Conservation covenants are a new type of voluntary but legally binding agreement enabled through the Environment Act that can secure the long-term conservation of the natural or heritage features of the land covered by the agreement.

The Shared Decision Making (SDM) in British Columbia Project was a multi-year independent research initiative housed at Simon Fraser University’s Centre for Dialogue. This collaborative project examined the emergence of non-treaty ‘SDM Agreements,’ negotiated between British Columbia and individual or groups of First Nations, in the form of Strategic Engagement Agreements’ or ‘Reconciliation Protocols.’ Each SDM Agreement provides a framework for collaboration between two governments who despite their differences, seek to build working relationships with one another, develop trust, and find ways to reach mutually agreeable decisions about how land and resources should be managed.
The overarching purpose of the SDM in BC project was to understand more clearly where SDM agreements have come from, what they mean, and how they are working so far.

This presentation was given by Adeline Dontenville of the EU REDD Facility at a COP20 side-event titled "Benefit and Burden Sharing in Forest Policies and REDD+" in Lima, Peru.
The event addressed the benefits and costs associated with forest conservation initiatives across multiple countries, and their equity implications. It builds on results gathered from an ongoing multi-year European Commission-funded project aimed to provide policy options and guidance to improve the design, development, and implementation of REDD+ benefit sharing mechanisms.

• Conservation opportunities in England are being missed
• Costly and complex workarounds currently required for conservation
action on private land due to current systems:
• Designation requires sites of a specific quality, and each designation must be approved
by government
• Property law does not allow for the attachment of positive obligations to land
• Contract law only binds the land's current owner to an agreement
• Results in suboptimal conservation and economic impacts

7. What is a Conservation Covenant (ConCov)?
• Private, legally binding and voluntary agreement between a
landowner or long-term leaseholder and a designated
“responsible body” (RB)
• Comes into force on 30th September
• RBs: a conservation charity, public body (inc. LAs) or for-profit body with
conservation as a core purpose
• Can be used for the conservation of nature or heritage on that piece of
land, and must be for the public good
• Can last in perpetuity or for a specified time period
• Binds future owners of the land (inc. LAs)

• Must be registered as a Local Land Charge
• Need to be monitored and enforced by both parties
• Can be discharged, modified or transferred to another RB through
mutual agreement between landowner and RB
• Will include an RB annual reporting requirement
