RULES AND PROCEDURES FOR RE-ADMISSION OF A FORMER
PARTICIPANT TO KP
Re-admission of a previously excluded Participant will be considered upon
written application, after the country has demonstrated compliance with the
minimum standards of the KPCS and the inconsistencies that were the basis
for exclusion of the country from the KPCS have been resolved.
The following procedure is employed for re-admission:
A) Authorized representatives of the Applicant for re-admission shall
submit to the KP Chair, through diplomatic or other official channels, an
official statement in writing of their desire to re-join the KP. The Participation
Committee, on receiving the corresponding request from the KP Chair, shall
initiate the procedure for assessing the application.
B) Upon the initiation of the assessment by the Participation Committee,
the Applicant shall submit to the Participation Committee:
1. A written review of the mechanisms for implementation of the
KPCS, along with copies of updated legislative and other materials that
demonstrate compliance with the minimum standards of the KPCS.
This should include contact information and addresses of designated
authorities responsible for implementation of the KPCS and description
of the system of controls over rough diamond trade (import and export)
as well as the internal controls for the internal trade in rough diamonds;
2. Replies in writing to the Questionnaire required for Applicant-
countries by the Plenary in Brussels 2007, as well as objective
evidence that the irregularities that were the reason for exclusion of the
country from the list of Participants have been addressed;
3. The Participation Committee may request additional data,
including verification of data on rough diamond mining/production/trade
and any other supplementary data, according to paragraph 3.4 of the
terms of reference of the Participation Committee.
4. The Applicant will invite a KP expert mission for the
assessment of implementation of KPCS minimum standards, and the
system of internal controls for rough diamond trading, unless otherwise
agreed to by the Participation Committee.
5. The Participation Committee may seek any other data or
information deemed relevant to assessing the capacity of the
Participant to comply with the KPCS minimum standards.

6. The Participation Committee, upon completion of its review of
all data and submissions, will recommend to the Chair in writing the re-
admission or the decision not to re-admit the Applicant. Such
recommendation shall be in a timely manner and shall not be
unreasonably withheld.
C) Recommendation on re-admission of the Applicant or on motivated
denial of the Application should be submitted by the KP Chair to the Plenary
for consideration. The KP Plenary decision shall be addressed in writing to
the authorized representatives of the Applicant by the KP Chair.
