3. This Act was passed in 3rd September , 1919 in India .
To control the possession for sale and the sale whether
wholesale or retails , of any specified poison .
Need of poison act ?
The act extends to the whole of India except the state of
Jammu and Kashmir where only certain provisions
related to the importation of specified poisons into are
applicable.

4. Regulate and control the import , possession and sale of poisons.
Central government regulates imports
State government regulates possession , possession for sale and
sale poisons.

5.  The import of poisons is permitted only by person to
have been granted liecence for the purpose by the
central Government .
 Such persons may import poison across one of the
defined custom frontiers and in accordance with the
condition of the liecence

7. The poisons the record maintained for their sale are
subject to inspection , by persons authorised in this
behalf by the state governments.
The state government are also empowered to regulate
the possession of any specified poison in any local area
.

8. List A:- Aconite , Arsenic , Coca , Digitalis ,lead
etc
List B:- Essential oils of almonds Chloroform ,
Carbolic acid , All oxides of mercury , Sulphonal
Zinc Chloride etc .

9. The District Magistrate , Sub –divisonal
Magistrates and the Commissioner of police
have been empowered to issue warrants for the
search of any place , where they have reasons
to believe or suspect that a contraband poison is
sold , kept or concealed.

10. OFFENCE AND PENALTIES
Import or sale any poisons exce the act, shall
be liable to punish imprisonment.
Break any condition of a license any poison
granted to him shall
(i)On a first conviction with imp which may
extend to 3 months o may extend to 500 rupees
or wi
(ii)On the second conviction, wi term which
may extend to 6 mo which may extend to 1000
rupees.
