(As per Article 309 of Indian constitution)
 Rule- 1 - Short Title
These Rules may be called the “Uttar Pradesh
Government Servants Conduct Rules-1956”
 Rule-2 Definitions
Government means- Government of UP
Government Servant means- A person appointed
to public services and posts in connexion with
the affairs of the state of UP.

Wife/Husband/son/step son/unmarried
daughter/unmarried step daughter
But Not Include
 Wife or husband legally separated
 son/stepson/unmarried
daughter/unmarried step daughter –
Not dependent on Govt Servant

Most Important Rule
1- Every Government Servant shall at all
times maintain absolute integrity and
devotion to duty.
2- Every government servant shall at all
times conduct himself in accordance with the
specific or implied orders of Government
regulating behaviour and conduct which
may be inforce.

3-A Prohibition of sexual harassment of working
women-
(1) No Government Servant Shall indulge in any
act of sexual harassment of any women at work
place.
(2) Every Government Servant who is incharge
of a work place shall take appropriate steps to
prevent sexual harassment to any women at
such work place.

Sexual Harassment includes-
 Physical Contact and advances:
 Demand or request for sexual favours:
 Sexually coloured remarks:
 Showing any Pornography:
 Any other unwelcome physical verbal or not
verbal conduct of sexual nature:

 In case a complaint of sexual exploitation or sexual
harassment against a Government servant –
formation of Complaints Committee (atleast one
female member will be essential)
 Report/findings of such Complaints Committee
shall be deemed to be an inquiry report and the
appointing authority may impose minor penalty
upon the delinquent Government servant on the
basis of such report and there shall be no need to
institute a separate inquiry.

Equal Treatment for All- Cast/Sect/Religion.
 No Govt. Servant shall practice Untouchability in
any form

Consumption of intoxicating drinks and drugs-
 A- strictly abide by any law relating to intoxicating
drinks or drugs.
 At the duty- No Drink/drug (his/her performance not
affected in any way by the influence of such drink)
 Refrain to take drink/drug in public place.
 Not appear in a public place in a state of intoxication
 Not use any intoxicating drink or drug too excess.

Taking Part in politics and elections
 Shall not be a member of –any Political parties
 - any organization which takes part in
politics.
Not assist any movement or organization
 To prevent any member of his family from taking
part in politics- if not, inform the Govt.
 No canvassing/Not use his/her influence.

Demonstrations and strike-(5A)
 - Do not participate in any demonstration which is
against the interest of the sovereignty and integrity
of India, the security of state, friendly relations of the
foreign states/ which involves contempt of court
 Any form of strike- for service matter of his own or
to others.
Joining of Association – (5B)-
 Not be a member of Association which is against the
interest of the sovereignty and integrity of India

Connection with Press or Radio-(without prior
permission of the Govt.)
 Not participated in the editing/managing of any
newspaper or other periodical publication.
 Not participate in any Radio broadcast or writing
any article/letter either anonymously or in his own
name or in the name of any other person to any
newspaper or periodical.
 No such sanction required for Literary/Scientific
article.

Criticism of Government-
 Not in Radio/Newspaper/Tv etc
 - Criticism of any decision taken by superior officer/
any current or recent policy.
 But he can deliver any statement/views by his
official capacity in the due performance of the duties
assigned to him.

Evidence before committee or any other Authority-
 Do not give evidence in connection with any enquiry
conducted by any person/committee/Authority.
 Not give evidence that shall criticise the policy of the
central/state Government
 But- Can give evidence
 Before an „inquiry officer‟ appointed by
State/centre/Assembly/ Parliament.
 Judicial enquiry

Unauthorised Communication of information-
 No Govt Servant published/communicate any
official documents/note sheet/information directly
or indirectly to any person who is not directly
related with such documents/information.
 If so - he/she will also held responsible with
violation of Official Secrets Act 1923

 Subscriptions:-
 Not accept or ask for any contribution
 Not associate himself/herself in such activities.
 Not raising any funds or other collections in cash or
in kind.

Gifts-
 Not accept directly/indirectly own or by name of his
family members - any gift/gratuity or reward from
any person other than a close relation.
 Exception- May accept a gift costing not more than
1/10th of his basic pay on special occasion/marriage
etc.
Rule- 11(A)
 Don‟t give/take “Dowry”
 For violation of above – Dowry Prohibition Act 1961
 Section 161 and 165 of I.P.C.

Public Demonstration in honor of Government
Servants:-
 Not Receive any complimentary or valedictory
address or accept any testimonial or attend any
meeting or public entertainment held in his honor, or
in the honor of any other Govt. Servant.
 Exception:- Can attend farewell party on the
occasion of the retirement/ transfer etc.

Private Trade or Employment:-
 Not directly or indirectly engage any trade/business
or undertake any employment except- honorary
work/charitable nature work of literary/artistic or
scientific character – condition- duties not suffer/
inform HOD within one month.
 If family of Govt. servant undertakes a private trade
or private employment The information of such
trade shall be given to the Govt.( Amendment in
1998)
 Don‟t engage a child below the age of 14 years in any
hazardous work/forced labour (Amendment 2002)
Rule-15

Registration Promotion and management of
companies-
 Shall not take part in Registration Promotion or
management of any bank or other company
registered under the companies act 1956.
 But take part in Registration Promotion or
management of Cooperative society under UP
Cooperative society Act 1965/charitable society
under Society registration Act 1860 but not in
financial transaction/ collection of funds etc.

Insurance Business-
Shall not permit his wife or any other relative
who is either wholly dependent on him or is
residing with him to act as an insurance agent
in the same district in which he is posted.

Guardianship of Minors-
 May not act as a legal guardian of the person or
property of a minor other than his dependent.
Definition of Dependent – wife/children/step
children/Grand son/daughter/
sisters/brothers/brothers children and sisters children
if residing with him and wholly dependent on him.

Action in respect of a relation-
 If sought opinion- Govt. servant while
recommending any action must disclose his nature
of relationship.
 If sought decision- do not take decision but to
forward the case to the next higher officer disclosing
his nature of relationship.

Rule- 20 Speculation
 No government servant shall speculates in any
investments
Rule-21 Investment
 Shall not make or permit any member of his family
to make any investment likely to embarrass or
influence him in the discharge of his official duties.

Lending and Borrowing-
 Shall not receive or lend money to any person at
interest or in kind
 But can give advance of pay to a private servant.
 May accept a purely temporary loan of small amount
free of interest from a friend or relative or operate a
credit account with a bonafide tradesman(Not more
than Two months basic pay) (Amendment in 1998)


Insolvency and habitual indebtedness-
 Shall manage his private affairs as to avoid habitual
indebtedness or insolvency.
 If he/she is facing legal proceedings for the
insolvency – inform to the head of the office.

Movable/immovable and valuable property-
 Shall not acquire or dispose of any immovable
property exceeding in value, the amount of his basic
pay of one month, by lease, mortgage, purchase, sale,
gift or otherwise either in his own name or in the
name of any member of his family.
 Shall give declaration of his all immovable property
at the time of joining thereafter at interval of five
years.

Vindication of acts and character of government
servants-
 Shall not recourse to the press for the Vindication of
any official acts which has been the subject matter of
adverse criticism or an attack of defamatory
character.
( shall not prohibit a government servant from
vindicating his private character or any act done
by him in private capacity)

Rule-25

Canvassing of Non-official or other outside influence
 Shall not attempt to bring any political or other
outside influence to bear upon any question relating
to his interest in respect of matters pertaining to his
service.
 Any act done by the wife or husband or any member
of the family shall be presumed to have been done at
the instance or with the connivance of the Govt.
servant unless the contrary shall have been proved.
 Representation shall always through proper channel.

Unauthorised pecuniary arrangements-
Shall not enter into any pecuniary (financial)
arrangements with another government servant or any
other person so as to afford any kind or advantage to
either or both of them in any unauthorised manner or
against the specific or implied provisions of any rule for
the time being in force.

Bigamous marriages-
 No govt. Servant who has wife living shall contract
another marriage without permission of the
Government.
 No female Govt. servant shall marry any person who
has a wife living without permission of the
government.

Rule-30 Proper use of amenities-
 Shall not misuse amenities provided for him to
facilitate the discharge of his public duties.
Rule- 31 Payment for purchases
 Not withhold prompt and full payment for the
article purchased (except incase of instalments)

Rule- 32 Use of services without payment-
Rule- 33 Use of conveyances belonging to others-
Rule- 34 Purchase through Subordinates-
Shall not ask or permit his wife or any member of his
family living with him to ask any Govt. servant who is
subordinate to him to make purchase locally or from
out station.

 Rule- 35 Interpretation: - If any question arises
relating to the interpretation of these rules- shall be
referred to the government whose decision thereon
shall be final.
 Rule- 36 Repeal and saving – Any rules
corresponding to these rules in force immediately
before the commencement of these rules and
applicable to government servant under the Govt. of
Uttar Pradesh are hereby repealed.

(As per Article 309 of Indian constitution)  Rule- 1 - Short Title These Rules may be called the “Uttar Pradesh Government Servants Conduct Rules-1956”  Rule-2 Definitions Government means- Government of UP Government Servant means- A person appointed to public services and posts in connexion with the affairs of the state of UP.   • 3.  Member of the family- Wife/Husband/son/step son/unmarried daughter/unmarried step daughter But Not Include  Wife or husband legally separated  son/stepson/unmarried daughter/unmarried step daughter – Not dependent on Govt Servant 3
  • 4. Most Important Rule 1- Every Government Servant shall at all times maintain absolute integrity and devotion to duty. 2- Every government servant shall at all times conduct himself in accordance with the specific or implied orders of Government regulating behaviour and conduct which may be inforce. Rule-3 4
  • 5. 3-A Prohibition of sexual harassment of working women- (1) No Government Servant Shall indulge in any act of sexual harassment of any women at work place. (2) Every Government Servant who is incharge of a work place shall take appropriate steps to prevent sexual harassment to any women at such work place. Rule-3 A(1998 Ammendment) 5
  • 6. Sexual Harassment includes-  Physical Contact and advances:  Demand or request for sexual favours:  Sexually coloured remarks:  Showing any Pornography:  Any other unwelcome physical verbal or not verbal conduct of sexual nature: 6
  • 7.  In case a complaint of sexual exploitation or sexual harassment against a Government servant – formation of Complaints Committee (atleast one female member will be essential)  Report/findings of such Complaints Committee shall be deemed to be an inquiry report and the appointing authority may impose minor penalty upon the delinquent Government servant on the basis of such report and there shall be no need to institute a separate inquiry. Rule-3(B) Amend.2014 7
  • 8. Equal Treatment for All- Cast/Sect/Religion.  No Govt. Servant shall practice Untouchability in any form Rule-4 8
  • 9. Consumption of intoxicating drinks and drugs-  A- strictly abide by any law relating to intoxicating drinks or drugs.  At the duty- No Drink/drug (his/her performance not affected in any way by the influence of such drink)  Refrain to take drink/drug in public place.  Not appear in a public place in a state of intoxication  Not use any intoxicating drink or drug too excess. Rule-4A 9
  • 10. Taking Part in politics and elections  Shall not be a member of –any Political parties  - any organization which takes part in politics. Not assist any movement or organization  To prevent any member of his family from taking part in politics- if not, inform the Govt.  No canvassing/Not use his/her influence. Rule-5 10
  • 11. Demonstrations and strike-(5A)  - Do not participate in any demonstration which is against the interest of the sovereignty and integrity of India, the security of state, friendly relations of the foreign states/ which involves contempt of court  Any form of strike- for service matter of his own or to others. Joining of Association – (5B)-  Not be a member of Association which is against the interest of the sovereignty and integrity of India Rule- 5A/5B 11
  • 12. Connection with Press or Radio-(without prior permission of the Govt.)  Not participated in the editing/managing of any newspaper or other periodical publication.  Not participate in any Radio broadcast or writing any article/letter either anonymously or in his own name or in the name of any other person to any newspaper or periodical.  No such sanction required for Literary/Scientific article. Rule-6 12
  • 13. Criticism of Government-  Not in Radio/Newspaper/Tv etc  - Criticism of any decision taken by superior officer/ any current or recent policy.  But he can deliver any statement/views by his official capacity in the due performance of the duties assigned to him. Rule-7 13
  • 14. Evidence before committee or any other Authority-  Do not give evidence in connection with any enquiry conducted by any person/committee/Authority.  Not give evidence that shall criticise the policy of the central/state Government  But- Can give evidence  Before an „inquiry officer‟ appointed by State/centre/Assembly/ Parliament.  Judicial enquiry Rule-8 14
  • 15. Unauthorised Communication of information-  No Govt Servant published/communicate any official documents/note sheet/information directly or indirectly to any person who is not directly related with such documents/information.  If so - he/she will also held responsible with violation of Official Secrets Act 1923 Rule-9 15
  • 16.  Subscriptions:-  Not accept or ask for any contribution  Not associate himself/herself in such activities.  Not raising any funds or other collections in cash or in kind. Rule-10 16
  • 17. Gifts-  Not accept directly/indirectly own or by name of his family members - any gift/gratuity or reward from any person other than a close relation.  Exception- May accept a gift costing not more than 1/10th of his basic pay on special occasion/marriage etc. Rule- 11(A)  Don‟t give/take “Dowry”  For violation of above – Dowry Prohibition Act 1961  Section 161 and 165 of I.P.C. Rule-11 17
  • 18. Public Demonstration in honor of Government Servants:-  Not Receive any complimentary or valedictory address or accept any testimonial or attend any meeting or public entertainment held in his honor, or in the honor of any other Govt. Servant.  Exception:- Can attend farewell party on the occasion of the retirement/ transfer etc. Rule- 14 18
  • 19. Private Trade or Employment:-  Not directly or indirectly engage any trade/business or undertake any employment except- honorary work/charitable nature work of literary/artistic or scientific character – condition- duties not suffer/ inform HOD within one month.  If family of Govt. servant undertakes a private trade or private employment The information of such trade shall be given to the Govt.( Amendment in 1998)  Don‟t engage a child below the age of 14 years in any hazardous work/forced labour (Amendment 2002) Rule-15 19
  • 20.  Registration Promotion and management of companies-  Shall not take part in Registration Promotion or management of any bank or other company registered under the companies act 1956.  But take part in Registration Promotion or management of Cooperative society under UP Cooperative society Act 1965/charitable society under Society registration Act 1860 but not in financial transaction/ collection of funds etc. Rule-16 20
  • 21.  Insurance Business- Shall not permit his wife or any other relative who is either wholly dependent on him or is residing with him to act as an insurance agent in the same district in which he is posted. Rule-17 21
  • 22.  Guardianship of Minors-  May not act as a legal guardian of the person or property of a minor other than his dependent. Definition of Dependent – wife/children/step children/Grand son/daughter/ sisters/brothers/brothers children and sisters children if residing with him and wholly dependent on him. Rule-18 22
  • 23.  Action in respect of a relation-  If sought opinion- Govt. servant while recommending any action must disclose his nature of relationship.  If sought decision- do not take decision but to forward the case to the next higher officer disclosing his nature of relationship. 23 Rule-19
  • 24.  Rule- 20 Speculation  No government servant shall speculates in any investments Rule-21 Investment  Shall not make or permit any member of his family to make any investment likely to embarrass or influence him in the discharge of his official duties. 24 Rule-20 & 21
  • 25.  Lending and Borrowing-  Shall not receive or lend money to any person at interest or in kind  But can give advance of pay to a private servant.  May accept a purely temporary loan of small amount free of interest from a friend or relative or operate a credit account with a bonafide tradesman(Not more than Two months basic pay) (Amendment in 1998) 25 Rule- 22
  • 26.  Insolvency and habitual indebtedness-  Shall manage his private affairs as to avoid habitual indebtedness or insolvency.  If he/she is facing legal proceedings for the insolvency – inform to the head of the office. 26 Rule-23
  • 27.  Movable/immovable and valuable property-  Shall not acquire or dispose of any immovable property exceeding in value, the amount of his basic pay of one month, by lease, mortgage, purchase, sale, gift or otherwise either in his own name or in the name of any member of his family.  Shall give declaration of his all immovable property at the time of joining thereafter at interval of five years. 27 Rule-24
  • 28.  Vindication of acts and character of government servants-  Shall not recourse to the press for the Vindication of any official acts which has been the subject matter of adverse criticism or an attack of defamatory character. ( shall not prohibit a government servant from vindicating his private character or any act done by him in private capacity) 28 Rule-25
  • 29.  Canvassing of Non-official or other outside influence  Shall not attempt to bring any political or other outside influence to bear upon any question relating to his interest in respect of matters pertaining to his service.  Any act done by the wife or husband or any member of the family shall be presumed to have been done at the instance or with the connivance of the Govt. servant unless the contrary shall have been proved.  Representation shall always through proper channel. 29 Rule-27
  • 30.  Unauthorised pecuniary arrangements- Shall not enter into any pecuniary (financial) arrangements with another government servant or any other person so as to afford any kind or advantage to either or both of them in any unauthorised manner or against the specific or implied provisions of any rule for the time being in force. 30 Rule-28
  • 31.  Bigamous marriages-  No govt. Servant who has wife living shall contract another marriage without permission of the Government.  No female Govt. servant shall marry any person who has a wife living without permission of the government. 31 Rule- 29
  • 32.  Rule-30 Proper use of amenities-  Shall not misuse amenities provided for him to facilitate the discharge of his public duties. Rule- 31 Payment for purchases  Not withhold prompt and full payment for the article purchased (except incase of instalments) 32 Rule-30 & 31
  • 33.  Rule- 32 Use of services without payment- Rule- 33 Use of conveyances belonging to others- Rule- 34 Purchase through Subordinates- Shall not ask or permit his wife or any member of his family living with him to ask any Govt. servant who is subordinate to him to make purchase locally or from out station. 33 Rule-32, 33 &34
  • 34.   Rule- 35 Interpretation: - If any question arises relating to the interpretation of these rules- shall be referred to the government whose decision thereon shall be final.  Rule- 36 Repeal and saving – Any rules corresponding to these rules in force immediately before the commencement of these rules and applicable to government servant under the Govt. of Uttar Pradesh are hereby repealed. 34 Rule- 35 & 36
