2. OBJECTIVE
The main object off passing this act was to regulate and control
the import , possession and sale of poisons.
POSSESSION, POSSESSION FOR SALE AND SALE OF
ANY POISON
The state government may regulate the possession for sale and the
sale whether wholesale or retail of any specified poison.
a) The grant of licenses for the possession for sale, wholesale or
retail of any specified poison and fixing of fees to be charged for
licenses.
b) The classes of person to whom the licenses for the possession
for sale and sale of poisons are to be granted.
3. c) The maximum quantity of any poison that may sold to a person.
d) maintenance of the registers for the sale of poisons and
inspection of the same .
e) Safe custody of poisons and the labelling of the vessels,
covering or packages in which such poison is sold or stored for
sale.
f) Inspection and examination of any such poison possessed for
sale by any vendor .
4. POSSESSION OF ANY POISON:
The state government has power make rules regarding the
possession of any specified poison in local area where such
poison can be used for poisoning cattle and in such local area
where such occurrences are very frequent.
Any break of this rule is punishable with imprisonment up to one
year, or with fine up to Re.1000/- or with both, together with
confiscation of the poison in respect of which the breach has been
committed.
5. IMPORT OF POISONS
Import of specified poison is allowed only under and in
accordance with the condition of a licence, Central government
may regulate the grant of such licenses.
Penalty for unlawful importation, possession for sale and sale of
any poison:*
a) Unlawful possession for sale and sale of poison.
b) Importation without of a licence of any poison the importation
of which is for the time being restricted by central government.
c) Beach of any condition of a licence for the importation of
any poison granted to him are punishable.
i). With imprisonment up to 3 mouths or with fine up to Rs.500/-
or with both, on a first conviction, and
6. ii). With imprisonment up to six months or with fine up to
Rs.1000/- or with both, on a second or subsequent conviction.
The poison in connection with the offence, together with the
vessels, packages or converting is liable for a confiscation.
The substances deemed to be poisonous are categorised in this act
as -
ListA: Aconite,Aconine , Arsenic, Atropine, Belladonna,
Cantharides, chloral Hydrate, Coca, Corrosive Sublimate,
potassium cyanide, Diamorphine (Heroin) Diethyl Barbituric
Acid,Digitalis, Ecagonine , Ergot or Rye , Lead, Nux Vomica ,
Stramonillan, Stropanthus, stropanthin Tarter Emetic, Tetraethyl
Lead.
7. List B: Essential oil of Almonds(unless deprived of Prussic acid)
Antimonial wines all salts of barium, except Barium sulphate,
Tincture of Contharides , Carbolic acid , Chloroform, Mercuric
Sulphocyanide, Oxalic acid ,Poppies , All oxides of Mercury,
Sulphonal , zinc chloride.
Exemption from certain provision of the act is made for the
poisonous substances of list B.
