CLAIMMING THE PROJECT IS DISRUPTING THEIR BUSINESS AS THEY HAVE PAID FOR THE SHOPS AND NEED TO
MAKE MONEY TO PAY FOR THEIR RENTS AND FEED THEIR FAMILIES. HOW WOULD YOU HANDLE THIS SITUATION?

13. DEFENCE AGAINST THE LAWSUIT OF OUR
CLIENT
QUESTION 8
AS A RESULT OF THE PROTEST THAT LASTED FOR THREE DAYS. YOUR COMPANY FAILED TO COMPLETE THE
PROJECT ON THE STIPULATED TIME. YOUR CLIENT IS SUING YOUR COMPANY. WHAT WILL BE YOUR DEFENCE
The key element of our defence would be to demonstrate that the delay in delivery was not
caused by any fault or negligence on the part of our company.In this situation, According to
the 1999 Constitution, we’ll refer to:
A. Section 6 of the Nigerian Constitution, which addresses the right to fair hearing. This
section provides that every person has the right to a fair hearing within a reasonable time, by
a court or other tribunal established by law.
14. We will carefully:
1. Review the contract or agreement that was in place for the work that was delayed: One of
which states, should there be any work obstruction not emanating from us, either by man
or nature, that we would not be held accountable.
2. Review any evidence or documentation related to the delay, and determine whether the
delay was caused by factors outside of the company's control.
3. We’ll also consider whether it is possible to negotiate a settlement with the party that is
suing the company.
B. Additionally, we’ll refer to section 36 of the Nigerian Constitution, which provides that a
person shall not be held guilty of a criminal offense unless that offense is defined and the
penalty for it is prescribed in a written law.
15. C. Also, section 36, sub-section 1d, which states that "No person shall be held liable for
breach of contract if there was no financial loss". This means that, in order to successfully
bring a breach of contract lawsuit against another party, the plaintiff must prove that they have
suffered some sort of financial loss as a result of the alleged breach.
