Danny advertised his van for sale for RM20,000 in the Star newspaper. Elaine saw the
advertisement and went to Dannys house with a cheque for RM20,000. Danny refused to accept
the cheque and Elaine stated that she would sue Danny for breach of contract. The next day Fiza
inspected the van and later wrote to Danny enclosing a cheque for RM20,000 and saying she
should assume the van was hers unless she heard to the contrary. Gary also inspected the van
and wanted two days to decide. He asked Danny whether he could keep the offer open to him for
the next day. Danny agreed in exchange for RM200. One day later Harry arrived with RM18,000
in cash, Danny accepted the money and allowed Harry to drive the van away.
Explain to Danny the conditions which must be fulfilled for there to be acceptance. Explain to
him also whether Elaine, Fiza and Gary could sue him under Law of Contract. Make references
