This document outlines a national program to formally recognize and protect customary communities in Indonesia through REDD+ initiatives. The program aims to 1) develop capacities and facilitate participation of customary communities in government programs like REDD+, 2) accelerate regulations recognizing customary communities, and 3) develop legal basis for protection through draft laws. Signatories, including several ministers, agree to implement this program to expand participation of customary communities in REDD+ under Indonesia's constitution.

1. Declaration
National Programme for the Recognition and Protection of Customary
Communities through REDD+ (Reduction of Emissions from
Deforestation and Forest and Peat-land Degradation)
In order to formalise the recognition and protection of customary communities (MHA,
Masyarakat Hukum Adat) within the framework of the Unitary State of the Republic of
Indonesia in accordance with the 1945 Constitution (Article 18B, paragraph 2), the People's
Consultative Assembly Ruling on Agrarian Reform and Natural-resources Management (TAP
MPR IX/2001), the Constitutional Court Decision No. 35/PUU-X/2012, and other related
regulations, herewith, we, the signatories below, agree to implement the following:
1. develop capacities and facilitate active participation of MHA in the implementation of
various government activities and programmes including, but not limited to, REDD+
programmes;
2. support the acceleration of synchronising and harmonising regulations related to the
protection and recognition of MHA including, but not limited to, the criteria for
determining their existence, mechanisms for their recognition, and the criteria for
determining spatial maps of MHA;
3. support the development of a legal basis for the protection and recognition of MHA
including, but not limited to, a draft law (RUU) on Protection and Recognition of
Customary Communities (PPMHA) and a RUU on Land, through active government
participation in the development process of the above two RUUs;
2. 4. support regional governments in the implementation of data recording of the presence
of MHA and their areas through an inventory process and regional regulations;
5. inventories and aim towards resolving various conflicts related to the presence of MHA
and, at the same time, anticipate future potential conflicts to ensure legal certainty in
the protection of rights for all citizens;
6. implement integrated and just mapping and data recording of land control, ownership,
and utilisation with attention given to land titles for the community including MHA;
7. strengthen the institutional capacity and authority of various national and regional
parties including those responsible and assigned to provide recognition and protection
of MHA;
8. support the implementation of the REDD+ (Reduction of Emissions from Deforestation
and Forest and Peat-land Degradation) programme as one effort to expand the
participation of MHA within the framework of the Unitary State of the Republic of
Indonesia.
