Utah passed the Transfer of Public Lands Act in 2012 demanding that the federal government transfer over 20 million acres of federally owned public lands in Utah to the state by 2014. The state argues that the federal government made promises at Utah's statehood that it would dispose of most of these lands in a timely manner. This white paper provides an overview of the legal arguments on both sides of this issue, discussing the interpretation of Utah's Enabling Act and whether it constitutes a binding agreement between Utah and the federal government. It also notes that other western states are exploring similar strategies to assert ownership and management of public lands currently under federal control.
