1. State’s Power of Disposal &
Rights in Reversion (Hak Perkembalian)
I. Who is state authority / PBN?
A. Seksyen 5
1. Raja atau gabenor negeri
B. Lebbey Sdn Bhd v Chong Wooi Leong
1. State gov, minister, exco member, politician is not a state authority in the NLC
II. S. 41 (B) : rights in reversionof state authority
A. Maksudnya tanah itu dikembalikan kepda PBN
B. Keadaan2 yang akan membawa kepada pengembalian tanah
1. 76 (a) : Tamat tempoh penggunaan tanah yang dibenarkan dia dalam dokumen
hak milik.
2. Selepas notis rampasan di hebahkan oleh pentadbir tanah
3. Pemilik tanah mati tanpa ada waris dan abandonment of title by registered
proprietor
4. 46 (1) (d): perkembalian,: surrender of land
5. S. 46 (2) : Reservation was revoked
6. Tanah atau sungai telah encroach any alienated land
i. Re Sithambaran Chettiar
Kalau that encroachment berlaku sebelum satu tanah tu dilupuskan, pemilik
tanah x leh claim extra territory kesan daripada encroachment tu.
C. Kesan pengembalian : s. 47
1. semua benda dekat atas tanah yang tidak boleh bergerak akan menjadi hak
milik PBN

2. III. 5 disposal power under S. 42 (1) (a-e)
A. Alienation 76;
B. Reservation (Perizaban)
C. Granting a temporary occupation licences
D. Permiting the extraction and removal of rock material from any land, other than
reserved forest,
E. permit the use of air space on or above land
IV. Restrictionofdisposal power : s 42 (2)
A. x leh dispose mining land
B. Cannot permit the extraction or removal of rock material for the purpose of
obtaining metal or mineral
C. X leh dispose any land for the urpose of removing any forest produce
D. X leh aleniate any land held under the category of agriculture to any person if
the land is less that 2. 5 hectare
V. To whom SA can dispose the land ?
A. S. 43
2. Natural person other than minors (so person below 18 years old cannot hold a
land under his name)
3. Company which permitted by their memorandum of association to hold land
4. Sovereigns
5. Governments organization
B. s. 433B : non-citizens and foregn companies
1. boleh dapat land dengan cara disposal kalau dorg kebenaran daripada state
authority
2. 433 (B) : PBN boleh kenakan terma dan syarat serta levy dalam memberi
kebenaran kepada mereka
3. Kebenaran ini x diperlukan kalau tanah itu melibatkan tanah perindustria
