2. SAMCODES
CP FRAMEWORK
Suitably qualified and experienced persons who are subject to an
enforceable Professional Code of Ethics (statutory/ professional
registration).

• Recognised Professional Organisations (local/international)
 Technical Competence /Experience
• Minimum five years relevant experience in the deposit type or mineralisation style; and
in the category of reporting;
• Expectation of continuity of experience
• Expectation of Continuous Professional Development.
Persons being called upon to sign as a Competent Person must be clearly satisfied in their
own minds that they are able to face their peers and demonstrate competence in the
commodity, type of deposit and situation under consideration.

CP FRAMEWORK
Professional
 Membership of GSSA/SAIMM obliges member to uphold all
the principles and tenets of the SAMCODES
• Geologists/Mining Engineers who compile documents must do
so with due recognition of the Codes
o Must comply with principles/terminology/ethics
• Include Accountants, Auditors, Corporate Finance professionals,
SACVPV
Regulatory
 JSE requires SAMCODE compliance for all Minerals
Companies
• FSB to institute compliance for all (South African) Stock
Exchanges with a Minerals/Metals board
Governmental
 CGS requires compliance with principles and terminology.
 DMR to require compliance with principles and
terminology

Readers Panel
 All documents submitted to the JSE get reviewed for
compliance with JSE Listing Rules and also SAMREC/SAMVAL
• Solid Minerals Panel, O&G Panel
• Practicing, registered CP/CV’s with +20yrs relevant experience
• Author remains responsible for their report in perpetuity
Complaints Procedure
 Any natural person may put in a complaint if they feel that any
public document is fraudulent or non-compliant with
SAMCODE principles
• Cannot complain that the project was bad or didn’t turn out as
expected; only if the reporting was fraudulent or non-compliant
• Not a substitution for due diligence
 Affiliated professional and statutory bodies have an
enforceable Professional Code of Ethics
• Disciplinary actions may range from simple re-issuing of document,
through fines and obligatory training, to suspension of membership
