may want to attain immediately, such as internships, graduate school, and grants so that you can use your documents for acquiring a "real" experience. If you are at sophomore status or below, I highly suggest internships since you may not have enough experience to include in your career documents.

THE FIELD PROJECT - Business 302
Purpose
The purpose of having you prepare an environment report for an industry is to give you
experience in applying the concepts of this course to an actual business situation. When the
environment remains stable, the importance of an environment analysis is minimal. However,
when faced with a dynamic environment the analysis of the environment and the
corresponding report are extremely important. An analysis of the environment is the basis for
developing a strategic plan and a marketing plan, which are required components for business
loans. A firm that does not constantly monitor its future environment for salient changes is
more likely to find itself out of step and ultimately, out of business.
The environment analysis of the Strategic Business Area (SBA) you prepare is to be
written from the perspective of an outside business consultant as an objective report on the
aspects of a firm’s environment. The report should provide insights that would enable a
management team or others in a firm to evaluate any proposed strategy. The report is not to
include any strategy, evaluation or strategy, or response.
Topics and Nature of Report
The basis of your report is concentrating in the Task Environment elements of the Griffin Model
and the Five Forces of the Porter Model. As you discover more about the environment, new
issues may be discovered about salient aspects of the environment that may lead to different
emphases. The first step is to identify five major trends, threats, and opportunities that will
exist in the SBA. The second step is to conduct an overview of the different aspects of the
environment (General: Economic, Social-Cultural, Political-Legal, Technological, and
International; Task: Competition, Customers, Regulators, Unions/Labor, Suppliers, Strategic
Allies, and Owners; Porter’s Industry Competitive Model). Jot down things about each
factor/dimension that you initially think may be important to the organization. Then conduct a
more in-depth research in each of the areas.
Throughout the course, material has been presented on each facet of the environment.
The Case Guide Analyses and class lectures give information on the General Environment as
well as information on task factors. Most of these overheads identify different types of
information that one could/should examine and/or include on each of these factors.
For each task factor it is important to identify 1) Who they are, and 2) What are their
characteristics, orientation, behaviors, etc. which make (or potentially make) them important to
a firm doing business in the SBA. Importance is determined by the potential to serve as a
stimulus (positive or negative/opportunity, threat or trend) for some type of firm response.
Conclude by outlining your general recommendation(s) about the industry sector.

Business Performance Risks Caused by Outsourcing of Information Technology.
The information technology (IT) growth has resulted in the rise of transaction demand by consumers and businesses. The majority of the organization's technical teams are ever-present to solve any emerging needs. Following rampant business needs growth, organizations are on a mission to keep the source and demand of particular information technology functions intact. The world's globalization has changed the production mode of enterprises from insourcing to outsourcing. The management of cost and time management efficiency are the determiners of the organization's business performance.

well as information on task factors.

Furthermore, several factors ...

The document provides feedback on a student's draft assignment on choosing a research topic. The feedback comments on the problem statement, purpose statement, theoretical framework, and annotated bibliography. It recommends revising the problem statement to better indicate what is already known from prior research. It also suggests describing how the theoretical framework of transaction cost analysis and integrated systems theory will be applied to the specific research problem. The student is asked to incorporate the feedback into a revised assignment for the following week.
The document provides instructions for three projects related to tourism and event planning. Project One involves creating a training manual for new airline employees. Project Two requires developing a business plan for a travel agency. Project Three consists of putting together an event proposal and planning a year-end function. Each project contains multiple practical assignments assessing skills in areas like tourism legislation, wholesale/retail travel, and events management. Students are instructed to research topics, demonstrate understanding, and respect legal guidelines.

PAD 502 Organizational Dynamics Final Project – Learning As.docxgerardkortney
This document discusses organizational goals and effectiveness. It begins by noting that organizational goals and effectiveness are important concepts in management theory and influence organizational performance. It then discusses some key issues regarding organizational goals, such as the fact that goals are often multiple and conflicting. The document also notes that public organizations' strategic plans emphasize goals and performance measures. However, assessing goals and effectiveness is complicated. The document reviews different models of organizational effectiveness developed by researchers. It concludes by discussing general complications with defining and assessing organizational goals and the implications this has for organizing and managing organizations.
This document discusses improving communication patterns between nursing home staff and residents. Currently, some staff use "elderspeak" which is disempowering communication. The proposed study would engage staff in collaboration to understand positive communication and provide alternatives to verbal interactions. The goal is to help staff improve their ability to meet resident needs through empowering communication, thereby improving quality of life. This approach aims to enhance current practice by increasing staff awareness of positive communication techniques.

Framework for Case Analysis (Adapted from the original document published by the UMass College of Management)
Part I – Analyzing a Case
What is this document?
You will be asked throughout your Graduate experience to analyze cases. Because there are many ways to approach cases, the CM faculty has agreed upon a framework for case analysis that you will be asked to learn in MGT 650. This framework will help you throughout your Graduate experience in thinking about cases as well as in preparing written reports.
UC Note: The SL and DEL curricula are not “case-based.” This document is intended to illustrate and explain my two-step case study assignment. My notes appear in bold blue font throughout.
What is a case?
A case is a story---usually a true story, but not always---that illustrates business and management theories and concepts you are studying in a course and/or presents a problem or series of problems for you to solve. A case usually ends with a dilemma or critical issue faced by a particular character or organization depicted in the case. Sometimes a case will be accompanied by a set of questions, usually theory-based, that your instructor expects you to answer. Some questions will be devoted to figuring out the problems imbedded in the case and the causes of those problems; others will ask you to determine a course of action to take in the future. These questions will be provided between steps one and two. More complex cases usually contain a variety of types of information, e.g. industry and economic data, financial reports, policies and procedures, market share and pricing data, descriptions of personnel and other resources, job descriptions, individual perceptions, and dialogue. Due to their complex nature, these cases demand your careful, sustained attention; indeed, each case contains subtleties that are likely to be discerned only by several re-readings and discussions with other students.
Why do professors ask students in the Graduate Programs to analyze cases?
Through the process of analyzing cases, professors believe that Graduate students can learn the value of: [1] responding actively and constructively to the conflicts of organizational life by: suspending judgment about personalities as well as about courses of action; differentiating between facts and opinions; graciously giving up an opinion if it is shown to be inadequate; integrating what one learns through discussions ...

You will choose a topic from the Complete Marriage and Family Home Reference Guide to study more closely. In 4–6 pages, you will compare current knowledge with facts from research and then examine the chosen topic from both a psychological and a theological perspective.
1. Briefly provide your initial thoughts on the topic. This section will not require source material. The purpose is simply for you to identify what you know about this topic. You may discuss facts, a biblical perspective, the moral dilemma involved in the topic, or just your thoughts around the topic. This section must be 1 page.
2. Look at the research that has been done on the topic. This section must be well-organized with headings and subheadings and must include at least 4 empirical sources. This section must be 2–3 pages. You may consider, but are not confined to, the following prompts and questions:
· Check some of what you know against what research has to say. How could this topic affect a marriage or family?
· What are benefits and consequences of approaching this topic and working through it within the affected family unit?
3. Compare the psychological and theological perspectives of the topic. The point here is to compare what the research says about the topic to what the Bible says about the topic. Not all of the topics from "The Quick-Reference Guide to Marriage and Family Counseling" are directly mentioned in the Bible. However, you may use biblical principles and discuss similarities and discrepancies found between these 2 perspectives. This section must be 1–2 pages.
4. The conclusion of this paper must include a good summary of the information provided in the preceding 3 sections. You must also provide an idea for future study of the topic. What further information could be provided in relation to this topic? For example, what are some variables that play a part of depression in marriage? Is depression within marriage easier to work through if the depression is a result of a mood disorder or of circumstances outside of the marriage?
5. Correct current APA formatting must be implemented throughout this paper, including avoiding first person and using properly formatted citations and headings. A title page and references page must be included; however, an abstract will NOT be necessary for this assignment. Assignment instructions and the grading rubric must be carefully reviewed to ensure that all assignment criteria are met.

Experimental and Quasi-Experimental Designs
Chapter 5
*
Introduction
Experiments are best suited for explanation and evaluation research
Experiments involve:
Taking action
Observing the consequences of that action
Especially suited for hypothesis testing
Often occur in the field
The Classical Experiment Classical experiment: a specific way of structuring researchInvolves three major components:
Independent variable and dependent variable
Pretesting and posttesting
Experimental group and control group
Independent and Dependent Variables
The independent variable takes the form of a dichotomous stimulus that is either present or absent
It varies (i.e., is independent) in our experimental process
The dependent variable is the outcome, the effect we expect to see
Might be physical conditions, social behavior, attitudes, feelings, or beliefs
Pretesting and Posttesting
Subjects are initially measured in terms of the DV prior to association with the IV (pretested)
Then, they are exposed to the IV
Then, they are remeasured in terms of the DV (posttested)
Differences noted between the measurements on the DV are attributed to influence of IV
Experimental and Control Groups
Experimental group: exposed to whatever treatment, policy, initiative we are testing
Control group: very similar to experimental group, except that they are NOT exposed
Can involve more than one experimental or control group
If we see a difference, we want to make sure it is due to the IV, and not to a difference between the two groups
Placebo
We often don’t want people to know if they are receiving treatment or not
We expose our control group to a “dummy” independent variable just so we are treating everyone the same
Medical research: participants don’t know what they are taking
Ensures that changes in DV actually result from IV and are not psychologically based
Double-Blind Experiment
Experimenters may be more likely to “observe” improvements among those who received drug
In a double-blind experiment, neither the subjects nor the experimenters know which is the experimental group and which is the control group
Selecting Subjects
First, must decide on target population – the group to which the results of your experiment will apply
Second, must decide how to select particular members from that group for your experiment
Cardinal rule – ensure that experimental and control groups are as similar as possible
RandomizationRandomization: produces an experimental and control group that are statistically equivalentEssential feature of experimentsEliminates systematic bias
Experiments and Causal Inference
Experimental design ensures:
Cause precedes effect via taking posttest
Empirical correlation exists via comparing pretest to posttest
No spurious 3rd variable influencing correlation via posttest comparison between experimental and control groups, and via randomization

Effective, purposeful communication is essential in the military profession. Following these instructions will help you properly complete your writing assignment and will improve your chances for success.
This template exemplifies the format for essays. Each essay must include a properly formatted cover page (see above), double-spaced text, Times New Roman 12pt font, 1-inch margins, as well as full endnote-style citations for paraphrasing and quotations in accordance with the Author Guide, Section 5.5. Endnotes are not counted as part of your total word count. The, Appendix A provides examples of endnote formats. Do not include a bibliography in these short essay assignments; however, ensure your full endnotes contain all source information.
Use quotation marks when you quote directly from the work of other writers. This is a relatively short assignment, so use block quotations sparingly to allow your own original thoughts to shine through.
You may notice minor variations between your consolidated lesson readers, which require different endnote formats. Some bundle the readings into a single document with continuous pagination (see example endnote 1 at the end of this document).
Other lesson readers retain each author’s original pagination (see example note 2).
You should use the author’s original pagination wherever it is possible to do so. Remember, cite any material used from the instructional narrative portion of the consolidated lesson reading file with “as the author (see example endnote 3).
The midterm and final essay exams are academic papers; write each in a narrative style, not a bullet/point paper. Refer to the assignment rubric located in your Grade Center for grading criteria. If you have any questions, contact your course instructor.
Much like your next level of leadership, the program requires effective writing founded on critical thinking and communication skills. Each essay you write as you progress toward graduation provides an opportunity for you to hone these abilities. Additionally, these assignments comprise a large portion of your final grade in each course. Therefore, successful course completion is contingent on your writing performance. The most ...

Expansion and Isolationism in Eurasia
How did approaches to cultural interaction shape empires in Eurasia?
Introduction
In 1279, under the leadership of Kublai Khan, the Mongols ousted the Song dynasty
and completed their conquest of China. As they
took control, they established the Yuan dynasty,
with Kublai Khan serving as emperor. However,
Mongol rule over China was relatively short lived.
Within 100 years, the Yuan dynasty would be
forced out by Chinese rebels.
Under Mongol rule, the Chinese became
increasingly angered by policies that favored
Mongols and foreigners. This anger and resentment
eventually resulted in unrest. Around 1350, small
states in China began to emerge to fight the
Mongols. Chinese leaders turned to military force to
advance their interests and establish regional
power. Some leaders were members of the upper class, and others were religious
leaders or bandits supported by peasants. By the middle of the 1350s, these Chinese
powers were united in their campaign to get rid of Mongol rule.
The years of ongoing warfare spurred military innovation among the Chinese.
Although the Mongols had access to gunpowder weapons, they did not develop new
technologies. In contrast, the first large cannons in China were manufactured by the
Chinese rebels. While the term “Gunpowder Empire” is often associated with the
Ottoman Empire, the Safavid Empire, and the Mughal Empire, the Chinese
advancements in gunpowder weaponry has led some historians to regard Ming China
as the world’s first gunpowder empire.

Expansion and Isolationism in Eurasia
How did approaches to cultural interaction shape empires in Eurasia?
In this lesson, you will learn about three countries in Eurasia that used gunpowder
to expand and maintain their control: China, Japan, and Russia. You will consider the
rise and fall of the Ming and Qing dynasties in China. You will examine the unification of
Japan under the Tokugawa. Finally, you will explore the growth of the Russian Empire
during the Romanov dynasty.
Section 1. China Under the Ming and Qing
Between the 14th and the early 20th centuries,
two dynasties governed China: the Ming and the Qing.
Both dynasties took power during times of upheaval.
To restore order, they established strong, centralized
rule and revived traditional Chinese values, including
Confucian ideals.
The Ming Revival By the mid-1300s, China was in
turmoil. The Mongols’ hold on power had became
unstable. Disease and natural disasters had weakened
the Mongol grip. Additionally, feuds broke out within the government, leaving the
countryside unprotected against bandits and rebels.
As life became more dangerous and difficult, Chinese peasants grew increasingly
frustrated with the incompetence of their rulers. Led by Zhu Yuanzhang, a peasant
uprising successfully invaded the city of Nanjing. In 1368, aided by gunpowder
weapons, Zhu and his army capt ...

EXPEDIA VS. PRICELINE -- WHOSE

Optimedia's Antony Young Analyzes the Media Strategies
Behind Rival Travel Sites
By Antony Young
Published: June 30, 2010
As schools break for summer, some families -- like mine -- are still planning their vacations. So I
took a look at two prominent travel sites, Expedia and Priceline, to see which one's media strategy
is likely to attract more trip planners.
Their media plans are especially important as the travel industry picks up after a tough 2009.
Demand for flights and hotels are rebounding and so, too, are airfares and room rates. With
slimmer margins on airline tickets, hotels have very much become the major battleground for
Expedia and Priceline and this is reflected in the focus of their advertising. Online Travel Agencies
(OTA's) accounted for 34.7% of all U.S. hotel bookings in the first quarter of 2010, up from 27.8% in
2009, Priceline CMO Brett Keller said in a recent speech.
Creative executions
Expedia launched a new branding campaign for 2010. Its tagline, "Where you book matters,"
accompanied a new logo incorporated into its creative messaging. The campaign, which targets
frequent leisure travelers, launched Dec. 26 with commercials featuring a visual metaphor of
building blocks as a way to demonstrate how consumers interact with Expedia. The first spot starts
with upbeat soft-rock music narrated by an unseen woman dictating her specifications for the
perfect "girls' weekend." She talks about having multiple hotel options and the ability to compare
dates for the best savings. Expedia's signature "dot coooom" jingle ends the spot. A spot with a
man's voice and trip goals was launched in February.
http://adage.com/
Priceline has built its position in the market on the opportunity for customers to name their own
price, brought to life through some hilarious spots fronted by pitchman William Shatner. This year,
Shatner introduced his new sidekick "Big Deal," a 520 lb 6'5" character who helps persuade hotels
to take a deal. In February, the Big Deal ads were joined by new creative that featured the
Negotiator's "Evil Twin" (played, of course, by Shatner). Priceline takes a karate chop at
Expedia.com (and Hotels.com), claiming that Priceline can get prices 50% lower.
The strategies of the two companies differed noticeably. Expedia.com attracted 16.7 million unique
visitors in May, 59% more than the 10.5 million who visited Priceline.com, according to ComScore.
And Expedia media seems to reflect this, promoting the site as the generic travel brand for a broad
audience and highlighting its full range of services and travel destinations. Priceline is more single-
mindedly focused on price, and its media appears to target lower down the purchase funnel with an
emphasis on converting transactions.

SUMMARY
1. Wilf & Labandeira (1999) suggested that increased temperatures because of global
warming will cause an increase in herbivory by insects. This conclusion was based on the
supposed effect of temperature on herbivores but did not consider an effect of temperature
on plant growth.
2. We studied the effect of temperature on grazing pressure by the small China-mark moth
(Cataclysta lemnata L.) on Lemna minor L. in laboratory experiments.
3. Between temperatures of 15 and 24 C we found a sigmoidal increase in C. lemnata
grazing rates, and an approximately linear increase in L. minor growth rates. Therefore, an
increase in temperature did not always result in higher grazing pressure by this insect as
the regrowth of Lemna changes also.
4. At temperatures below 18.7 C, Lemna benefited more than Cataclysta from an increase in
temperature, causing a decrease in grazing pressure.
5. In the context of global warming, we conclude that rising temperatures will not
necessarily increase grazing pressure by herbivorous insects.
Keywords: Cataclysta, grazing, herbivory, Lemna, temperature
Introduction
Duckweeds (Lemnaceae) are often abundant in dit-
ches and ponds (Landolt, 1986). Especially when
nitrogen and phosphorus concentrations in the water
column are high, the surface area can become covered
with dense floating mats of duckweed (Lüönd, 1980,
1983; Portielje & Roijackers, 1995). These mats have
large impacts on freshwater ecosystems, restricting
oxygen supply (Pokorny & Rejmánková, 1983), light
availability of algae and submerged macrophytes
(Wolek, 1974) and temperature fluxes (Dale &
Gillespie, 1976; Landolt, 1986; Goldsborough, 1993).
These changed conditions often have a negative effect
on the biodiversity of the ecosystem (Janse & van
Puijenbroek, 1998). Other free-floating plants such as
red water fern (Azolla filiculoides), water hyacinth
(Eichhornia crassipes) and water lettuce (Pistia stratiotes)
often cause serious problems in tropical and sub-
tropical regions (Mehra et al., 1999; Hill, 2003).
Various species of herbivorous insects consume
free-floating macrophytes. Several species of weevils
(Coleoptera: Curculionidae) are able to consume large
amounts of red water fern, water hyacinth and water
lettuce (Cilliers, 1991; Hill & Cilliers, 1999; Aguilar
et al., 2003), while the larvae of the semi-aquatic Small
China-mark moth (Cataclysta lemnata) are capable of
removing large parts of floating cover of Lemnaceae
covers (Wesenberg-Lund, 1943). Duckweed is not
only used as food source, but also as building material

This document summarizes a journal article that examines the concept of self-forgiveness. It begins by noting that while research on interpersonal forgiveness has increased greatly, self-forgiveness has received little attention. The document then provides definitions of self-forgiveness from philosophy and psychology literature. It distinguishes self-forgiveness from interpersonal forgiveness and pseudo self-forgiveness. A theoretical model of the processes involved in self-forgiveness after wrongdoing is outlined. The document discusses emotional, cognitive, and offense-related determinants of self-forgiveness and calls for more research on this important topic.

Experimental and Quasi-Experimental DesignsChapter 5.docxelbanglis

MEDIA PLAN TO BOOK?

Experiments with duckweed–moth systems suggest that
global warming may reduce rather than promote
herbivory
TJISSE VAN DER HEIDE, RUDI M. M. ROIJACKERS, EDWIN T. H. M. PEETERS AND
EGBERT H. VAN NES
Department of Environmental Sciences, Aquatic Ecology and Water Quality Management group, Wageningen University,
Wageningen, The Netherlands
SUMMARY
1. Wilf & Labandeira (1999) suggested that increased temperatures because of global
warming will cause an increase in herbivory by insects. This conclusion was based on the
supposed effect of temperature on herbivores but did not consider an effect of temperature
on plant growth.
2. We studied the effect of temperature on grazing pressure by the small China-mark moth
(Cataclysta lemnata L.) on Lemna minor L. in laboratory experiments.
3. Between temperatures of 15 and 24 C we found a sigmoidal increase in C. lemnata
grazing rates, and an approximately linear increase in L. minor growth rates. Therefore, an
increase in temperature did not always result in higher grazing pressure by this insect as
the regrowth of Lemna changes also.
4. At temperatures below 18.7 C, Lemna benefited more than Cataclysta from an increase in
temperature, causing a decrease in grazing pressure.
5. In the context of global warming, we conclude that rising temperatures will not
necessarily increase grazing pressure by herbivorous insects.
Keywords: Cataclysta, grazing, herbivory, Lemna, temperature
Introduction
Duckweeds (Lemnaceae) are often abundant in dit-
ches and ponds (Landolt, 1986). Especially when
nitrogen and phosphorus concentrations in the water
column are high, the surface area can become covered
with dense floating mats of duckweed (Lüönd, 1980,
1983; Portielje & Roijackers, 1995). These mats have
large impacts on freshwater ecosystems, restricting
oxygen supply (Pokorny & Rejmánková, 1983), light
availability of algae and submerged macrophytes
(Wolek, 1974) and temperature fluxes (Dale &
Gillespie, 1976; Landolt, 1986; Goldsborough, 1993).
These changed conditions often have a negative effect
on the biodiversity of the ecosystem (Janse & van
Puijenbroek, 1998). Other free-floating plants such as
red water fern (Azolla filiculoides), water hyacinth
(Eichhornia crassipes) and water lettuce (Pistia stratiotes)
often cause serious problems in tropical and sub-
tropical regions (Mehra et al., 1999; Hill, 2003).
Various species of herbivorous insects consume
free-floating macrophytes. Several species of weevils
(Coleoptera: Curculionidae) are able to consume large
amounts of red water fern, water hyacinth and water
lettuce (Cilliers, 1991; Hill & Cilliers, 1999; Aguilar
et al., 2003), while the larvae of the semi-aquatic Small
China-mark moth (Cataclysta lemnata) are capable of
removing large parts of floating cover of Lemnaceae
covers (Wesenberg-Lund, 1943). Duckweed is not
only used as food source, but also as building material

EXPERIMENT 1 OBSERVATION OF MITOSIS IN A PLANT CELLData Table.docxelbanglis

CASE STUDY 9
ST. LUKE'S HEALTH CARE SYSTEM
Hospitals have been some of the earliest adopters of wireless local area
networks (WLANs). The clinician user population is typically mobile and
spread out across a number of buildings, with a need to enter and access
data in real time. St. Luke's Episcopal Health System in Houston, Texas
(www.stlukestexas.com) is a good example of a hospital that has made
effective use wireless technologies to streamline clinical work processes.
Their wireless network is distributed throughout several hospital buildings
and is used in many different applications. The majority of the St. Luke’s
staff uses wireless devices to access data in real-time, 24 hours a day.
Examples include the following:
• Diagnosing patients and charting their progress: Doctors and
nurses use wireless laptops and tablet PCs to track and chart patient
care data.
• Prescriptions: Medications are dispensed from a cart that is wheeled
from room to room. Clinician uses a wireless scanner to scan the
patient's ID bracelet. If a prescription order has been changed or
cancelled, the clinician will know immediately because the mobile device
displays current patient data.
http://www.stlukestexas.com/

• Critical care units: These areas use the WLAN because running hard
wires would mean moving ceiling panels. The dust and microbes that
such work stirs up would pose a threat to patients.
• Case management: The case managers in the Utilization Management
Department use the WLAN to document patient reviews, insurance
calls/authorization information, and denial information. The wireless
session enables real time access to information that ensures the correct
level of care for a patient and/or timely discharge.
• Blood management: Blood management is a complex process that
involves monitoring both patients and blood products during all stages of
a treatment process. To ensure that blood products and patients are
matched correctly, St. Luke’s uses a wireless bar code scanning process
that involves scanning both patient and blood product bar codes during
the infusion process. This enables clinicians to confirm patient and blood
product identification before proceeding with t ...
Executive SummaryXYZ Development, LLC has requested ASU Geotechn.docxelbanglis
Executive Summary
XYZ Development, LLC has requested ASU Geotechnical, Inc. to organize a geotechnical evaluation with recommendations regarding foundation for three planned structures. XYZ Development, LLC has planned to construct a three-story medical tower, a one-story office building, and a multi-story parking garage on a 10-acre property that is in West Memphis, AR. In addition, an 18-feet high retaining wall is planned to be constructed on the north side of the parking garage.
ASU Geotechnical, Inc. was provided with soil data included a log of a borehole that extended to a depth of 100 feet. Has recommended a 6’ x 6’ shallow foundation for the one- story building at depth of 5 feet. The expected settlement under the foundation for the parking garage was calculated to be 1.09 inches, and the expected settlement for the medical tower was calculated to be 0.78 inch. Also, ASU Geotechnical, Inc. has recommended a drilled shaft deep foundation design to be used for the three-story medical tower. Furthermore, for the 3-story medical tower the pile should have a diameter of 48 inches and reach a depth of 40 feet below the ground surface with a total of 2 piles required per column. For the multi-story parking garage, a drilled shaft should have a diameter of 48 inches and reach a depth of 70 feet below the ground surface with a total of 2 piles required per column.
The expected total differential settlement for the parking garage was calculated to be 0.31 inches, and the total differential settlement for the tower was calculated to be 0.23 inch. The recommended dimensions for the retaining wall include a 12-foot-wide footing base with 1.5-foot thickness. The entire retaining wall should have a total height of 20 feet, with only 18 feet above the ground surface. The 0.5 foot of soil above the toe was placed to adjust the effects of sliding of the wall. The base of the stem wall should have a thickness of 1.5-foot, and the top of the stem wall should have a thickness of 8 inches. Also, the factor of safety for sliding was calculated to be 1.59, the factor of safety for the bearing capacity was calculated to be 2.78

LAND USE LAND COVER AND NDVI OF MIRZAPUR DISTRICT, UPRAHUL
This Dissertation explores the particular circumstances of Mirzapur, a region located in the
core of India. Mirzapur, with its varied terrains and abundant biodiversity, offers an optimal
environment for investigating the changes in vegetation cover dynamics. Our study utilizes
advanced technologies such as GIS (Geographic Information Systems) and Remote sensing to
analyze the transformations that have taken place over the course of a decade.
The complex relationship between human activities and the environment has been the focus
of extensive research and worry. As the global community grapples with swift urbanization,
population expansion, and economic progress, the effects on natural ecosystems are becoming
more evident. A crucial element of this impact is the alteration of vegetation cover, which plays a
significant role in maintaining the ecological equilibrium of our planet.Land serves as the foundation for all human activities and provides the necessary materials for
these activities. As the most crucial natural resource, its utilization by humans results in different
'Land uses,' which are determined by both human activities and the physical characteristics of the
land.
The utilization of land is impacted by human needs and environmental factors. In countries
like India, rapid population growth and the emphasis on extensive resource exploitation can lead
to significant land degradation, adversely affecting the region's land cover.
Therefore, human intervention has significantly influenced land use patterns over many
centuries, evolving its structure over time and space. In the present era, these changes have
accelerated due to factors such as agriculture and urbanization. Information regarding land use and
cover is essential for various planning and management tasks related to the Earth's surface,
providing crucial environmental data for scientific, resource management, policy purposes, and
diverse human activities.
Accurate understanding of land use and cover is imperative for the development planning
of any area. Consequently, a wide range of professionals, including earth system scientists, land
and water managers, and urban planners, are interested in obtaining data on land use and cover
changes, conversion trends, and other related patterns. The spatial dimensions of land use and
cover support policymakers and scientists in making well-informed decisions, as alterations in
these patterns indicate shifts in economic and social conditions. Monitoring such changes with the
help of Advanced technologies like Remote Sensing and Geographic Information Systems is
crucial for coordinated efforts across different administrative levels. Advanced technologies like
Remote Sensing and Geographic Information Systems

Essay 2 The purpose of this project is to see if you are a.docx
1. Essay 2
The purpose of this project is to see if you are able to apply the
theories we have learned in this
class to gain a perspective on/explains a phenomenon in the
world. Or, to put it another way: to
see “general” processes in your “particular” case study.
For this project, the case study you will analyze will have
something to do with sports. It can be
about the career of a person, it can be about a particular sport
(or a comparison of sports), it
could be about the business of sports, it could be about a level
of sports (recreational, high
school, collegiate, professional), it could be about who gets to
participate in sports. It could be
something happening on the FIU campus or here in Miami or
anywhere. Basically anything
sports-related that you can reasonably cover in 8-10 pages. I
will take an extremely broad
definition of sports: including competitive video games,
marching band, professional wrestling,
dance, fitness, etc…
The proposal and presentation (detailed below) are steps you
take on the way to producing a
final paper. This paper will consist of three parts (plus a
bibliography), each about roughly 1/3
of the total length of your paper:
1. The presentation of the case: In this section, you will
introduce your topic. You will
2. include what it is about, who is/was involved, where it took
place and when. You
should also include what other people have thought/said about
it. In this section, you
must have at least 8 “data sources” – although a few more than
that is probably
preferable (but no need to go overboard). The easiest is to use
Google News or some
other news search engine (for example, the library website will
let you search old issues
of Sports Illustrated, New York Times, Miami Herald, etc.). It
would be great if you used
something like Web of Science (accessible via FIU Library
Website) to find some
sources in peer-reviewed academic journals -- but some topics
may not have anything
on them written in journals, so this is not a hard and fast
requirement. You are also
welcome to conduct interviews, observe/take field notes to get
information, particularly if
your topic is located in South Florida or impacts South Florida.
Citations must be
included and properly formatted in a style of your choosing.
The goal of this section is
to demonstrate that you have a good grasp of the nuances of the
topic, and have
examined multiple perspectives on it.
2. The summarization of two theorists from the course: In
this section, you will
introduce two theorists/writers from the course whose theory
you think will be applicable
to an analysis of the topic. They MUST be from this course,
not other courses you have
taken. Authors covered on Thursdays will be easier to work
with, because the “general”
3. point of their readings is clearer. You will begin by
summarizing the reading from the
first author, highlighting its particular topic (e.g. prisons,
Lesothto) and then outlining its
general point, using the author’s specific terminology (but
explained in your own words).
For example, if you cited Butler, you would explain
performativity; Foucault, panopticism
and discipline; etc…. You would then do the same for a second
author. You will then
compare and contrast the two authors – how are their ideas
similar? How are their ideas
distinct from each other? The key thing I am looking for here
is that you understand
each of the theories and are able to explain them in your own
words in a detailed
manner.
3. Your Analysis: In this last section, you will use the two
theorists you outlined to
conduct an analysis of your particular case. Take the first
author, and explain how their
theory explains multiple aspects of your case study. Then do
the same for other author.
Then contrast these understandings provided by course authors
to other
explanations/proclaimed impacts you have found about your
topic during your research.
Conclude by highlighting at least three major takeaways/main
points you want your
audience/reader to know about you case/remember about your
analysis. In this section,
be detailed in your explanations instead of brief – make the
4. specific connections
between your case and the theories clear. To use the Foucault
example: yes, Foucault
says we learn to discipline ourselves – but he has a lot of details
of how, where and why
that unfolds. Be sure to include those details.
4. Bibliography
---------------------------------------------------------------------------
----------------------------------------------------
My question: How big data influenced sports and marketing
forever.
- Use the Thaler and Sunstein “Money ball” reading
- The Bourdieu reading, “How can one be a sports fan?”
- Can use additional sources if necessary
So basically, the first section you would introduce the topic of
big data in sports, and then its impact on
sports marketing in particular. The second section, first talk
about Thaler and Sunstein; then Bourdieu --
following the above guidelines. The third section is to use
whatever points you made about the authors to
analyze the case of big data and sports marketing, then discuss
how those analyses are similar and
different.
That is a rough, rough outline -- but hopefully enough to get
you started.

About Doing Business
The project provides objective measures of business regulations
and their enforcement across 190 economies and selected cities
at the subnational and
regional level.
7. Doing Business
The project, launched in 2002, looks at domestic small and
medium-size companies and measures the regulations applying
to them through their life
cycle.
Doing Business
captures several important dimensions of the regulatory
environment as it applies to local firms. It provides quantitative
indicators on regulation for
starting a business, dealing with construction permits, getting
electricity, registering property, getting credit, protecting
minority investors, paying taxes, trading across
borders, enforcing contracts and resolving insolvency. also
measures features of employing workers. Although does not
present rankings
of economies on the employing workers indicators or include
the topic in the aggregate ease of doing business score or
ranking on the ease of doing business, it does
present the data for these indicators.
Doing Business
Doing Business Doing Business
By gathering and analyzing comprehensive quantitative data to
compare business regulation environments across economies
and over time, encourages
economies to compete towards more efficient regulation; offers
measurable benchmarks for reform; and serves as a resource for
academics, journalists, private sector
researchers and others interested in the business climate of each
economy.
8. Doing Business
In addition, offers detailed , which exhaustively cover business
regulation and reform in different cities and regions within a
nation.
These studies provide data on the ease of doing business, rank
each location, and recommend reforms to improve performance
in each of the indicator areas. Selected
cities can compare their business regulations with other cities in
the economy or region and with the 190 economies that has
ranked.
Doing Business subnational studies
Doing Business
The first study, published in 2003, covered 5 indicator sets and
133 economies. This year’s study covers 11 indicator sets and
190 economies. Most
indicator sets refer to a case scenario in the largest business city
of each economy, except for 11 economies that have a
population of more than 100 million as of 2013
(Bangladesh, Brazil, China, India, Indonesia, Japan, Mexico,
Nigeria, Pakistan, the Russian Federation and the United States)
where also collected data
for the second largest business city. The data for these 11
economies are a population-weighted average for the 2 largest
business cities. The project has benefited from
feedback from governments, academics, practitioners and
reviewers. The initial goal remains: to provide an objective
basis for understanding and improving the
regulatory environment for business around the world.

14. Starting a Business
This topic measures the number of procedures, time, cost and
paid-in minimum capital requirement for a small- to medium-
sized limited liability company to start up and
formally operate in each economy’s largest business city.
To make the data comparable across 190 economies, uses a
standardized business that is 100% domestically owned, has
start-up capital equivalent to
10 times the income per capita, engages in general industrial or
commercial activities and employs between 10 and 50 people
one month after the commencement of
operations, all of whom are domestic nationals. Starting a
Business considers two types of local limited liability
companies that are identical in all aspects, except that one
company is owned by 5 married women and the other by 5
married men. The ranking of economies on the ease of starting a
business is determined by sorting their
scores for starting a business. These scores are the simple
average of the scores for each of the component indicators.

Case study assumptions
To make the data comparable across economies, several
assumptions about the business and the
procedures are used. It is assumed that any required information
is readily available and that the
entrepreneur will pay no bribes.
The business:
-Is a limited liability company (or its legal equivalent). If there
is more than one type of limited
liability company in the economy, the limited liability form
most common among domestic firms is
chosen. Information on the most common form is obtained from
incorporation lawyers or the
statistical office.
-Operates in the economy’s largest business city. For 11
economies the data are also collected for
the second largest business city.
-Performs general industrial or commercial activities such as
17. the production or sale to the public of
goods or services. The business does not perform foreign trade
activities and does not handle
products subject to a special tax regime, for example, liquor or
tobacco. It is not using heavily
polluting production processes.
-Does not qualify for investment incentives or any special
benefits.
-Is 100% domestically owned.
-Has five business owners, none of whom is a legal entity. One
business owner holds 30% of the
company shares, two owners have 20% of shares each, and two
owners have 15% of shares
each.
-Is managed by one local director.
-Has between 10 and 50 employees one month after the
commencement of operations, all of them
domestic nationals.
-Has start-up capital of 10 times income per capita.
-Has an estimated turnover of at least 100 times income per
capita.
-Leases the commercial plant or offices and is not a proprietor
of real estate.
-Has an annual lease for the office space equivalent to one
income per capita.
-Is in an office space of approximately 929 square meters
(10,000 square feet).
-Has a company deed that is 10 pages long.
The owners:
-Have reached the legal age of majority and are capable of
making decisions as an adult. If there
is no legal age of majority, they are assumed to be 30 years old.
-Are in good health and have no criminal record.
-Are married, the marriage is monogamous and registered with
18. the authorities.
-Where the answer differs according to the legal system
applicable to the woman or man in
question (as may be the case in economies where there is legal
plurality), the answer used will be
the one that applies to the majority of the population.

1 Obtain a certificate of availability for the proposed company
name (certificación negativa
de la denominación social)
: Mercantile RegistryAgency
To register a company, entrepreneurs can choose between
obtaining a certificate of availability of
the company name or selecting a name from a list of approved
names (Bolsa de
denominaciones). Most companies are registered with a
previous certificate.
The certificate of availability of the company name is typically
requested through the website of
the Central Commercial Registry:
https://www.rmc.es/privado/CertificacionesDenominaciones.asp
x. The company can choose
between obtain the certificate in person at the Registry, receive
it by email or received it
electronically (with the electronic signature of the register). The
Registry will issue and deliver the
certificate within the next 48 hours.
This procedure can also be requested through the Help Desk for
Entrepreneurs (Puntos de
Atención al Emprendedor, PAE) or through the notary online
system SIGNO.
Once the Registry issues the certificate, the requested corporate
name will be reserved for a
maximum of 6 months from the certificate's date of issuance.
Each certificate is valid for 3 months
from its date of issuance. Furthermore, once the certificate's
24. validity has expired (3 months), the
certificate can only be renewed once, after which a new
certificate must be requested.
2 days EUR 13.52 (excluding
VAT)
2 Open a company bank account and deposit capital
: BankAgency
In most cases, the entrepreneur deposits the amount of the
contributions directly in the bank. The
contributions can also be directly given to the public notary at
the time of granting the deed of
incorporation. In this scenario, the notary can deposit them in
the company's bank account.
The law No. 14/2013 of Entrepreneurship support established
that is not necessary to justify the
deposit of the share capital if the shareholders express in the
public deed that they will respond
jointly and severally in front of the company and its creditors.
1 day no charge
3 File the Single Electronic Document (Documento Único
Electrónico - DUE) and make an
appointment with a notary
: Help Desk for Entrepreneurs (PAE)Agency
Prior incorporation, the entrepreneur completes a single
registration form (DUE) through the
online system CIRCE that is then sent to the notary's office, the
commercial registry, the tax
agency and the social security agency to obtain the company
contribution number (Codigo de
25. Cuenta de Cotizacion, CCC) and to register the employees.
The single registration form can be filed at any Help Desk for
Entrepreneurs (Puntos de Atención
al Emprendedor - PAE) or online by the entrepreneur, in which
case a digital signature is required.
Once the DUE is sent, an appointment request is generated with
the notary chosen for the
preparation of the public deed of incorporation.

4 Obtain through a notary the registered public deed of
incorporation and the fiscal
identification number (Código de identificación fiscal - CIF)
: Public Notary and Mercantile RegistryAgency
The notary provides the public deed (escritura de constitucion)
once it is obtained the company
name certificate and the rest of the documents. The Notary will
send to the Registry the accredited
copy of the deed through the online platform SIGNO. The
Registry will incorporate the company
and the confirmation of the incorporation will be notified
electronically to the Notary.
The Notary will apply for a provisional fiscal identification
number (NIF) at the tax authority
26. (Agencia Estatal de Administracion Tributaria) through the
online notary platform SIGNO. Once
the tax authority confirmed the permanent NIF, it will be
electronically notified to the Notary and
Registry.
At the moment of incorporation, the entrepreneurs must provide
to the Notary the information on
the company's beneficial owners that will be included in the
company deed by a 'responsible
declaration". The Notary will verify the provided information at
the Beneficial Ownership Database.
The registration and the fiscal identification number can also be
obtained through CIRCE, the
electronic platform of the Ministry of Economy, Commerce and
Tourism. Although, the SIGNO
platform is more used among notaries to incorporate a company.
For a company with a share capital higher than EUR 30,000, the
notary fees are as follows (per
Number 2, Royal Decree 1426/1989, last modified per Official
Gazette 285 of Nov. 17, 2011):

Dealing with Construction Permits
This topic tracks the procedures, time and cost to build a
warehouse—including obtaining necessary the licenses and
permits, submitting all required notifications,
requesting and receiving all necessary inspections and obtaining
utility connections. In addition, the Dealing with Construction
Permits indicator measures the building
quality control index, evaluating the quality of building
regulations, the strength of quality control and safety
mechanisms, liability and insurance regimes, and professional
certification requirements. The most recent round of data

Case study assumptions
To make the data comparable across economies, several
assumptions about the construction
company, the warehouse project and the utility connections are
used.
The construction company (BuildCo):
- Is a limited liability company (or its legal equivalent) and
operates in the economy’s largest
business city. For 11 economies the data are also collected for
the second largest business city.
- Is 100% domestically and privately owned; has five owners,
none of whom is a legal entity. Has a
licensed architect and a licensed engineer, both registered with
the local association of architects
or engineers. BuildCo is not assumed to have any other
employees who are technical or licensed
experts, such as geological or topographical experts.
- Owns the land on which the warehouse will be built and will
sell the warehouse upon its
completion.
The warehouse:
32. - Will be used for general storage activities, such as storage of
books or stationery.
- Will have two stories, both above ground, with a total
constructed area of approximately 1,300.6
square meters (14,000 square feet). Each floor will be 3 meters
(9 feet, 10 inches) high and will be
located on a land plot of approximately 929 square meters
(10,000 square feet) that is 100%
owned by BuildCo, and the warehouse is valued at 50 times
income per capita.
- Will have complete architectural and technical plans prepared
by a licensed architect. If
preparation of the plans requires such steps as obtaining further
documentation or getting prior
approvals from external agencies, these are counted as
procedures.
- Will take 30 weeks to construct (excluding all delays due to
administrative and regulatory
requirements).
The water and sewerage connections:
- Will be 150 meters (492 feet) from the existing water source
and sewer tap. If there is no water
delivery infrastructure in the economy, a borehole will be dug.
If there is no sewerage
infrastructure, a septic tank in the smallest size available will
be installed or built.
- Will have an average water use of 662 liters (175 gallons) a
day and an average wastewater flow
of 568 liters (150 gallons) a day. Will have a peak water use of
1,325 liters (350 gallons) a day and
a peak wastewater flow of 1,136 liters (300 gallons) a day.
- Will have a constant level of water demand and wastewater
flow throughout the year; will be 1
33. inch in diameter for the water connection and 4 inches in
diameter for the sewerage connection.

infringements of the building
regulations or criminal law, a proposal on sanctions must be
made, and a copy of the written
record is given to the public prosecutor. At minimum,
administrative proceedings are initiated.
In each inspection report, a record is included that provides
information on every person involved
and their roles, as well as on the facts, circumstances, dates,
and results of the inspection. The
record is regarded as a public administrative deed. The record
must be signed by the inspector(s)

Case study assumptions
To make the data comparable across economies, several
assumptions about the warehouse, the
electricity connection and the monthly consumption are used.
The warehouse:
- Is owned by a local entrepreneur and is used for storage of
goods.
- Is located in the economy’s largest business city. For 11
economies the data are also collected for
the second largest business city.
- Is located in an area where similar warehouses are typically
located and is in an area with no
physical constraints. For example, the property is not near a
railway.
- Is a new construction and is being connected to electricity for
the first time.
- Has two stories with a total surface area of approximately
55. 1,300.6 square meters (14,000 square
feet). The plot of land on which it is built is 929 square meters
(10,000 square feet).
The electricity connection:
- Is a permanent one with a three-phase, four-wire Y connection
with a subscribed capacity of 140-
kilo-volt-ampere (kVA) with a power factor of 1, when 1 kVA =
1 kilowatt (kW).
- Has a length of 150 meters. The connection is to either the
low- or medium-voltage distribution
network and is either overhead or underground, whichever is
more common in the area where the
warehouse is located and requires works that involve the
crossing of a 10-meter road (such as by
excavation or overhead lines) but are all carried out on public
land. There is no crossing of other
owners’ private property because the warehouse has access to a
road.
- Does not require work to install the internal wiring of the
warehouse. This has already been
completed up to and including the customer’s service panel or
switchboard and the meter base.
The monthly consumption:
- It is assumed that the warehouse operates 30 days a month
from 9:00 a.m. to 5:00 p.m. (8 hours
a day), with equipment utilized at 80% of capacity on average
and that there are no electricity cuts
(assumed for simplicity reasons) and the monthly energy
consumption is 26,880 kilowatt-hours
(kWh); hourly consumption is 112 kWh.
- If multiple electricity suppliers exist, the warehouse is served
by the cheapest supplier.
56. - Tariffs effective in January of the current year are used for
calculation of the price of electricity for
the warehouse. Although January has 31 days, for calculation
purposes only 30 days are used.

Details – Getting Electricity in Spain – Procedure, Time and
Cost
Takes place simultaneously with previous procedure.
No. Procedures Time to Complete Associated Costs
1 Submit application to Iberdrola and await estimate
: IberdrolaAgency
Customers must submit an application for a new connection
with the utility. Iberdrola Distribución
Eléctrica will prepare an estimate and inform the customer with
a letter about the estimated costs
of the project and the technical characteristics of the project.
The payment is made at the bank. A
receipt of this payment has to be submitted to Iberdrola at the
time when the customer signs the
supply contract.
20 calendar days EUR 0
2 Obtain license for external works from City Council
: City CouncilAgency
Customers need to obtain a license for the external works from
the municipality. The tax for this
license is charged as 4% of the cost of the works, plus a fee for
provision of urban services (‘Tasa
por prestación de servicios urbanísticos’), and a fee for private
use of public spaces (‘Tasa por
Utilización Privativa o Aprovechamiento Especial del Dominio
63. Público Local’).
.
25 calendar days EUR 956.6
3 Await completion of connection works by Iberdrola or private
firm
: IberdrolaAgency
Customers have two choices: The external connection works can
be done by Iberdrola or the
customer can hire a private licensed electrical constructor.
In most cases, for a connection with a capacity of 140 kVA,
customers hire a private company to
carry out the works. For such a capacity, the connection is
considered in most cases as low
voltage. This cost includes materials and labor.
30 calendar days EUR 20,500
4 Obtain clearance of electrical installation
: General Directorate for Industry, Energy and Mining
(‘DGIEM’)Agency
The customer obtains a clearance of the electrical installation
(‘acta de puesta en servicio’) from
the General Directorate for Industry, Energy and Mining to
certify that it is in compliance with its
requirements. The documents to be presented are:
- Contract of maintenance of proof of own capacity of
maintenance of transformers
- Certificate of conclusion of works
- Initial certificate of inspection by the OCA
- Declaration of responsibility
64. 15 calendar days EUR 0
5 Sign supply contract with Iberdrola and await meter
installation and electricity flow
: IberdrolaAgency
Irrespective of who executes the actual works of the connection
(installation of the transformer,
excavation for cables etc.), Iberdrola is always in charge of
installing the meter and the final
energization of the project. The meter can be rented or bought
by the customer. Most clients
prefer to rent it at an approximate cost of EUR 12 per month.
According to Article 79 of the Real Decreto 1955/2000, the
utility can levy a security deposit in the
amount of one month of future consumption (corresponding to
50 hours supply of the contracted
load). Additional fees for the access to electricity (cuotas de
acceso) and for the final connection
(derechos de enganche) also apply.

Registering Property
This topic examines the steps, time and cost involved in
registering property, assuming a standardized case of an
entrepreneur who wants to purchase land and a
building that is already registered and free of title dispute. In
addition, the topic also measures the quality of the land
administration system in each economy. The quality
of land administration index has five dimensions: reliability of
infrastructure, transparency of information, geographic
67. coverage, land dispute resolution, and equal access
to property rights. The most recent round of data collection for
the project was completed in May 2019. .See the methodology

Case study assumptions
To make the data comparable across economies, several
assumptions about the parties to the
transaction, the property and the procedures are used.
The parties (buyer and seller):
- Are limited liability companies (or the legal equivalent).
- Are located in the periurban (that is, on the outskirts of the
city but still within its official limits)
area of the economy’s largest business city. For 11 economies
the data are also collected for the
second largest business city.
- Are 100% domestically and privately owned.
- Perform general commercial activities.
69. The property (fully owned by the seller):
- Has a value of 50 times income per capita, which equals the
sale price.
- Is fully owned by the seller.
- Has no mortgages attached and has been under the same
ownership for the past 10 years.
- Is registered in the land registry or cadastre, or both, and is
free of title disputes.
- Is located in a periurban commercial zone (that is, on the
outskirts of the city but still within its
official limits), and no rezoning is required.
- Consists of land and a building. The land area is 557.4 square
meters (6,000 square feet). A two-
story warehouse of 929 square meters (10,000 square feet) is
located on the land. The warehouse
is 10 years old, is in good condition, has no heating system and
complies with all safety standards,
building codes and legal requirements. The property, consisting
of land and building, will be
transferred in its entirety.
- Will not be subject to renovations or additional construction
following the purchase.
- Has no trees, natural water sources, natural reserves or
historical monuments of any kind.
- Will not be used for special purposes, and no special permits,
such as for residential use,
industrial plants, waste storage or certain types of agricultural
activities, are required.
- Has no occupants, and no other party holds a legal interest in
it.

1 Notary requests property information from the Property
Registry
: Property RegistryAgency
According to the law (Art. 175 of the Decree dated on June 2,
1944), the notary is obliged to duly
inform the parties, be aware of the ownership and encumbrances
on the property, and consult the
Property Registry books before executing the deed. The
consultations can be done on-line at
www.registradores.org and the printout from the internet is
valid.
This document is an “Informative Land Registry Extract”
containing the same information as an
Ownership and encumbrances Certificate, and bearing the same
responsibility of the Registrar in
case of mistake as a formal certificate would provide. This is an
information product specifically
foreseen by the Mortgage Law to answer the Notary's requests
of Information related to
76. registrable acts and contracts. The Notary submits an electronic
request and receives the
information also by electronic means. From that moment and for
the next ten days, the Registrar
must inform the Notary about any Document submitted to the
Land Registry related to the same
property, within the maximum term of 24 hours since such
document was submitted to the Land
Registry Office. This procedure is aimed at preventing any
surprises or unexpected situations
while the contract is being formalized.
Article 28 of "Act 24 /2005 on reforms to foster productivity",
orders the direct and on line access
from notaries to the register books in order to obtain
information and register the notarial deeds.
This obligation was stated by the former Act 24/2001.
Nevertheless, up to now registries have not
implemented this law and notaries still have to ask information
via "telefax", according to article
354-a of the Mortgage Act of 8 February 1946 and the
implementing Regulations of 14 February
1947.
1 day EUR 9.02
2 Notary obtains cadastral description
: CadastreAgency
The Notary would search the land parcel corresponding to the
property object of the transaction to
identify the area of the land whether there are any buildings in
the property and the cadastral
value for tax purposes (for property transfer tax/value added
tax, for municipal capital gains tax
and for real estate tax).
77. No cost if the "Graphic Consultation" is submitted on line. But
it does not include neither the name
of the owner nor the cadastral value of the property. Those data
can be obtained at a cost of 1€ or
2€ (depending on the extension of the certificate) via the
notarial platform SIGNO that includes
both the name of the owner and the cadastral value of the
property.
The Notary has special access to the Cadaster database. If
parties check this information by
themselves, they still can verify boundaries, size and buildings,
but they cannot obtain information
on ownership and cadastral value. In order to obtain this
information, they have to request an
extract for a fee.

3 Execution and delivery of the public deed of purchase of the
property
: NotaryAgency
Property transfers are valid with a private contract between the
parties, plus the handing over of
the possession of the property to the buyer (ie. the "traditio"
78. through, for example, the handing
over of the keys to the property to the buyer). However, in order
to make the property transfer
opposable to good faith third parties, it has to be registered at
the Land Registry, and in order to
be registered, the contract between the parties has to be
notarized. Additionally, if the buyer
acquired the property in good faith, his title over the property
would be indefeasible after
registration.
Notary fees are set according to a cumulative scale:
• Property value up to EUR 6,010.12: EUR 90.151816;
• For the excess amount between EUR 6,010.13 and EUR

• For the excess amount above EUR 6,010,121.04 the fees are
determined by agreement
between the notary and client.
The Real Decreto Ley 8/2010, of May 20 2010, modifies the
Real Decreto 1426/1989, of
79. November 17th 1989, establishing notary fees. The 2010 decree
establishes a 5% discount for
notary fees. According to Royal Decree 45/2007, the notary
must issue an authorized copy of the
deed on the same or next day and send it to the Registry
electronically, unless otherwise
requested by the interested party.
The documentation shall include:
• Power of attorney granted by the seller and ID of the person in
favor of whom the power was
granted.
• Power of attorney granted by the buyer and ID of the person in

4 Payment of the Transfer Tax (ITP) and obtain the
confirmation of payment at tax authority
: Autonomous Community of Madrid's Tax OfficeAgency
First transfers of property or transfers made between
entrepreneurs are subject to VAT and Stamp
Duty. Second and subsequent property transfers are not subject
to VAT, but to the Transfer Tax
("Impuesto sobre Transmisiones Patrimoniales y Actos Jurídicos
Documentados", ITP).
For the Doing Business case study, as it is assumed that the
buyer is a company and the property
is in Madrid and has been transferred at least once in the past,
the applicable tax should be the
Transfer Tax (ITP). The ITP is paid at the relevant tax office
within 30 working days after the date
of granting of the notarial deed of transfer (a copy of the
transfer deed is to be attached to the
transfer tax liquidation form).
In some autonomias, like Madrid, Catalunya, and Andalucia, the
tax may be paid online, although
the buyer needs to obtain a stamp from the tax authority
81. confirming the payment for ITP and
capital gains tax.
However, it has to be noted that under certain circumstances
(e.g., that the acquisition of the
property is within the scope of the usual activities of the
acquiring company), the acquiring
company can choose to make the transaction subject to transfer
tax or VAT. The VAT paid would
become a credit that the company would deduct from subsequent
transactions, such as those
related to the normal business of the company.
1 day EUR 77,553.17; (6% of
purchase price (ITP))
5 File and pay the municipal capital gains tax ("Impuesto sobre
el Incremento del Valor de los
Terrenos de Naturaleza Urbana") and obtain receipt
: Municipality of MadridAgency
In order to register the property transfer in the Property
Registry, the parties must attach a receipt
to the transfer deed proving that the transaction has been
submitted to the Municipal Tax Authority
in order to file and clear the Municipal Capital Gains Tax
("Impuesto sobre el Valor de los Terrenos
de Naturaleza Urbana"). This procedure can be completed
online at the website of the
Municipality of Madrid.
Notaries can also communicate the transaction to the
municipality online. The municipality sends
an e-mail to the notary confirming the reception.
The tax to be paid for the IVTNU is not used to calculate the

6 The public deed is registered at the Land and Property
Registry
: Property RegistryAgency
The notary submits the public deed to the Land Registry. The
Land Registry will review and
register the transfer within the legal time limit of 15 business
days. If the Procedure takes more
than 15 business days, the fees will be reduced by 30%, unless
there is an objective reason for
the delay.
With the introduction of technology and online Procedures due
to Law 24/2005 of November 18, in
particular section II on electronic registration, the time to
register is in the process of being
reduced. The average registration time is currently at 8 calendar
days.
83. The documentation to be presented to the Land Registry shall
include: (i) Public deed; (ii) Proof of
VAT or ITP payment (attached to the sale purchase agreement);
(iii) Proof of stamp duty payment
(in the case that VAT applied and not ITP); and (iv) proof of
payment of the municipal capital gains
tax.

decree 1427, the cost is
calculated as follows:
a) property value up to

Getting Credit
This topic explores two sets of issues—the strength of credit
reporting systems and the effectiveness of collateral and
bankruptcy laws in facilitating lending. The most
recent round of data collection for the project was completed in
May 2019. .See the methodology for more information
What the indicators measure
Strength of legal rights index (0–12)

Case study assumptions
assesses the sharing of credit information and the legal rights of
borrowers and
lenders with respect to secured transactions through 2 sets of
indicators. The depth of credit
information index measures rules and practices affecting the
coverage, scope and accessibility of
credit information available through a credit registry or a credit
bureau. The strength of legal rights
index measures the degree to which collateral and bankruptcy
laws protect the rights of borrowers
and lenders and thus facilitate lending. For each economy it is
first determined whether a unitary
secured transactions system exists. Then two case scenarios,
case A and case B, are used to
determine how a nonpossessory security interest is created,
publicized and enforced according to
the law. Special emphasis is given to how the collateral registry
operates (if registration of security
interests is possible). The case scenarios involve a secured
borrower, company ABC, and a
secured lender, BizBank.
Doing Business
In some economies the legal framework for secured transactions
will allow only case A or case B
(not both) to apply. Both cases examine the same set of legal
94. provisions relating to the use of
movable collateral.
Several assumptions about the secured borrower (ABC) and
lender (BizBank) are used:
- ABC is a domestic limited liability company (or its legal
equivalent).
- ABC has up to 50 employees.
- ABC has its headquarters and only base of operations in the
economy’s largest business city. For
11 economies the data are also collected for the second largest
business city.
- Both ABC and BizBank are 100% domestically owned.
The case scenarios also involve assumptions. In case A, as
collateral for the loan, ABC grants
BizBank a nonpossessory security interest in one category of
movable assets, for example, its
machinery or its inventory. ABC wants to keep both possession
and ownership of the collateral. In
economies where the law does not allow nonpossessory security
interests in movable property,
ABC and BizBank use a fiduciary transfer-of-title arrangement
(or a similar substitute for
nonpossessory security interests).
In case B, ABC grants BizBank a business charge, enterprise
charge, floating charge or any
charge that gives BizBank a security interest over ABC’s
combined movable assets (or as much of
ABC’s movable assets as possible). ABC keeps ownership and
possession of the assets.

Case study assumptions
To make the data comparable across economies, a case study
105. uses several assumptions about
the business and the transaction.
- Is a publicly traded corporation listed on the economy’s most
important stock exchange.
- Has a board of directors and a chief executive officer (CEO)
who may legally act on behalf of
Buyer where permitted, even if this is not specifically required
by law.
- Has a supervisory board in economies with a two-tier board
system on which Mr. James
appointed 60% of the shareholder-elected members.
- Has not adopted bylaws or articles of association that go
beyond the minimum requirements.
Does not follow codes, principles, recommendations or
guidelines that are not mandatory.
- Is a manufacturing company with its own distribution network.
The business (Buyer):
- Mr. James owns 60% of Buyer, sits on Buyer’s board of
directors and elected two directors to
Buyer’s five-member board.
- Mr. James also owns 90% of Seller, a company that operates a
chain of retail hardware stores.
Seller recently closed a large number of its stores.
- Mr. James proposes that Buyer purchase Seller’s unused fleet
of trucks to expand Buyer’s
distribution of its food products, a proposal to which Buyer
agrees. The price is equal to 10% of
Buyer’s assets and is higher than the market value.
- The proposed transaction is part of the company’s principal
activity and is not outside the
authority of the company.
- Buyer enters into the transaction. All required approvals are
obtained, and all required disclosures
106. made—that is, the transaction was not entered into fraudulently.
- The transaction causes damages to Buyer. Shareholders sue
Mr. James and the executives and
directors that approved the transaction.
The transaction involves the following details:
