This month, the Office of Disadvantage Business Enterprise would like to
introduce Mrs. Beverly Thomas, President of Regional Contracting Services
(RCS). RCS was founded in July 2001 and became a Metropolitan Washington
Unified Certification Program (MWUCP) certified DBE in 2003. RCS employs
52 full-time employees (FTE’s), each with an 8-year average tenure with
the company. Her initial contract with Clark Construction was working as
a subcontractor at Morgan Station from Oct. 2004 through July 2005. RCS
has been given the opportunity to perform as a DBE on several contracts and
is currently working with Clark on the rehabilitation of the Orange and Blue
lines. Her company’s success is attributed to not only becoming a certified
business enterprise, but also with networking with prime contractors,
becoming known to the contracting community, and only accepting work
that RCS can self-perform. Beginning with the ability to perform on the
small projects and developing the company’s ability to perform on the
bigger contracts is key to her DBE success. Many of her foremen are well
known in the contracting community and are often requested to perform on
a particular contract. In addition to The Clark Construction Group, RCS has
subcontracted with Hensel Phelps, Kiewit Construction, Gilbane, Forrester
Construction, and Turner/Mass Electric as Prime Contractors. Mrs. Thomas
thanks WMATA and the Office of Disadvantage Business Enterprises for
the many opportunities afforded to RCS and asks for WMATA’s continued
creativity in ensuring maximum DBE participation.
2. WMATA is rolling out its “Small Business Enterprise (SBE)
Program” as mandated by 49 CFR 26.39. SBE will be a
component of the Disadvantaged Business Enterprise (DBE)
Program, not a replacement. The Program will be used to
increase opportunities for small businesses, including DBEs,
to participate as prime contractors on selected federally
funded contracts. Any contract, with a total value less than
$500,000, will be reviewed for a potential set-aside for
certified SBEs. In order to qualify as an SBE, a firm must
meet the following:
• Small business concern as defined by U.S. Small Business
Administration (13 CFR Part 121)
• Average gross receipts, including any affiliates, over the
last three years must be less than $22.41 million
• At least 51% ownership must be held by, one or more
U.S. citizen(s) or permanent resident(s), with a net worth less
than $1.32 million (equity in the personal residence and the
applicant firm are excluded)
All DBE certified firms automatically qualify for the Small
Business Enterprise (SBE) Program; however, your firm’s
participation in the SBE Program is optional. If you are NOT
interested in participating as an SBE, please send an e-mail
to bvtoulson@wmata.com. A response is required on or
before April 15, 2014. No response is necessary if you wish
to participate. Your firm will be designated as “SBE” in our
SBE Directory. Further details regarding the SBE Program
may be found on WMATA’s Web site, under Business with
METRO, at wmata.com. There will be an “Ask Ms. Betty”
column in upcoming newsletters that will be used to share
information and to respond to general questions regarding
all WMATA small business programs. E-mail your questions/

Meet this month’s
Compliance Specialist
Ernest Hunter began his career with WMATA in May 2013. He
is a long-tenured civil servant and previously worked for the D.C.
Water and Sewer Authority; and more recently with the District’s
Child and Family Services. In both agencies, Mr. Hunter served as
a Contracts Compliance Specialist and Officer respectively, and
has acquired a host of experience relative to compliance work.
Mr. Hunter’s five-year objective is to benchmark DBE programs
throughout the nation and to mirror their success, as well as
pioneer new approaches to the DBE program with the aim of
establishing WMATA as the premier DBE program.
DBE Payment Reporting
If your firm is currently working on a federally-funded project
here at WMATA as a DBE, you are REQUIRED to submit a
monthly report showing timely payments and amounts from
whoever contracted your services. Federal Law – CFR Part
26.29 Prompt Payment mandates that the prime contractor
must pay each subcontractor no later than ten (10) working
days from the receipt of each payment the prime contractor
receives from WMATA. This provision applies to all Prime/
Sub and Sub/Sub contracts. For more information, contact

OUTREACH EVENT
As a certified DBE firm with WMATA, you are invited to network with
