       surprise that real estate in Gurgaon has seen tremendous growth – both in terms of
       quality of housing as well as capital values. If fact, Gurgaon real estate is perhaps the

       Gurgaon have given spectacular returns in the past two years (2010 – 2012).

NRI / PIO Investors - Acquisition

       We shall try to address a few key questions often faced by NRIs (Non Resident Indians)
       & PIOs (Persons of Indian Origin) looking to take part in the Indian real estate story.

       Important Points
       • Permitted to purchase any number of residential and commercial properties in India. Not
         permitted however to purchase plantation/agricultural/farm house properties
       • Permitted to sell/gift their residential / commercial properties to an NRI/PIO or a person
         resident in India
       • Can fund the purchase from (a) remittances to India or (b) funds held in NRE / FCNR(B) / NRO
         account held in India
       • Can avail housing loans in India for purchase of a residential property
       • Repayment of a housing loan can be
              –   By way of inward remittance through normal banking channels
              –   By debit to the NRE/FCNR(B)/NRO account of the NRI/PIO
              –   Out of rental proceeds from such property
              –   By the borrower’s close relatives through their account in India

NRI / PIO Investors - Maintenance

       Acquisition of a property in India is only the first step; maintenance of such property
       also throws up some questions that are useful to be aware of.

       • NRIs/PIOs can rent out their property in India; there is no explicit permission
         required from the reserve bank
       • Rental receipts can be credited to the NRO account or even remitted abroad subject
         to a limit of USD 1 Million per financial year
       • NRIs/PIOs can continue to hold a property (including plantation/agricultural/farm
         house properties) even if the property was acquired as a resident Indian. The
         receipts from such property can also be remitted abroad from an NRO account
         subject to limit of USD 1 Million per financial year

NRI / PIO Investors - Repatriation

       It is important to be aware of the provisions for repatriation of funds from sale of the
       property even before an NRI/PIO may acquire such property in India
       A) In case of a property acquired out of FOREIGN FUNDS i.e. inward remittances, repatriation of
          such proceeds may be permitted provided:
               (i) the immovable property was acquired in accordance with provisions of the law in force;
               (ii) the amount to be repatriated does not exceed:
                    - amount in foreign exchange paid for acquisition received through banking channels, or
                    - amount paid out of funds held in Foreign Currency Non-Resident Account, or
                    - foreign currency equivalent of the amount paid where such payment was made from the funds
                      held in Non-Resident External account for acquisition of the property; and
               (iii) in the case of residential property, repatriation is restricted to not more than two such properties.
       B) In case of a property acquired out of RUPEE FUNDS and/or loan is repaid by close relatives in
          India, the amount, including any capital gains, can be credit to NRO account.
              (i) repatriation of such funds up to USD 1 Million per financial year is permitted.
              (ii) documentary evidence supporting the acquisition & tax clearance / NOC from the Income Tax Dept

            There is no lock in period for sale of immovable property or repatriation of sale proceeds
