“If copyright hadn't been invented, what kind of copyright would we want…”
This was the question put by the British Council. On April 9th they are hosting an event at which a wide range of speakers will discuss new ideas and proposals for the future evolution of copyright to mark the week when the world's first copyright act came into force 300 years ago. This document is CAS-IP's contribution to the debate.
This is a lesson I created for an assignment in my EdTech program. It can be used in middle school & high school technology classes to introduce the basics of copyrights, and guidelines for reducing infringement on copyrighted material.
This infogram could be used as a starting point for people who would like to learn more about how and why Creative Commons came to be, as well as providing information about its activities and support of the open movement.

The current IPR regime, a legacy of the simpler times of the 20th century, has come under assault since the new millennium. We look at what is happening, why, and how IPR can remain a champion cause for the future.
In August 2009, the US Department of Justice (DoJ), together with the US Department of Agriculture (USDA) announced a series of workshops intended to “explore competition and regulatory issues in the agriculture industry”. - Agriculture and Antitrust Enforcement Issues in Our 21st Century Economy – will enquire into agriculture and into the dairy, poultry and livestock industries. One of several workshops that has been scheduled will take place in Iowa and address “…seed technology, vertical integration, market transparency and buyer power”.
These hearings will ask if mergers and acquisitions have reduced competition in the US seed industry. While this enquiry is US centric, CAS-IP, in its role to assist the CGIAR and its constituency of resource-poor farmers, argues that the availability of seed to poor farmers is critical to current and future food security. This is no longer a national issue, and the food security of developing nations is of great concern to the US and to other developed nations.

Those of us that work in the area of intellectual property (IP) often long to find sources that cover a collection of information where it is easy to find what we want, is dependable, and is concise. This Compendium is that sort of work, (that we hope to update on an annual basis). The IP systems of thirteen countries located in Asia, Africa and Latin America are briefly described, with a chapter on the European and U.S. system for comparative purposes. Links for official governmental (on-line) sites are provided for those that need official information. It represents the work of members of the National Partners Initiative (NPI), a community of intellectual property (IP) practitioners. The NPI is supported by its members and the funding generosity provided by the Directorate-General for International Cooperation (DGIS), Ministry of Foreign Affairs of the Netherlands and the Centers of the Consultative Group on International Agricultural Research (CGIAR), through the CGIAR-Central Advisory Service on Intellectual Property (CAS-IP).

This case examines the Peruvian National Agricultural Innovation Institute (INIA). The authors took one example of a project being executed by INIA, analyzed the IP issues and identified how these issues impact researchers’ daily activities. This will help them to realize that IP needs to be constantly taken into consideration. An additional purpose of this case study is to trigger, in the near future, a complete understanding of the importance of IP and a sequence of actions leading to the development of an internal and appropriate IP Policy for INIA. Finally, the authors' assessment allowed identification of issues that may affect the development of the technology initiated by the project and its commercialization in Peru and, potentially, in other countries.

This case study comes from Costa Rica. It describes the process that the University of Costa Rica’s Office for Knowledge Management and Transfer (PROINNOVA) undertook to license the seeds of a new papaya variety, named Pococi. This was developed jointly by the University of Costa Rica (UCR) and the National Institute for Agricultural Technology (INTA, for its acronym in Spanish) from Costa Rica. The study seeks to better understand the institutional challenges that must be addressed by potential license seeking organizations in Costa Rica to ensure successful transactions.
The project itself was not successful because, after addressing several institutional issues, a license agreement was not concluded. Failures and/or unsuccessful projects can be a good way of acquiring experience, especially when lessons can be learned.

IPRs had never been an important issue within CPFRD, due to the general belief among its staff that all research findings and innovation generated in the centre ought to remain in the public domain. Through intensive discussions among the research managers, scientists and supporting staff within the CPFRD, a clearer understanding about IPRs and its potential role in stimulating research and innovation has evolved, and IPRs are now becoming one of the priority issues within the CPFRD. The centre has now developed some initial “IPRs Policy Guidelines”, a manual of procedures for IPRs application, and has initiated a Forestry IP Forum among forestry research institutions and practitioners in Indonesia.
These case studies aim to share country experiences from developing countries in the areas surrounding IP policy making, policy implementation and use of IPRs by researchers for leveraging more benefits to the stakeholders, people, institutions and countries.

1. Copyright 2010: if copyright hadn't been invented, what kind of copyright would we
want?
Many would answer this question by saying “we do not need copyright at all”. But
copyright, if well designed, can serve end-users, creators and the public.
Common regime
A strong international convention with unalterable conditions will be in place. Moral
rights will be interpreted and applied uniformly in all states. A common agreement to
enforce them uniformly is essential to ensure that copyright protects culture. If
harmonization is not possible on an international level, it will at least be on a European
level.
Fair dealing/use
Understanding when a consumer can use a copyrighted work without infringing a
copyright holder’s rights is clear. Extended terms are defined so that the boundaries of
the commons are preserved; the work itself uses a comprehensible code system (as in
Creative Commons) to communicate to the public what users can do and in what
circumstances.
Derivative works
Copyright cannot extend to derivative works. Authors of works which derive from
copyrighted works do not need authorization from the original right-holder. However, a
high degree of originality is required to grant protection to the derivative work.
Registration
The requirement for an international registration of copyrighted works facilitates the
identification of the rights-holder, thus making it easier to provide legal access to works;
the more legal access there is, the fewer reasons there are for people to opt for non-legal
methods.
2. Responsibility for infringement
There are clear parameters of responsibility for breach of copyright. Copyright has its
own regime of primary and secondary liability without forcing the application of
common law principles of “joint-liability” or rules from other intellectual property
systems, like patents. In this way, end-users and service providers have a better
understanding of when they would be in breach of copyright.
Term
The copyright regime promotes creativity and cultural activity. Protection lasts only for
the life of the author.
Collecting Societies
The online world now takes advantage of the possibilities offered by digital formats to
include all relevant licensing/payment systems in the file, so that artists are paid directly
rather than using collecting societies. In this way consumers do not have to pay every
time they use a copyrighted work. This system strengthens the link between artists and
users.
Conclusion
Copyright law has one purpose: the promotion of culture and artistic creativity. In this
regime, rights, especially if in the hands of non-authors, do not become mere
commodities, as this could harm both the public interest and, ironically, also artists and
creativity itself. By achieving this balance, current technology is fully utilized to ensure
that knowledge and information is freely accessible and widely disseminated. Further,
this copyright regime has a significant impact, not just on artistic expression, but also on
research and innovation by creating a free flow of information.
