Lease
THIS LEASE, made the 3rd day of April, 2015, between Windy Hills Trading, Inc., of Tulsa,
county of Tulsa, state of Oklahoma, hereinafter called the Lessor and Mary Giles of Cordell,
county of Washita, state of Oklahoma, hereinafter called the Lessee.
WITNESSETH AS FOLLOWS:
In consideration of the rent and the Lessee’s covenants hereinafter reserved and contained, the
Lessor hereby demises to the Lessee the following described property:
All that certain piece, parcel, or lot of land, with the improvements thereon commonly
referred to as 10 Downing Street, in the city of Cordell, county of Washita, state of
Oklahoma, more particularly described as Lot 15, Block P, as shown on plat prepared by
J. M. Crawford & Sons, R.E., recorded I Plat Book IX at page 210, in the Office of the
Registrar of Mesne Conveyances, county of Washita, state of Oklahoma.
To hold to the Lessee for the term of one (1) year commencing on the 3rd day of May,
2015, at the monthly rent of $850, payable in advance on the 3rd day of each month, the first
payment to be made on the 3rd day of May, 2015.
The Lessee hereby covenants with the Lessor as follows:
1. To pay the rent reserved on the days and in the manner aforesaid
2. To pay all the telephone, electric power, water charged, and other taxes and assessments
imposed or charged upon the premises upon the owner or occupier in respect thereof,
excepting taxes and assessments for permanent benefit or improvement to the premises.
3. To keep the demised premises in such repair as the same are at the commencement of the
term or may be put in by Lessor during the continuance thereof, reasonable use and wear
and damage by fire or other unavoidable casualties only excepted.
4. Not to make or permit to be made any alterations or additions to the demised premises
without the previous consent in writing of Lessor.
5. To permit Lessor and his agents at all reasonable times upon five (5) days’ written notice
to enter upon the demised premises and to examine the condition thereof and make
necessary repairs.
6. To yield up the demised premises and all additions thereto (excepts Lessee’s fixtures) at
the termination of the tenancy in good and tenantable repair, reasonable use and wear
excepted, as the same now are or may be put in by the Lessor.
2. Kaylie Cassity
The Lessorhereby covenants with the Lessee as follows:
1. That Lessee, observing and performing the above covenants, shall peaceably hold and
enjoy the demised premises during said term without any interruption by Lessor or
anyone rightfully claiming under Lessor.
2. Provided further that in case the buildings on said premises or any part there of shall be
damaged by fire or other unavoidable casualty, to that the same shall thereby be rendered
unfit for use and occupation, then and in such case, the rent hereby reserved or a just and
proportional part thereof according to the nature and extent of the injury sustained, shall
be abated until the premises shall have been duly repaired and restored by Lessor, or in
case the premises shall be substantially destroyed, then at the election of the Lessee the
estate hereby created may thereupon be determined.
3. This lease is made upon the express condition that if the Lessee fails to keep and perform
an of the covenants and agreements contained in this lease, then this lease shall become
void at the option of the Lessor, provided, the Lessor shall first give to Lessee at least
thirty (30) days’ written notice of intention to re-enter the premises and declare the lease
forfeited, if such breach to be continued. Such notice shall be deemed duly served, if left
at the demised premises addressed to Lessee, and after the expiration of thirty (30) days’
notice this lease shall be void, Lessor shall then be entitled to the possession of the
demised premises.
