4. INTRODUCTION OF RERA:
land Regulation & Development Authority (RERA) is an Act gone by the Indian
Parliament. The Rajya Sabha passed the RERA bill on March 10, 2016, followed by
the Lok Sabha on March 15, 2016, and it came into force from May Day, 2016. 59
of its 92 sections were notified on May Day, 2016 and therefore the remaining
provisions came into force from May Day, 2017. Under the Act, the central and
state governments, are required to notify their own rules under the Act, six months,
on the idea of the model rules framed under the central Act.
For a long, homebuyers complained that land transactions were lopsided and
heavily in favor of the developers. RERA and therefore the government's model
code, aim to make a more equitable and fair transaction between the vendor and
therefore the buyer of properties, especially within the primary market. RERA, it's

5. Delay Analysis:
DELAY ANALYSIS Numerous factors cause the causes of delays in construction
projects which range from issues within the technology and its management to
those emanating from the social, physical, and financial environment. These delays
are grouped into the subsequent categories
• Causes of delay by owner
• Causes of delay by the contractor
• Causes of delay by Consultant
• Causes of delay by equipment Planning, Scheduling and Delay Analysis of a
Building.
• Causes of delay by labors
• Causes of delay by external factors
The reaction of RERA on Delay:
RERA will determine the compensation that the builder has got to buy the delay
within the delivery of property to the customer. If a construction developer fails in
delivering possession of the property as per the date that's mentioned within the
contract or sale and buy agreement, then the customer of the property has two
options: to terminate the contract and seek compensation from the builder or
continue the project for construction and claim reimbursement for the delay.
When the customer decides to withdraw from the project, a builder goes to be
liable for returning the whole amount that's paid by the customer for the property
plus the interest. If the customer decides on continuing the project, the interest is
often claimed for every month of the delay until the property is handed to the
property buyer.
If the property developer isn't compensating the customer voluntarily, the
customer has the proper in filing a complaint with the important Estate regulatory
agency. The RERA will appoint a politician which will perform a judge's functions.
The officer appointed by the authority will perform an inquiry then pass an order if
the expert has decided whether the customer is going to be getting curious about
regards to the cash that was spent.

land is free from all obstructions.
Maintaining Book of Records:
7. As per RERA, 70 percent of the quantity realized for the important estate project
from the customer shall be deposited in separate accounts in scheduled banks to
hide the value of construction and therefore the cost of land and it shall be used
just for that purpose.
Offence:
If the promoter/builder doesn't adhere to the principles, he not only loses the
registration of the project but he's also responsible for punishment for a term up
to three years or 10 percent of the estimated cost of the important estate project
fine might be imposed.

the property as per the 'agreement of sale', the Buyer would have the proper to

homebuyer suffer anymore by running around and be at the mercy of the builders?
