There is no internationally agreed definition of what constitute indigenous peoples or ethnic
minorities. An ethnic group generally shares a common sense of identity and common

The Supreme Court has ruled in S.K. Patro v. State of Bihar, that a minority community can only
claim the privileges under Article 30 must be a minority person who is residing in
India. Foreigners who are not resident or nor a citizen in Indian do not come within the scope of
Article 30.

A particular problem relating to minorities and citizenship is that all too often members of
certain groups are denied or deprived of their citizenship because of their national or ethnic,
religious and linguistic characteristics.

ethnic, religious or linguistic minorities. Discrimination against minorities
has frequently led to their exclusion from citizenship. Such exclusion is
often experienced in newly independent States that define citizenship in
a manner that excludes persons belonging to certain minority groups who are considered
as “outsiders” despite long-standing ties to the territory of the new State
