Product Review Actions
The Food and Drug Administration (FDA) continues to review tobacco
product marketing applications and issue decisions on those
submissions. In November, FDA issued 24 Substantially Equivalent (SE)
orders, 6 Not Substantially Equivalent (NSE) orders, and companies
withdrew 17 SE reports from the review process. More information on
these actions, and a summary of all the actions FDA has taken, can be

Reynolds American, Lorillard Set
Date for Merger Vote
Reynolds American Inc. and Lorillard Inc. have set Jan. 28 as the date
for asking their respective shareholders to approve Reynolds’ $27.4
billion offer for Lorillard. The manufacturers announced their deal July 15,
essentially for Reynolds to gain top U.S. menthol brand Newport. In a
joint regulatory filing Friday, Reynolds said it has scheduled its meeting
for 9 am at its headquarters in downtown Winston-Salem. Lorillard set its
meeting for 10 am at the Ballantyne Hotel in Charlotte. Reynolds
spokesman David Howard said he would not speculate on whether
setting the shareholder meetings signals an acceleration toward a
decision by the Federal Trade Commission. "It is not unusual to have a
shareholder meeting at this time in the process," Howard said. Winston-

Cigs
E-cigarette taxes are the new topic in many state capitals, including New
Jersey. Lawmakers everywhere are predicting huge amounts to be
raised by taxing e-cigs, but there's no solid basis for any of the
predictions. Not even the tobacco companies know how many people
are actually using the devices. And no one can accurately predict how
many people will take up nicotine usage for the first time or will switch
from traditional cigarettes to "vaping," as use of the e-cigarettes is called.
Although a dozen states have e-cigarette taxation legislation pending, so
far only Minnesota and Ohio have begun collecting money. In New
Jersey, Gov. Christie has suggested $35 million a year could be raised
by taxing e-cigarettes. NJ.com

When it comes to the use of tobacco products by U.S. Armed Services
personnel, the 2015 National Defense Authorization Act (NDAA) which
Congress passed as part of the $1.1 trillion omnibus government funding
bill is a mixed bag. On one side, it eliminates the discount for tobacco
and tobacco-related products sold at military exchanges. On the other
side, the bill prohibits "any new policy that would ban the sale of any legal
consumer tobacco product category … within the defense retail systems
or on any Department of Defense vessel at sea."American Academy of

Two Studies Find Big Jump in Teen
Use of E-Cigarettes
Two new studies have found that far more kids are using electronic
cigarettes than previously reported. About 25% of high school students in
Connecticut and 29% of teens in Hawaii have used e-cigarettes,
according to separate studies. About 18% of the Hawaii teens and 12%
of the Connecticut high school students had used e-cigarettes in the past
month. Both studies were done in 2013. Those rates are much higher
than the latest data from the Centers for Disease Control and Prevention,
which found 4.5% of high schoolers and 1.1% of middle schoolers had
used e-cigarettes in the past 30 days in 2013. USA Today

Tobacco-Selling Stores by Half
Hundreds of businesses currently hold city permits to sell tobacco in San
Francisco's poorest neighborhoods, but only a handful are in more
affluent areas. Faced with this disparity, a group of San Francisco youths
with the nonprofit Youth Leadership Institute has worked since 2008 to
impose density controls on tobacco permits. Recently the Board of
Supervisors gave unanimous approval for the Tobacco Sales Reduction
Act. The law imposes a cap of 45 tobacco-selling permits issued for each
of the 11 supervisor districts in The City. For some, that would be a
dramatic decrease. The legislation, introduced by Supervisor Eric Mar,
doesn't eliminate existing permits, but through attrition, it is estimated that
it would take 10 to 15 years to halve the existing nearly 1,000 tobacco
