P/S : I am sharing my personal notes of law-related subjects. Some parts of them are explained in a very informal-relaxed way and mix of languages (BM and English). 1. Alienation/ Pemberianmilik
A. Kuasa pelupusan melalui alienation : S. 42 (1)(a) selaras dengan s. 76
B. S76 Alienation of state land
1. (a) : not exceeding 99 years.
2. (aa): Alienation of state lands in perpetuity … are only possible :
i. where Federal Government requires the state authority to alienate the
land in perpetuity either to Federal Government or public authority.
ii. where the SA is satisfied that the land is to be used for public purpose or
iii. where SA is satisfied that there are special circumstances which render it
appropriate to do so.
C. Alienation either for a terms of years or in perpetuity subject to the
following terms : s. 76
(b) grantee must pay premium (once only unless exempted), survey fee and
other fees in connection with preparation and registration of documents of title,
the first year’s rent and annual rent subsequently every year without fail
(c) the land will be subjected to specific category of land use determined by state
pursuant to s52 and to such conditions and restrictions in interest as the state
may impose.
D. Permohonan pemberian milik adalah mengikut peraturan negeri masing2
1. 78 (3) : kalau permohonan lulus the applicant will be informed about the
approval tru letter tai tanah itu masih milik SA selagi mana premium x bayar.
2. Once SA dan approve , s.79 dah senaraikan details yang SA kena tetapkan
semasa bagi kebenaran tu:
i. Number of year the land will be alienated
ii. The area of approved alienation
iii. Rate of annual rent

1. Where an approved applicant received a notification of 5A from authorities
which contains certain sums of land revenue must be paid within a stipulated
time,
2. applicant must make that payment in good time in default of which approval of
state authority to alienation shall thereupon lapse.
3. Kalau lapse, kena buat fresh application
I. Alienation is subjected to express conditions dan sekatan kepentingan
yang akan ditentukan semasa permohonan di terima
1. S. 120 : Pengenaan syarat2 nyata dan sekatan kepentingan apabila
pemberianmilikan berlaku
2. Kalau breach, forfeit : s. 127 (1)
3. Sekatan kepentingan adalah had kepada kepada pemilik untuk apply
subdivision /amalgamation dan partition
4. Express condition: yang tertera dalam dokumen hak milik
7. Teh Bee v K Maruthamuthu
Position in s81 becomes unclear.

a. Mahni v Ali & Anor
Sapiah had applied for state land- her application was approved, she paid the premium, first year’s
rent and survey fee and later she sold the land to Mahni. Vendor’s stepfather, Ali who had been
staying on the land refused to vacate after sale. Ali brought tenant to land and collected ground
rent.
Recovery of vacant possession of land is allowed. Land held under an approved application is
state land and that the approved applicant has no right to registration of title. All that the
approved applicant has is rights of by way of expectation of title to land. These rights are capable
of assignment provided that (relevant rules) are complied with. Until assignment was registered
by A, became licensee of Sapiah and consequently became entitled to occupation and possession of
land and so entitled to sue for recovery of possession.
4. b. Tan Ah Boon v The State of Johor
A failed to pay rent for next 2 years. Then authorities commenced attachment proceedings to
recover arrears for rent. Failed to yield cash and they put land for sale.
This is simply a common law action seeking damages for breach of an alleged contract and
nothing else. No P can maintain such action unless he can aver and prove that he has performed or
has at all time been ready to perform his part of contract which A owing to his serious default in
payment of rent, incapable of doing.
