2. Introduction & Object
• Old Acts related to Narcotic Substances: Opium Act 1857,
Opium Act 1878, Dangerous Drugs Act, 1930.
• The Central Govt. replaces these Act & Passed “The Narcotic
Drugs & Psychotropic Substances Act, 1985”
• In this Act provision related to:
- Prohibit, Control & regulate the operations
- Licensing system to State & Central Govt. related to regulate:
- Manufacture,
- Cultivation,
- Import,
- Export inter-state traffic,
- Transportation,
- Sale & possession
3. Definitions
• Addict:
A person habitual to regular use of any
narcotic drug or psychotropic substance is
known as Addict.
• Cannabis (Hemp) : It includes the
following:
- Charas, which is a resin in crude or purified
form obtained from the canabbis plant
which includes concentrated preparations &
a resin known as hashish oil or liquid
hashish.
- Ganja, which comprises of flowering or
fruiting tops of the cannabis plant
- Any mixture with or without any neutral
material of ganja or charas or any drink
prepared from them.
4. • Opium:
It means the coagulated juice of the
opium poppy & its mixture with or
without neutral material, (excluding
the preparations containing less
than 0.2% per cent of morphine)
• Opium Poppy:
It includes the plant of papaver
somniferum L & other species of
papaver from which opium or any
phenathrene alkaloid can be
extracted.
• Psychotropic Substances:
It means any substance natural or
synthetic or any salt or preparation
of such substance or material, which
is included in the list of psychotropic
substances specified in the schedule.
5. • Illicit Traffic: It includes:
- Cultivating any coca plant
- Cultivating the opium poppy
- Engaging in the production,
manufacture, sale, purchase,
transportation, import, export, use of
consumption, inter state import or
export.
- Dealing in Narcotic drugs or
Psychotropic substances.
- Provide finance…

6. Authorities & Officers
MEASURE FOR PREVENTING & COMBATING ABUSE OF
NARCOTIC-DRUGS & ILLICIT TRAFFICS THEREIN
- Co-ordinations of actions by various officers, state
Govt & other authorities under the act or under any
other law for the time being in force relating to the
enforcement of the provision of this Act.
- Obligations under the international conventions
- Assistance to the concerned authorities in foreign
countries & concerned international organisations
regarding prevention & suppression of illicit traffic
in narcotic drugs & psychotropic substances.
- Identification, treatment, education, aftercare,
rehabilitation & social re-interaction of addict.
7. OFFICERS OF CENTRAL GOVERNMENT
- Central Govt. appoints Narcotic
Commissioner & such other officers
performs functions relating to:
- The supervision of the cultivation of the
opium poppy &
- Production of opium &
- Other functions as may be entrusted to him
by the central govt.
8. THE NARCTOIC DRUGS & PSYCHOTRIPIC SUBSTANCE
CONSULTATIVE COMMITTEE
- Central Government may constitute an advisory
committee for efficient administration of this Act.
- The committee shall advise to the Central Govt.
on the matters relating to the administration of
this Act.
- The committee consists of a Chairman & such
other members not exceeding 20 appointed by
the Central Govt.
- The committee may constitute & appoint one or
9. PROHIBITION CONTROL & REGULATION
Prohibition of certain operations as per Sec.8 No person
shall:
- Cultivate any coca plant or gather any portion of
coca plant,
- Cultivate the opium poppy or any cannabis plant,
- Produce, manufacture, possess, sell, purchase,
transport, warehouse, consume, import or export
any NDPS except for medical & scientific
purpose with Govt. approval.
- The central govt. control & fix the following
things:
- Time frame for cultivation,
- Prices to be paid to cultivator,
- Issue permit for manufacture
10. - Govt. shall fix time to time limits of licence may be
given for cultivation.
- To the cultivators, provides all the products relating to
cultivation by authorised officers.
- The rules may prescribed the forms & conditions of
licence for Mfg, Sale, Import or export inter state etc.
The rules may also prescribe the authorities granted &
fees that may be charged therefore.
- Also, The rules may prescribed the forms & conditions
of licence for cultivation of opium poppy.
- The rules may prescribed that opium shall be
weighed, examined & classified according to as
quality & consistence by the officers in the presence
of the cultivator at the time of delivery by the
cultivator.
