Directions Consider the following scenario: Chanel has been married for five years. She recently left her husband, Robert, and moved back in with her parents. Chanel wants to divorce Robert and go back to school so that she can earn a college degree. For the past month, Robert has called and texted her at least ten times per day, begging her to come home. Chanel has blocked his number, but Robert seems to get new numbers all the time. Robert often asks Chanel to go out with him, but Chanel has refused. On one such occasion, Chanel declined his offer and told Robert that she just wanted to stay home and visit with her parents. At the last minute, Chanel changed her mind and went shopping with some friends. When she left the shopping center, she noticed Robert sitting on the hood of her car. Robert was very angry, and accused Chanel of "lying" to him about her plans. Robert grabbed Chanel and attempted to force her into his car, but was thwarted when a security guard drove up and asked him what he was doing. He released Chanel, and she was able to drive home in her own car. Next, Robert turned up at the same restaurant when Chanel went out to lunch with some friends, and later, at the same movie theater. Both times, he approached Chanel and asked her to leave with him. Chanel declined, and left with her friends. The week after, Chanel slowed down for a yellow traffic light when Robert rear-ended her car. Chanel's car suffered extensive damage, and although Chanel was not seriously injured, she was bruised and scared. The police interviewed her and Robert. Robert told the police that Chanel was a terrible driver, and that she had just slammed on the brakes so as to cause a collision. Fortunately, video surveillance cameras at a nearby store showed that Chanel was telling the truth, and that Robert had actually sped up and rammed Chanel's car. Chanel is confused and, while she is thinking of getting a restraining order against Robert, she continually tells her friends that since Robert never hit her, she does not think that Robert would really hurt her. At the same time, she concedes that she is having trouble sleeping, and she is becoming more worried about what Robert will do in the future, because he cannot seem to accept the divorce. Assume that the police have referred Chanel to your domestic violence agency, and she has been assigned to you as a client. Chanel is confused about why she has been referred to a domestic violence agency, because she reiterates that Robert has never hit her. Chapter 1 of "Minding the Obligation Gap in Community Colleges" opens by challenging the idea of "disruption" and how we're conditioned through our educational experiences to categorize this as a negative action from a student. The authors suggest a shift in perspective away from the behavior and towards the educational structures themselves. As stated in the reading, community colleges often act as the first step for PERMSCs to pursue their professional goals and endeavors. Therefore, the information presented here should be of key interest to those that serve in community college, both as administrators and educators. We need to look at the European American system that we've become accustomed to and become aware of how this ties into cultural dissonance, equity gaps and hyper marginalization of students.
The emphasis of White Supremacy, especially in the "Bursting the Myth" section, is a topic that has and will continue to be highlighted in the midst of our current social movements, namely Black Lives Matter. The prevalence and continuation of racism is due to White Supremacy being a foundational block of many of our systems in America today, including education. This is a topic that I got the chance to do more research on when focusing on CRT (Critical Race Theory) in graduate school and how this translates to higher education settings. The call for racial equality, social justice and reform has continued to increase in volume throughout the past several years. Just in the past year alone, more educational institutions are focusing and aligning with this movement on a national (and global) scale. While it may take many years to completely dismantle White Supremacy from education and in our nation as a whole, recognizing the issues and systems that are barriers for success for PERMSCs is a step in the right direction.

Not so long ago, I was in charge of Safety for a fleet of vehicles and drivers. The trucks always had a "team", i.e. 2, and sometimes 3 to a truck to perform delivery duties. There always seemed to be accidents that were minor (damage) to the vehicles with no injuries to the driver team. These accidents would mostly occur while backing. Prior to my managing of fleet safety, technological advancements had "SUBSTITUTED" the job of a good old-fashined "spotter". Back up cameras, sensors and additional mirrors had replaced a person simply disembarking the vehicle and positioning themselves in a safe location to make eye-contact with the driver; and usher the driver/truck into the parked position. Seeing that "ENGINEERING CONTROLS" were already in-place, I needed to affect "ADMINISTRATIVE CONTROLS" and revise the drivers current Standard Operating Procedures, SOP's, (outlining backing) to incorporate the passenger performing duties as a spotter. This also necessitated a training component for the entire fleet of drivers as to expectations around both critical functions of driving and acting as the spotter. This change was implemented successfully and minor-backing accidents, without a spotter, reduced significantly and the engineering controls were present as an additional measure in lieu of ELIMINATING the spotter.

Abstract
A brief synopsis of the legality of disciplining students with special needs in public
education is presented. An example of a case study is also presented from the
experience of the author demonstrating laws surrounding providing students with a free
and public education (FAPE). Examples of the application of the laws protecting
students’ rights to FAPE and the responsibility of school districts to insure the timely
response of handling discipline issues are also presented.
Legal Analysis
Laws are made to protect the rights, liberty, life, and the pursuits of happiness of
individuals. This paraphrase of the Fourteenth Amendment of the Constitution of the
United States of America is exhibited in every area of society. The discipline of
education also has these same laws to protect and to preserve the sanctity of instruction
where the transmittal of knowledge is presented in an atmosphere that is conducive to
the learning environment. When students habitually display inappropriate attitudes and
behaviors especially after appropriate disciplinary responses are applied to try to
discourage those destructive actions, alternative means of providing education to those
students become an urgent priority of the school to insure that instruction and learning
continue and are not hindered by the wrongful choices of disrespectful, disobedient, and
disruptive students.
There are federal laws, state statutes, case laws, and local policies which address
the areas of rights, liberty, life, and the pursuits of happiness of individuals who are
disabled. The intent of these laws, statutes, and policies are positive. The main purpose
of these safeguards is to insure that everyone is treated fairly and is not disadvantaged
due to a physical, mental, or emotional disability. The challenge exists when
individuals with a disability or disabilities exploit their disability or disabilities and the
intent of these laws, statutes, and policies, to perpetuate their wrongful and selfish
impulses. The topic: Disciplining Students Receiving Special Education attempts to
address the importance of following legal documents to help and not to hinder the
protection and preservation of instruction and learning in a safe environment for all
students.
According to Title 20>Chapter 33>Subchapter II>c 1415 Procedural Safeguards,
there are different types of procedures listed which address the responsibilities and
rights of schools, parents, and students pertaining to disciplining students receiving
Special Education. One of those procedures discussed the steps to be initiated by the
school prior to initiating or refusing to initiate a change of placement.

Not so long ago, I was in charge of Safety for a fleet of vehicles and drivers. The trucks always had a "team", i.e. 2, and sometimes 3 to a truck to perform delivery duties. There always seemed to be accidents that were minor (damage) to the vehicles with no injuries to the driver team. These accidents would mostly occur while backing. Prior to my managing of fleet safety, technological advancements had "SUBSTITUTED" the job of a good old-fashined "spotter". Back up cameras, sensors and additional mirrors had replaced a person simply disembarking the vehicle and positioning themselves in a safe location to make eye-contact with the driver; and usher the driver/truck into the parked position. Seeing that "ENGINEERING CONTROLS" were already in-place, I needed to affect "ADMINISTRATIVE CONTROLS" and revise the drivers current Standard Operating Procedures, SOP's, (outlining backing) to incorporate the passenger performing duties as a spotter. This also necessitated a training component for the entire fleet of drivers as to expectations around both critical functions of driving and acting as the spotter. This change was implemented successfully and minor-backing accidents, without a spotter, reduced significantly and the engineering controls were present as an additional measure in lieu of ELIMINATING the spotter.

Abstract
A brief synopsis of the legality of disciplining students with special needs in public
education is presented. An example of a case study is also presented from the
experience of the author demonstrating laws surrounding providing students with a free
and public education (FAPE). Examples of the application of the laws protecting
students’ rights to FAPE and the responsibility of school districts to insure the timely
response of handling discipline issues are also presented.
Legal Analysis
Laws are made to protect the rights, liberty, life, and the pursuits of happiness of
individuals. This paraphrase of the Fourteenth Amendment of the Constitution of the
United States of America is exhibited in every area of society. The discipline of
education also has these same laws to protect and to preserve the sanctity of instruction
where the transmittal of knowledge is presented in an atmosphere that is conducive to
the learning environment. When students habitually display inappropriate attitudes and
behaviors especially after appropriate disciplinary responses are applied to try to
discourage those destructive actions, alternative means of providing education to those
students become an urgent priority of the school to insure that instruction and learning
continue and are not hindered by the wrongful choices of disrespectful, disobedient, and
disruptive students.
There are federal laws, state statutes, case laws, and local policies which address
the areas of rights, liberty, life, and the pursuits of happiness of individuals who are
disabled. The intent of these laws, statutes, and policies are positive. The main purpose
of these safeguards is to insure that everyone is treated fairly and is not disadvantaged
due to a physical, mental, or emotional disability. The challenge exists when
individuals with a disability or disabilities exploit their disability or disabilities and the
intent of these laws, statutes, and policies, to perpetuate their wrongful and selfish
impulses. The topic: Disciplining Students Receiving Special Education attempts to
address the importance of following legal documents to help and not to hinder the
protection and preservation of instruction and learning in a safe environment for all
students.
According to Title 20>Chapter 33>Subchapter II>c 1415 Procedural Safeguards,
there are different types of procedures listed which address the responsibilities and
rights of schools, parents, and students pertaining to disciplining students receiving
Special Education. One of those procedures discussed the steps to be initiated by the
school prior to initiating or refusing to initiate a change of placement.

Title: Recorded/Live Popular Music Concert Report (Essay) Overview: Recorded and live performances are invaluable to the understanding and appreciation of music. They provide students with an opportunity to see amateur/professional musicians at work, as well as provide context for class discussions. Each student is required to either attend a live concert or view a recorded performance of a popular music artist and write a concert report (essay of at least 500 words) that assesses carefully the musical elements of the performance. Details: The purpose of this assignment is to: x identify and describe the elements of music. x demonstrate listening skills through identification of musical elements within the music. x identify basic musical vocabulary. x experience a recorded RU liYe SeUfRUPaQce Rf a ³SRSXlaU PXVic´ aUWiVW. Requirements: Each student is required to either attend a live concert or view a recorded performance (e.g., DVD, YouTube, etc.) of a popular music artist (e.g., rock, hip hop, salsa, etc.) and write a concert report (essay of at least 500 words) that assesses carefully the musical elements of the performance. Proper citation is required if a recorded performance is selected. Students who opt for a live performance of a popular music artist must submit a photocopy of the program cover (when available). The essay must be double-spaced and use Times New Roman, 12 Point Font. A sample report (essay) and sample outline (for note taking during the performance) will be provided in the weeks to come. A rubric will be used to assess the essay (See Attachment) Check the calendar for due dates. Resources: Students are required to submit this writing assignment to Tutor.com. - 1. Directions Consider the following scenario: Chanel has been married for five years. She recently left her husband, Robert, and moved back in with her parents. Chanel wants to divorce Robert and go back to school so that she can earn a college degree. For the past month, Robert has called and texted her at least ten times per day, begging her to come home. Chanel has blocked his number, but Robert seems to get new numbers all the time. Robert often asks Chanel to go out with him, but Chanel has refused. On one such occasion, Chanel declined his offer and told Robert that she just wanted to stay home and visit with her parents. At the last minute, Chanel changed her mind and went shopping with some friends. When she left the shopping center, she noticed Robert sitting on the hood of her car. Robert was very angry, and accused Chanel of "lying" to him about her plans. Robert grabbed Chanel and attempted to force her into his car, but was thwarted when a security guard drove up and asked him what he was doing. He released Chanel, and she was able to drive home in her own car. Next, Robert turned up at the same restaurant when Chanel went out to lunch with some friends, and later, at the same movie theater. Both times, he approached Chanel and asked her to leave with him. Chanel declined, and left with her friends. The week after, Chanel slowed down for a yellow traffic light when Robert rear-ended her car. Chanel's car suffered extensive damage, and although Chanel was not seriously injured, she was bruised and scared. The police interviewed her and Robert. Robert told the police that Chanel was a terrible driver, and that she had just slammed on the brakes so as to cause a collision. Fortunately, video surveillance cameras at a nearby store
- 2. showed that Chanel was telling the truth, and that Robert had actually sped up and rammed Chanel's car. Chanel is confused and, while she is thinking of getting a restraining order against Robert, she continually tells her friends that since Robert never hit her, she does not think that Robert would really hurt her. At the same time, she concedes that she is having trouble sleeping, and she is becoming more worried about what Robert will do in the future, because he cannot seem to accept the divorce. Assume that the police have referred Chanel to your domestic violence agency, and she has been assigned to you as a client. Chanel is confused about why she has been referred to a domestic violence agency, because she reiterates that Robert has never hit her.
