4. Objective - Improvement or Refinement of Old Skills
through Theoretical & Practical Training, i.e.,
Apprenticeship Training, in number of Trades &
Occupation.
It is a Course of Training in any Industry or
establishment undergone in pursuance of a Contract
of Apprenticeship & under prescribed Terms &
Conditions which may be different for different
categories of Apprentices.
Duration of training – 6 months to 4 years, depending
on the Trade.
Apprentice has to work 42 to 48 Hours in a week.
5. Objective – It provides compensation for injury
by accident during the course of Employment.
Payment of Compensation Amount –
Permanent Total Disablement (PTD) of a
Workman – Minimum compensation is
Rs.1,40,000 or an amount equal to 60% of
monthly wages of injured workman’s multiplied
by relevant factor, whichever is higher.
Death of a Workman – Minimum Compensation is
Rs.1,20,000 or an amount equal to 50% of
monthly wages of workman’s multiplied by
relevant factor, whichever is higher.
6. Example – In case of Death of a Workman
Suppose, Monthly Wages = Rs.7,700, Age = 35
years, Relevant Factor = 197.06 (as per Schedule
IV),
Then, Compensation Amount = Rs. (50% of
Rs.7,700 * 197.06) = Rs.7,58,681.
As it is higher than Minimum Compensation of
Rs.1,20,000, so, Compensation Amount is
Rs.7,58,681.
7. Objective – It acts as a remedy against
unauthorized deductions made by the Employer
or unjustified delay in payment of wages.
Applicability – should have a minimum average
wage of Rs.10,000 per month.
Deduction – Maximum 50% of monthly wages.
Wages can be paid on Daily, Weekly, Fortnightly
or Monthly basis.
8. Objective – To ensure the safeguard of the
interest of workers and protect them from
exploitation.
Welfare –
a. Adequate facilities for washing, sitting, storing
of clothes [Sec - 42].
b. If a worker has to work in standing position,
sitting arrangement to take short rests, [Sec -
44].
c. Adequate First Aid boxes, [Sec - 45].
9. Facilities –
a. Adequate Lighting, Drinking Water, Latrines, Urinals
& Spittoons should be provided, [Sections 17 to 19].
b. Proper ventilation for air & light inside the factory
building.
c. Reasonable temperature for comfort of employees
should be maintained, [Section 13].
d. Dust & Fumes should be controlled below
permissible limits, [Section 14].
Working Hours –
a. Maximum working hours is 48 Hours in a week,
[Sec - 51].
b. Maximum daily working hours is 9 Hours, [Sec -
54].
c. One weekly holiday is compulsory, [Sec - 52(1)].
d. Atleast half an hour rest should be provided after 5
hours of work, [Sec - 55].
10. Safety measures –
a. All machineries should be properly fenced to
protect workers when machinery is in motion,
[Sec- 21 to 27].
b. Hoists and Lifts should be in good condition &
tested periodically, [Sec- 28 & 29].
c. Floor, Stairs & means of access should be of
sound construction & free form obstructions,
[Sec - 32].
d. Adequate fire fighting equipments, [Section 38].
e. Safety appliances for eyes, dangerous dusts,
gas, fumes, [Sec - 35 & 36].
