Consumer Protection Meaning & Definition
Consumer Protection means providing
shield to the consumer from the
unethical, exploitative and unlawful
practices of sellers or manufacturers.

NEED FOR CONSUMER PROTECTION
• Adulteration.
• Spurious goods.
• Misleading advertising.
• Artificial scarcity.
• Other problems.
Consumer ProtectionAct-1986 4
UNFAIR TRADE PRACTICE
 Any unfair method or deceptive practice used for
supplying the goods or for the promotion ofsales.
TYPES OF UNFAIR TRADE PRACTICES
• False representation.
• False offer of bargain price.
• Free gifts offer and prize scheme.
• Non-compliance of prescribed standards.

The exploitation of consumer predominantly categorized into following three heads:
1) Physical and Mental Exploitation:
Consumers are disappointed and angry when they are forced to purchase sub-standard
quality products or duplicate ones. The inferior ingredients used in the product, leads to
physical problems.
2) Economic Exploitation:
Consumers are facing financial loses due to hoarding of goods, black marketing and
charging higher prices than the printed prices.
3) Against Public Interest:
Public interest is not safeguarded when some products are produced by using certain
materials which can cause harm to environment.
Categories of Exploitation of Consumers

CONSUMER
• According to the Consumer protection Act, “A consumer is a person who receives
goods or services against an exchange. He pays or agrees to compensate partly or
fully or promises to compensate on a future date or has participated in some future
payment plan. Any user of the product or services who uses it on the basis of the
permission of the purchase is a consumer. But the one who purchases on a resale
basis or for further production is not included under the definition of a consumer.”
• Person who buys any commodity or service or
uses such commodity or service
• Must satisfy two conditions to claim himself as a consumer
 The service must have been rendered to him
 He must have paid or promised to pay for the same
• If any person buy capital goods to provide services to other individuals then he is also
recognized as consumer
• If any person who buys commodity with an intention to resale or trade then he is
not recognized as consumer

CONSUMER PROTECTION ACT-1986
• This law was enacted in 1986 to protect interests of consumersin
India
• To make provision for the establishment of consumer councils
• For settlement of consumer disputes
• This Act applies to all goods andservices
• It guides how to file the case in consumer courtProvide justiceto
consumers.
• It was passed by both the Houses of Parliament

• Part of the society : Any business is a part of a society. Every
seller is a customer of another seller. If consumer exploitation is
inevitable then every person will have to experience exploitation.
Hence , every seller should adopt such a policy which will increase
the faith of the buyer and distance him from consumers
exploitation.
• Impression on the society: Business impacts the habits of
the people of society, their life style , thoughts , living
standards , food habits , fashions , clothing etc. thus can
be changed through advertisement. That is why business
policy should be proper and good business ethics remains
the moral responsibility of the businessmen.

From the view point of consumer
• Extensive Exploitation of consumer : It is widely seen
that business units are trying to increase their
profit by producing sub standard , adulterated ,
and duplicated products and resorting to
misleading advertisement , black marketing ,
hording of goods and other unethical units have
resulted in a need for consumer protection.

  • 5. UNFAIR TRADE PRACTICE  Any unfair method or deceptive practice used for supplying the goods or for the promotion ofsales. TYPES OF UNFAIR TRADE PRACTICES • False representation. • False offer of bargain price. • Free gifts offer and prize scheme. • Non-compliance of prescribed standards. 5

The exploitation of consumer predominantly categorized into following three heads: 1) Physical and Mental Exploitation: Consumers are disappointed and angry when they are forced to purchase sub-standard quality products or duplicate ones. The inferior ingredients used in the product, leads to physical problems. 2) Economic Exploitation: Consumers are facing financial loses due to hoarding of goods, black marketing and charging higher prices than the printed prices. 3) Against Public Interest: Public interest is not safeguarded when some products are produced by using certain materials which can cause harm to environment.   • 7. CONSUMER • According to the Consumer protection Act, “A consumer is a person who receives goods or services against an exchange. He pays or agrees to compensate partly or fully or promises to compensate on a future date or has participated in some future payment plan. Any user of the product or services who uses it on the basis of the permission of the purchase is a consumer. But the one who purchases on a resale basis or for further production is not included under the definition of a consumer.” • Person who buys any commodity or service or uses such commodity or service • Must satisfy two conditions to claim himself as a consumer  The service must have been rendered to him  He must have paid or promised to pay for the same • If any person buy capital goods to provide services to other individuals then he is also recognized as consumer • If any person who buys commodity with an intention to resale or trade then he is not recognized as consumer 7

CONSUMER PROTECTION ACT-1986 • This law was enacted in 1986 to protect interests of consumersin India • To make provision for the establishment of consumer councils • For settlement of consumer disputes • This Act applies to all goods andservices • It guides how to file the case in consumer courtProvide justiceto consumers. • It was passed by both the Houses of Parliament Consumer Protection Act-1986 8

  • 12. • Part of the society : Any business is a part of a society. Every seller is a customer of another seller. If consumer exploitation is inevitable then every person will have to experience exploitation. Hence , every seller should adopt such a policy which will increase the faith of the buyer and distance him from consumers exploitation. • Impression on the society: Business impacts the habits of the people of society, their life style , thoughts , living standards , food habits , fashions , clothing etc. thus can be changed through advertisement. That is why business policy should be proper and good business ethics remains the moral responsibility of the businessmen. 12

From the view point of consumer • Extensive Exploitation of consumer : It is widely seen that business units are trying to increase their profit by producing sub standard , adulterated , and duplicated products and resorting to misleading advertisement , black marketing , hording of goods and other unethical units have resulted in a need for consumer protection. 14
