The US Justice Department opened an antitrust investigation into the hiring practices of major tech companies in Silicon Valley like Google, Apple, Yahoo, and Genentech. While these companies aggressively compete for top talent, lawyers and recruiters said there is an unwritten "gentlemen's agreement" that companies do not poach employees from each other, but rather compete through legitimate hiring processes. The key question is whether this agreement constitutes anticompetitive behavior under antitrust law.

The Troubled Future of Startups and Innovation: Webinar for London Futurists
These slides show how the most successful startups of today (Unicorns) are not doing as well as the most successful of 20 to 50 years ago. Today's startups are doing worse in terms of time to profitability and time to top 100 market capitalization status. Only one Unicorn founded since 2000 has achieved top 100 market capitalization status while six, nine, and eight from the 70s, 80s, and 90s did so. It is also unlikely that few or any of today's Unicorns will achieve this status because their market capitalizations are too low, share prices increases since IPO are too small, and profits remain elusive. Only 14 of 45 had share price increases greater than the Nasdaq and only 6 of 45 had profits in 2019. The reasons for the worse performance of today's Unicorns than those of 20 to 50 years ago include no breakthrough technologies, hyper-growth strategies, and the targeting of regulated industries. The slides conclude with speculations on why few breakthrough technologies, including science-based technologies from universities are emerging. We need to think back to the division of labor that existed a half a century ago.

Ask most people who invented the lightbulb, and they will promptly provide the wrong answer: Thomas Alva Edison. Truth is, the famous inventor's 1879 debut of his incandescent light trailed others by decades. So why does he get all the glory? Mostly because of what he did next, notes Andrew Hargadon, author of How Breakthroughs Happen: The Surprising Truth about How Companies Innovate. To get his creation to the masses, Edison and his team of engineers in Menlo Park, N.J., spent years building the entire electric system, from light sockets and safety fuses to generating facilities and the wiring network. Only then did the electric light flare into the innovation that lit the world.
In short, Edison beat all his predecessors at one crucial task: managing the whole process of innovation, from light-bulb moment to final product. Today that task is scarcely easier than it was 125 years ago. Sure, it's easy to get lucky once in a while. The real trick is doing it over and over again. "Managing innovation means cultivating an environment where lightning can strike twice," says Paul Saffo, research director at the think tank Institute for the Future. "It's extraordinarily difficult."
To hard-headed business people, innovation often seems as predictable as a rainbow and as manageable as a butterfly. Penicillin, Teflon, Post-it Notes -- they sprang from such accidents as moldy Petri dishes, a failed coolant, and a mediocre glue. It's no wonder so many executives throw up their hands. "Our approach has always been very simple, which is to try not to manage innovation," shrugs Silicon Valley venture capitalist Michael Moritz, a partner with Sequoia Capital. "We prefer to just let the market manage it."
Yet even in the Darwinian chaos of Silicon Valley, innovations are made, not born. The world's most innovative companies, from Procter & Gamble and Toyota Motor to Apple Computer and Edison's own General Electric, make their own luck. They plunge ahead on new ideas even though they know most will fail. "You have to go down blind alleys," says Jeffrey P. Bezos, founder and chief executive of pioneer online retailer Amazon.com Inc. "But every once in a while you go down an alley and it opens up into this huge, broad avenue. That makes all the blind alleys worthwhile."

Overall what occurred in 2015 following the information of Volkswagen cheating the consumers, the market, and the EPA was fairly little in the grand scheme of things. The background surrounding Volkswagen essentially getting away with mass pollution and hoodwinking the industry for years is that a defeat device was installed within the vehicle’s engine that programmed it to run in a cleaner mode when hooked up to a test (Poeir, 2020). This obviously did not restrict the vehicle when performing on an open road. The device was eventually discovered and Volkswagen was billed for 25 billion dollars (Poier, 2020). However, the market share gained from this deception may have been worth it, as the vehicles outperformed all other competition in power and fuel economy that it resulted in the vehicles being ranked top in their respective classes that year (Poier, 2020).
However, what might Volkswagen do now to build back some of the trust within the corporate world? How can they redeem themselves economically? The first step arguably is to regain the trust of their shareholders and instill a set of ethics the likes of which cannot be questioned. Obviously, a drop in stock price is bad news, however, the company is by no means insolvent, and they quickly recovered following the incident. However ethics the company needs to advertise and explain to investors and to staff some sort of new ethical guidance that can convince people to purchase their products once again.
In regards to recovering legally, there’s been a fairly limited number of lawsuits, there were several major ones, however between the payouts of that and the fines levied against them from the EPA and other countries they seem to have paid the piper, the best way to address the issue legally and ethically would be to launch a voluntary recall in which people with the defeat devices may receive an upgrade at no cost to themselves. This would also address the philanthropic needs of the company. Additionally, many companies devote a sum of their profits to things that seem counter to their product, Coke for example sponsors huge numbers of athletic programs for children. Volkswagen may consider doing the same but planting some sort of forest to help deal with the carbon footprint. While I’m not the most creative individual in the world, it seems that there is any number of philanthropic things the company could do to earn them a “Subaru-Esque” reputation in the industry.

Do you remember the winner of the The Apprentice who lied on his CV, but still won the job with Sir Alan? I
recently took part in a Money and Morals Roadshow with a group of sixth formers and heard from many of them
that it was OK to do the same--after all, the practice had been endorsed on TV.
Why do I mention this? Well, I've been thinking a lot about ethics and the property industry since the article,
Double Agents (Property Week, 06.13.10), which lifted the lid on the practice of investment advisers that act for
both vendor and purchaser.
One of my biggest concerns about this practice is the signal that it gives young people coming into our industry.
From where do they take their direction? Will it be the RICS, with its nine core values that include "acting with
integrity" and "being open and transparent in your dealings", or will it be from the senior managers with whom they
work day to day?
My guess is that, like the sixth formers, they are more likely to be influenced by the behaviour of a high-flying role
model at work, rather than a moral or ethical code published by the RICS.
This means that those who have reached a position of influence in the industry need to take care to ensure that the

next generation of surveyors has a clear moral compass. My fundamental concern is that by turning a blind eye to
practices such as double dealing, we are, in fact, giving the thumbs-up to unethical practice.
Business ethics has been described as the attempt to resolve the conflict between selfishness and selflessness and
between our material needs and our conscience. I strongly believe the property industry needs to develop a set of
ethical norms to guide its behaviour and help young people deal with the pressures on business today. These norms
need to be debated, challenged and understood. I accept that there are many pressures on business today, but do not
believe this in a reason to put ethical behaviour to the bottom of the agenda. Well done to Property Week for giving
profile to the issue.
I recently spoke with a leading investment agent who told me a string of stories about the ways in which he believes
"certain firms" are crossing the boundary between selflessness to selfishness.
An example, in addition to acting for both sides, includes a subsector of the investment market where he believes
that deal.
