dia’s merchandise and
services exports will
cross USD 2 trillion by
2030 from the current
level of USD 765 bil-
lion, as he unveiled a
“dynamic and respon-
sive” foreign trade pol-
icy. He said that goods
exports have witnessed
good growth consider-
ing the current global
scenario while services
exports may see a quan-
tum jump in the cur-
rent fiscal.
“It shouldn’t be that
by 2030, services ex-
ports cross USD 1 tril-
lion while you (mer-
chandise exports) lag
behind. I am confident
that we will cross USD 2
trillion by 2030,” Goyal
said. The WTO’s global
trade has forecast
growth in world trade to
slow down to 1 per cent
in 2023 due to global un-
certainties.

Ahmedabad: Eight workers of the AAP have been
arrested for allegedly putting up posters saying “Modi
Hatao Desh Bachao” in different parts of Ahmedabad
city, police said on Friday. The arrests come just a day
after the AAP launched a nationwide poster campaign

were released on bail later in the day.

Six of a family suffocate to

many as six people died
due to suffocation while
two others were injured
after a fire broke out in

Gas cylinders will be
cheaper from today,
electricity bills are now
going to give relief to
both farmers and com-
mon consumers. Along
with this, many
schemes of the govern-
ment will also be imple-
mented today

Khadi and Village In-
dustries Board has
sent a proposal to the
state government for
providing free khadi
uniforms in govern-
ment primary schools.
Besides, the board
has demanded that
medical staff in gov-
ernment hospitals and
doctors should wear
aprons and gowns made
of Khadi.
Bedsheets, pillow
covers, curtains, fancy
gowns, soap, handwash,
and phenyl should also
be procured from Kha-
di Industries.
The board has made
a special demand that a
day should be fixed
when officers and em-
ployees in the govern-
ment offices should
wear Khadi dress. This
would encourage peo-
ple to wear Khadi and
the financial condition
of Khadi industries
will also improve.

there was a hail-
storm in more than
half-a-dozen villages.
Farmers said that a
lot of their crops got
destroyed.
Transport dept records
`1,300 crore increase
in revenue collection

partment has worked

The reve-
nue collec-
tion of the transport
department has crossed
Rs 6,000 crore. This fi-
nancial year, there has
been an increase of Rs
1300 crore in the reve-
nue collection.
In the last financial
year, the department re-
ceived a revenue of Rs
4758 crore. Record sales
of vehicles in this fi-
nancial year helped the
department garner
more revenue in the
form of one-time tax.
Transport Commis-

ings of RTOs and DTOs
for performance.

11 lakh farmers will start getting free electricity for
2000 units per month which means up to 66 units
daily. This benefit will be available on agricultural con-
nections. Similarly, common electricity consumers
will get free electricity up to 100 units per month.
Families with Ujjwala Yo-
jana will get gas cylinders
for Rs 500. Only Rs 500
will have to be paid every
month for re-filling, the rest
of the money will be paid
by the state government.
As per order of the govern-
ment, the entry fee for tour-
ists visiting Ranthambore
National Park has been
increased. The new rates
will be applicable from the
morning shift on April 1.
Jaipur: An official of the
weather department said
another fresh Western
Disturbance is expected
to become active on April
3, which may once again
cause thunderstorms,
strong winds and light
rain in parts of Bikaner
division and Shekha-
wati region. A western
disturbance persists as
a cyclonic circulation
over Afghanistan and the
neighbourhood. Another
cyclonic circulation over
Southwest Rajasthan
and the neighbourhood
extends up to 1.5 km
above mean sea level. The
western disturbance will
likely affect Northwest
India from April 2.
There will be a 15 percent
increase in the allowances
and honorarium of Urban
Bodies and Panchayati Raj
employees across the state
from April 1. They will now
get an increased allowance.
Social security pension will
be at least Rs 1000 from
today in the state. Social se-
curity pension will automati-
cally increase by 15 percent.
On retirement, employees
working part-time in govt
offices will get a retirement
package of Rs 2 to 3 lakh.
Home guards, contract em-
ployees, over 2 lakh part-time
employees will get the benefit.
Women will have to pay
only half fare on roadways
buses. This discount will
be available on roadways
buses (local and express
buses), This facility is not
applicable in Volvo-Scania.
The incentive package will
be increased from Rs 5
lakh to Rs 10 lakh for inter-
caste marriage with a Dalit.
After marrying a Divyang,
an incentive package of Rs
5 lakh will be available.
One-time tax on diesel
vehicles will be reduced
by 2%. Till now, a 2%
one-time tax was levied on
diesel four-wheelers during
registration. Now, there will
be an equal one-time tax.
LIGHT RAINFALL IN PARTS OF RAJASTHAN
Jaipur: Light to moderate rainfall, triggered by western
disturbance, was recorded in some parts of Rajasthan during
the last 24 hours. As per meteorological (MeT) department,
the highest rainfall till Friday morning since yesterday was
recorded at 40 mm in Kotputli and Jaipur and 23.3 mm in
Ganganagar. By Friday evening, Ajmer, Jaipur, Sikar, Churu
and Ganganagar recorded 16.2, 5.2, 8, 3.7 and 3.6 mm
of rainfall. The day temperature also remained below 35.1
degrees Celsius (Vanasthali- Tonk). The effect of the western
disturbance is likely to end from April 1 and the weather is
likely to remain mainly dry on April 1-2.
TREATMENT UP TO `25 LAKHS
6.50 L ORPHAN KIDS WILL GET `1500
Under the Chiranjeevi Yojana, up to Rs 25 lakhs will
be given for treatment. Till now, treatment up to Rs
10 lakh could be done. Accident insurance for the
families involved in the Chiranjeevi scheme will also
be increased from Rs 5 lakh to Rs 10 lakh.
6.50 lakh orphan kids included in the Palanhar Yojana
will get increased money. The money received every
month for children up to 6 years will be increased
from Rs 500 to Rs 750. Kids of 7 years to 18 years
will get from Rs 1000 to Rs 1500 every month.

employment seminar
for retired, retiring De-
fence personnel on 31
March 2023 at Maan Pal-
ace, Gandhi Path W,
Vaishali Nagar Jaipur.
The event was organ-
ised to provide multiple
opportunities, as a sec-
ond career option, to
skilled and experienced
defence veterans.
Around 1171 veterans
and 24 corporate houses
participated in the Em-
ployment Seminar with
total of 1050 job vacan-
cies. The event was
beneficial for both, cor-
porate and veterans.

ditional Advocate Gen-
eral Rajendra Yadav for
failure to effectively
represent the 2008
Jaipur serial blast case
in the Rajasthan High
Court. The government
will file a Special Leave
Petition (SLP) in the Su-
preme Court against the
acquitted accused in the
case. This decision was
taken in a high-level
meeting chaired by CM
Ashok Gehlot at CMR
on Friday
.
Gehlot said that the
HC has acquitted all the
accused, overturning
the 2019 district court
verdict. “It is the inten-
tion of the State Gov-
ernment that the cul-
prits should be given
the harshest punish-
ment, therefore the
State Government will
soon file a SLP in the
Supreme Court against
the decision of the High
Court,” he said.

On the strike of private hospitals and doctors against the
RTH, CM Ashok Gehlot on Friday again appealed to the
protestors to end their strike. “I would request them to end the
strike as their method is wrong. Resentment is growing among
people. If the doctors are facing any problem, we will fix it. The
rules of the bills are yet to be framed their suggestions will be
incorporated.” “Our thinking is open but going on strike like
this... where will the poor patient go? Your approach is not
good,” he said. According to the Bill, every resident of the state
will have the right to emergency treatment and care “without
prepayment” at any “public health institution, health care
establishment and designated health care centres”.

pulled up the lawyers.
“They are the same
lawyers, who returned to
the courts only a week

the judicial boycott. The
lawyers should not advo-
cate against any strike,
as they themselves go
on strike in the name
of boycotting judicial
work,” the bench said.
Later, the High Court
issued notices to the
State Government, Indian
Medical Association, Ra-
jasthan Medical Council,
and Doctors’ Association
and sought their response
by April 11 on the matter.

and earlier years the “segrega-

week before his indictment

charges. The Joe Biden ad-
ministration cannot take the
warning lightly after a deadly
attack by Trump supporters
on Capitol Hill. Trump called
the unprecedented verdict
“political persecution”.
Although he could never
prove his charge of electoral
fraud, Trump continues to
insist that he won the 2020
election and the election was
rigged. It is this refusal to ac-
cept defeat that provoked
Trump to incite his support-
ers, mainly the White su-
premacists, to storm the seat
of power in a first act of its
kind in American history.
The attack happened when
the election of Joe Biden was
about to be formalised. In-
vestigators claimed that the
attack was part of a plan to
overturn the election. Five
people died in the violence
and over 100 were injured.
The loss caused to the Capi-
tol was estimated at more
than $ 2.7 million.
Reacting to the judgment
Trump said, “The Democrats
have lied, cheated and stolen
in their obsession with get-
ting Trump out.” As he
claimed innocence, the ver-
dict could not only divide
America with the right-wing
white supremacists on the
side of Trump but also influ-
ence the next presidential
election in which the former
president, a Republican, was
emerging as a front-runner.

voted to indict former Presi-
dent Donald Trump. The spe-
cific state charges, reports
The New York Times, “re-
main a mystery” but will be
related to the Manhattan dis-
trict attorney’s investigation
of Trump for making hush
money payments to a porn
star just before the 2016 pres-
idential election. It’s the first
time a U.S. president or for-
mer president has been in-
dicted.
At the same time, Trump is
expected to continue his cam-
paign for the presidency
, seek-
ing to regain in 2024 the posi-
tion he lost in 2020 to Joe
Biden. What are the conse-
quences of an indictment and
potential trial for his cam-
paign and, if his effort is suc-
cessful,hisfuturepresidency?
Article II of the U.S. Con-
stitution sets forth very ex-
plicit qualifications for the
presidency: The president
must be 35 years of age, a U.S.
resident for 14 years and a
natural-born citizen.
In cases involving analo-
gous qualifications for mem-
bers of Congress, the Su-
preme Court has held that
such qualifications form a
“constitutional ceiling” –
prohibiting any additional
qualifications to be imposed
by any means.
Thus, because the Consti-
tution does not require that
the president be free from in-
dictment, conviction or pris-
on, it follows that a person
under indictment or in pris-
on may run for the office and
may even serve as president.
This is the prevailing legal
standard that would apply to
former President Trump. The
fact of his indictment and po-
tential trial is irrelevant to
his qualifications for office
under the Constitution.
Nevertheless, there seems
no question that indictment,
conviction or both – let alone
a prison sentence – would sig-
nificantly compromise a
president’s ability to func-
tion in office. And the Consti-
tution doesn’t provide an
easy answer to the problem
posed by sucha compromised
chief executive.
GOVERNING FROM JAIL?
A presidential candidate
could be indicted, prosecuted
and convicted by either state
or federal authorities. Indict-
ment for a state crime may
seem less significant than
federal charges brought by
the Department of Justice.
Ultimately, though, the
spectacle of a criminal trial
in state or federal court
would have a dramatic effect
on a presidential campaign
and on the credibility of a
president, if elected.
All defendants are pre-
sumed innocent until proved
guilty
. But in the case of con-
viction, incarceration in
state or federal prison in-
volves restrictions on liberty
that would significantly com-
promise the president’s abil-
ity to lead.
This point – that function-
ing as president would be dif-
ficult while under indictment
or after being convicted – was
made plain in a 2000 memo
written by the Department of
Justice. The memo reflected
on a 1973 Office of Legal
Counsel memo produced dur-
ing Watergate titled “Amena-
bility of the President, Vice
President and other Civil Of-
ficers to Federal Criminal
Prosecution while in Office.”
The background to the 1973
memo was that President
Richard Nixon was under in-
vestigation for his role in the
Watergate break-in and Vice
President Spiro Agnew was
under grand jury investiga-
tion for tax evasion.
FUNCTIONS AFFECTED
According to the 1973 memo,
“the President plays an un-
paralleled role in the execu-
tion of the laws, the conduct
of foreign relations, and the
defense of the Nation.”
Because these core func-
tions require meetings, com-
munications or consulta-
tions with the military, for-
eign leaders and government
officials in the U.S. and
abroad in ways that cannot
be performed while impris-
oned, constitutional law
scholar Alexander Bickel re-
marked in 1973 that “obvi-
ously the presidency cannot
be conducted from jail.”
RUNNING FROM PRISON
Yet what to do if citizens actu-
ally elect an indicted or incar-
cerated president? This is not
out of the question. At least
one incarcerated presidential
candidate, Eugene Debs, gar-
nered almost a million votes
out of a total 26.2 million cast
in the election of 1920. One
potential response is the 25th
Amendment, which enables
the president’s Cabinet to de-
clare the president “unable to
discharge the powers and du-
ties of his office.”

Bhubaneswar: In a tragic incident, seven members of a
marriage party were killed after their vehicle fell into a canal
in Sambalpur district late on
Thursday night, the police said on
Friday. The deceased, all residents
of Badadhara village in Jharsugu-
da district, have been identified
as Ajit Khamari, Subal Bhoi,
Sumant Bhoi, Saroj Seth, Dibya Loha, Ramakant Bhunya and
Satrughan Bhoi. The driver of the vehicle is reportedly on the
run ever since the tragic accident.
Bulandshahr : Four people were killed on Friday in an ex-
plosion in a chemical factory in Bulandshahr district in Uttar
Pradesh. The incident took place in a house, where the fac-
tory was running, on Dhikoli road in the Nagar Kotwali area.
The house where the explosion took place has collapsed,
more persons are suspected to be buried under the debris.
Cylinder pieces have also been recovered from the spot. The
explosion was so strong that its sound was heard for two
kilometres. Senior officials have reached the spot and rescue
work has begun.

2 HYBRID TERRORISTS HELD IN SHOPIAN

district on Friday, police said.
An SIT was set up to probe

Reyaz and Anayat Ullah Iqbal,
both residents of Saidapo-
ra Payeen, admitted their

brid terrorists of proscribed
terror outfit TRF,” police said.

, a PIL was
filed at the Calcutta
High Court seeking CBI
probe into the matter.
The clashes which
were mainly at Sandhy-
abazar area of Shibpur
on Thursday, spread to
adjacent Kazipara area
this morning. A group
of people started pelt-
ing stones towards the
high-rises in the area. A
couple of vehicles were
vandalised and torched.
Even the vehicle of
the state minister Arup
Roy, which was passing
through the area then,
was not spared. The
window-screen of the
vehicle was totally
smashed. However, the
minister was not pre-
sent in the vehicle.
Finally
, a huge contin-
gent of police force, ac-
companied by the per-
sonnel of the Rapid Ac-
tion Force (RAF),
reached the spot. They
resorted to massive
lathicharge to bring the
unruly mob under con-
trol. Some of the police-
men also suffered inju-
ries in the clashes. Till
the filing of the report,
the total number of ar-
rests in this connection
was 36. Though the situ-
ation has been brought
under control, tension
prevailsinthesepockets.

New Delhi (PTI) : The
NIA has seized more
than Rs 7.80 lakh in cash
and a vehicle as “pro-
ceeds of terrorism” in a
case related to the re-
covery of arms and ex-
plosives, smuggled from
Pakistan by the pro-
scribed Babbar Khalsa
International, in Hary-
ana last year, an official
said on Friday
.
The cash and the In-
nova vehicle were
seized on Thursday un-
der the Unlawful Activi-
ties (Prevention) Act, a
spokesperson of the
federal agency said.
On May 5 last year,
police had intercepted
the vehicle at Bastara
Toll Plaza in Haryana
and recovered three im-
provised explosive de-
vices (IEDs), one pistol
with two magazines, 31
rounds of ammunition,
and Rs 1.30 lakh in cash
which had been con-
cealed in a specially de-
signed cavity

heavy vehicles
New Delhi (PTI): The
government has extend-
ed the date of mandato-
ry fitness testing
througharegisteredAu-
tomated Testing Station
(ATS) for heavy goods
and passenger motor ve-
hicles by 18 months to
October 1, 2024.
Earlier, the Road
Transport and High-
waysMinistry(MoRTH)
had said that fitness
testing for heavy goods
vehicles and heavy pas-
senger motor vehicles
through an ATS will be
mandatory from April
1, 2023.
However, in the case
of medium goods vehi-
cles, medium passen-
ger motor vehicles and
light motor vehicles
(transport), the
MoRTH had said the
requirement will be
made compulsory from
June 1, 2024.
COVID-19: India records 3,095 new cases
New Delhi (PTI): India
witnessed a single-day
rise of 3,095 fresh COV-
ID-19 cases with the ac-
tive caseload increasing
to 15,208, according to
Union Health ministry
data updated on Friday
.
The toll has risen to
5,30,867 with five
deaths – one each re-
ported by Goa and Gu-
jarat and three recon-
ciled by Kerala – in a
span of 24 hours, the
data updated at 8 am
said. The daily positiv-
ity was recorded at 2.61
per cent while the
weekly positivity was
pegged at 1.91 per cent.
The total tally of Cov-
id cases was recorded at
4.47 crore (4,47,15,786).
The active cases now
comprise 0.03 per cent
of the total infections
while the national re-
covery rate has been
recorded at 98.78 per
cent, according to the
ministry website.
The number of peo-
ple who have recuper-
ated from the disease is
at4.41crore(4,41,69,711)
while the case fatality
was recorded at 1.19
per cent.
According to the min-
istry website, 220.65
crore Covid vaccine
doses have been admin-
istered under the na-
tionwide drive so far.

examinations in the
state and to take action

mafia, officials said. Ac-
cording to an official
release, the anti-cheat-
ing task force will be
formed in the Special
Operations Group
(SOG) of Raj Police.
This decision will
help in conducting an

HCM-RIPA, DG Pan-
chayati Raj Sansthan,
Registrar Cooperative
and Divisional Commis-
sioner Kota. Apart from
thi, two posts are vacant
on IAS members in Rev-
enue Board. Notably,
some of these posts are
vacant from six months
to a year! This means
that the transfer list of
IAS is overdue.
Inreality

fer lists of IPS, IFS and
RAS were released dur-
ing the Assembly ses-
sion but the IAS transfer
list is still awaited.
There is no denying
thefactthatcomparedto

the DoP. Add to that the
drought of IAs officers
at senior level and as a
result the permutation
and combination to ‘fit’

that a Secretary of a ma-
jor and important de-
partmentcanbechanged
owing to poor perfor-
mance while another of-
ficial can be changed for
their‘overperformance’!
Such is the disgruntle-
ment against the poorly
performing Secretary
that the official has been
completely sidelined.
While the over perform-
ing Secretary has court-
ed controversy
.
About half a dozen
senior IAS do not have
workload according to
their capacity
. Word is
thattheseofficialscanbe
brought in main stream,
because there is not
enough time left to bring
CM Ashok Gehlot’s flag-
ship schemes to ground.
In such a situation, the
IAS with less workload
can be given work of
those officials who are
currently holding addi-
tional charge. Notably

the IAS who have less
workload as of now, are
all senior officials.

MD Karan Singh have
suo-moto requested for
their transfer, whereas
2005batchIAsPunam,is
currently on APO hav-

According to sources,
the situation regarding
Collectors is not clear
as of now, as to will they
be shuffled right now or
with posting of Collec-
tors in new districts. As
such Tonk Collector
Chinmayee Gopal and
Barmer Collector Lok
Bandhu have stayed on
the position for two
years and 18 Collectors
have spent more than a
year on their current
assignment and thus, a
change is necesary due
to various reasons.
Therefore, the en-
tire IAS lobby is ea-
gerly awaiting the
transfer list.

State BJP State Prez CP Joshi said that the Jaipur
serial bomb blasts accused were let off because of
weak lobbying by the state government. “The entire case
puts the govt under suspicion for gross negligence. The
acquittals show the insensitivity of the govt in this whole
matter. 71 innocent lives were lost in the bomb blasts
while hundreds of people were left. The govt should pun-
ish the accused by strong lobbying in the Supreme Court
and justice should be done to the victims,” he said. “CM
Gehlot also holds the home portfolio, yet the common
man of Rajasthan is yearning for justice. If the state govt
does not show seriousness even in punishing the ac-
cused of Jaipur blasts, what will happen to rest of cases?”
DELEGATION ALSO STUDIED AMBITIOUS
PLANS OF THE RAJASTHAN HOUSING BOARD
It is noteworthy that a delegation of 25 international rep-
resentatives from 19 countries have come to Rajasthan
under the Training Program for Overseas Profession-
als on Formal Solutions to Informal Settlements being
organized by the Ministry of External Affairs and Human
Management Settlement Institute (HSMI) New Delhi
under the ITEC course scheme. On Wednesday, the
delegation had also studied the ambitious plans of the
Board after reaching Housing Board’s headquarters.
Rajasthan Housing Board Commissioner Pawan Arora
thanked the delegation from 19 countries and also
invited them to visit Jaipur again.
The four men who were acquitted by the Rajasthan
High Court earlier this week in the 2008 Jaipur serial
blasts case are yet to be set free as a related case is
pending against them in a trial court, officials said. The
pending case pertains to the recovery of an unexploded
bomb after the serial blasts in Jaipur which had claimed
71 lives, 185 injured. Their lawyer SS Ali said a bail appli-
cation of the four will be moved in trial court on Monday.

Jaipur: An official of the weather department said another fresh Western Disturbance is expected to become active on April 3, which may once again cause thunderstorms, strong winds and light rain in parts of Bikaner division and Shekha- wati region. A western disturbance persists as a cyclonic circulation over Afghanistan and the neighbourhood. Another cyclonic circulation over Southwest Rajasthan and the neighbourhood extends up to 1.5 km above mean sea level. The western disturbance will likely affect Northwest India from April 2. There will be a 15 percent increase in the allowances and honorarium of Urban Bodies and Panchayati Raj employees across the state from April 1. They will now get an increased allowance. Social security pension will be at least Rs 1000 from today in the state. Social se- curity pension will automati- cally increase by 15 percent. On retirement, employees working part-time in govt offices will get a retirement package of Rs 2 to 3 lakh. Home guards, contract em- ployees, over 2 lakh part-time employees will get the benefit. Women will have to pay only half fare on roadways buses. This discount will be available on roadways buses (local and express buses), This facility is not applicable in Volvo-Scania. The incentive package will be increased from Rs 5 lakh to Rs 10 lakh for inter- caste marriage with a Dalit. After marrying a Divyang, an incentive package of Rs 5 lakh will be available. One-time tax on diesel vehicles will be reduced by 2%. Till now, a 2% one-time tax was levied on diesel four-wheelers during registration. Now, there will be an equal one-time tax. LIGHT RAINFALL IN PARTS OF RAJASTHAN Jaipur: Light to moderate rainfall, triggered by western disturbance, was recorded in some parts of Rajasthan during the last 24 hours. As per meteorological (MeT) department, the highest rainfall till Friday morning since yesterday was recorded at 40 mm in Kotputli and Jaipur and 23.3 mm in Ganganagar. By Friday evening, Ajmer, Jaipur, Sikar, Churu and Ganganagar recorded 16.2, 5.2, 8, 3.7 and 3.6 mm of rainfall. The day temperature also remained below 35.1 degrees Celsius (Vanasthali- Tonk). Jaipur: While hearing the public interest litigation filed against the strike by private doctors in the state, a division bench of Acting Chief Justice MM Srivastava and Justice Anil Upman in the Rajasthan High Court pulled up the lawyers. “They are the same lawyers, who returned to the courts only a week ago after one month of the judicial boycott. The lawyers should not advo- cate against any strike, as they themselves go on strike in the name of boycotting judicial work,” the bench said. Article II of the U.S. Con- stitution sets forth very ex- plicit qualifications for the presidency: The president must be 35 years of age, a U.S. resident for 14 years and a natural-born citizen. In cases involving analo- gous qualifications for mem- bers of Congress, the Su- preme Court has held that such qualifications form a “constitutional ceiling” – prohibiting any additional qualifications to be imposed by any means. Thus, because the Consti- tution does not require that the president be free from in- dictment, conviction or pris- on, it follows that a person under indictment or in pris- on may run for the office and may even serve as president. This is the prevailing legal standard that would apply to former President Trump. The fact of his indictment and po- tential trial is irrelevant to his qualifications for office under the Constitution. Nevertheless, there seems no question that indictment, conviction or both – let alone a prison sentence – would sig- nificantly compromise a president’s ability to func- tion in office. And the Consti- tution doesn’t provide an easy answer to the problem posed by sucha compromised chief executive. GOVERNING FROM JAIL? A presidential candidate could be indicted, prosecuted and convicted by either state or federal authorities. Indict- ment for a state crime may seem less significant than federal charges brought by the Department of Justice. Ultimately, though, the spectacle of a criminal trial in state or federal court would have a dramatic effect on a presidential campaign and on the credibility of a president, if elected. All defendants are pre- sumed innocent until proved guilty . But in the case of con- viction, incarceration in state or federal prison in- volves restrictions on liberty that would significantly com- promise the president’s abil- ity to lead. This point – that function- ing as president would be dif- ficult while under indictment or after being convicted – was made plain in a 2000 memo written by the Department of Justice. The memo reflected on a 1973 Office of Legal Counsel memo produced dur- ing Watergate titled “Amena- bility of the President, Vice President and other Civil Of- ficers to Federal Criminal Prosecution while in Office.” The background to the 1973 memo was that President Richard Nixon was under in- vestigation for his role in the Watergate break-in and Vice President Spiro Agnew was under grand jury investiga- tion for tax evasion. FUNCTIONS AFFECTED According to the 1973 memo, “the President plays an un- paralleled role in the execu- tion of the laws, the conduct of foreign relations, and the defense of the Nation.” Because these core func- tions require meetings, com- munications or consulta- tions with the military, for- eign leaders and government officials in the U.S. and abroad in ways that cannot be performed while impris- oned, constitutional law scholar Alexander Bickel re- marked in 1973 that “obvi- ously the presidency cannot be conducted from jail.” RUNNING FROM PRISON Yet what to do if citizens actu- ally elect an indicted or incar- cerated president? This is not out of the question. At least one incarcerated presidential candidate, Eugene Debs, gar- nered almost a million votes out of a total 26.2 million cast in the election of 1920. The Punjab govt has informed the Akal Takht, the supreme temporal body of Sikhs, that almost all the peo- ple taken into preven- tive custody – 348 out of 360–havebeenreleased. The clashes which were mainly at Sandhy- abazar area of Shibpur on Thursday, spread to adjacent Kazipara area this morning. A group of people started pelt- ing stones towards the high-rises in the area. A couple of vehicles were vandalised and torched. Even the vehicle of the state minister Arup Roy, which was passing through the area then, was not spared. The window-screen of the vehicle was totally smashed. The pending case pertains to the recovery of an unexploded bomb after the serial blasts in Jaipur which had claimed 71 lives, 185 injured. Their lawyer SS Ali said a bail appli- cation of the four will be moved in trial court on Monday.
