Board of Health Charter Change Proposed 11-18-2010Adam Cohen

Qualche giorno fa è stata resa nota una Ordinanza della Corte di Giustizia Europea di cui, ancora una volta, si tenta di fornire una lettura distorta e lobbysta. Il tema è la pianta organica (i.e. il contingentamento numerico delle farmacie).
Le due schede allegate (la prima di carattere generale, la seconda con focus sull’Ordinanza) contengono alcune considerazioni sulla chiave di lettura delle sentenze della Corte di Giustizia e della nostra Corte Costituzionale, quando le due Corti giudicano su tematiche attinenti settori protetti, in cui vari aspetti corporativistici si “puntellano” l’uno con l’altro, e la cui organizzazione coinvolge obiettivi multipli da perseguire contemporaneamente (come la salute e la libera intrapresa, nel caso delle farmacie).
Il Diritto è forma e sostanza assieme. È davvero paradossale che anche rinvii pregiudiziali del Tar e del Consiglio di Stato innanzi alla Corte di Giustizia continuino a chiudersi con un nulla di fatto, per la difficoltà a rappresentare, a chi poi deve emettere la sentenza, un quadro completo e approfondito della tematica.
In tutto ciò, sembra di sentire eco del dibattito che ha accompagnato la nascita dell’Agcm, quando ci si è chiesti se fosse opportuno permettere a questa nuova Istituzione di adire direttamente la Corte Costituzionale per risolvere problemi di chiusura al mercato e di corporativismo annidati in tutto il diritto costituito. Il passo fu giudicato, forse, troppo lungo. Ma fu scartata anche l’ipotesi più cauta di rendere passaggio formale necessario l’audizione dell’Agcm da parte della Corte Costituzionale su questioni di assetto di mercato e concorrenza.
L’augurio è gli scritti possano risultare di interesse e aiutare a preparare e sostenere una nuova stagione di riforme, tenuto conto che questi temi sono a cavallo tra finanza pubblica, costruzione del federalismo e politica industriale.
La spesa farmaceutica è parte importante della spesa sanitaria, e la sua ottimizzazione non è priva di effetti sulla finanza pubblica delle Regioni e sul processo di riorganizzazione federalista. Una prospettiva - quella delle connessioni tra riorganizzazione federalista e riforme strutturali sui mercati - che andrebbe valorizzata anche al di là del comparto della distribuzione del farmaco.
