Tariff on raw materials and environmental protection tax

1.5 Regulatory Framework
Tariff duty on raw materials
• Dependency on raw material imports exposed Vietnamese flexible packaging manufacturers risk associated with import duty regulation. From Jun
2017, LDPE resins enjoyed preferential tariff duty rate of 0%. On the other hand, the most recent imposed tariff on PP resins was raised from 1% to
3%, according to Decree No. 122/2002 / ND-CP and effective from Jan 2017. Ministry of Finance (MOF) justified the decision in Feb 2017 based on
confidence in local manufacturers, especially Nghi Son Refinery’s upcoming production. Lawmakers felt that import duty was required to protect local
industry. However, Nghi Son refinery’s production was delayed until Nov 2018 and unable to supply for plastic market.
• As a result, domestic raw materials were inadequate, causing plastic enterprises to pay premium taxes when importing raw materials. The raise in PP
tariff caused a stir among local plastic and flexible packaging manufacturers. The Vietnam Plastic Association (VPA) did preliminary calculation and
determined that new tax rate would result in US$82mn incurred cost domestic enterprises to pay for export businesses within FTA in 2017.
Environmental protection tax on nylon bags
• Latest regulation by Ministry of Finance, effective from Jan 2019, the environmental protection tax rate for plastic bag would be 50,000VND /kg,
increased from the current rate of 10,000VND /kg. The environmental protection tax rate for plastic bags was designed to limit the production and
use of plastic bags, thus lessen environmental pollution.
• Taxable nylon bags were bags made from single plastic films such as HDPE or LDPE, excluding pre-packaged goods and environmental friendly plastic
bags that meet green criteria certified by authorized organizations.
