WHATYOU SHOULD KNOWABOUT
TEACHER’S LEAVE?
•Teachers are entitled of leave
privileges for the continuous
service in the government, enable
to rest, recuperate and to regain
energy. For this purpose, leave
laws are provided to serve as
guide in processing leave and
availing leave benefits.
WHATYOU SHOULD KNOWABOUT
TEACHER’S LEAVE
•The Omnibus Rules Book
V of Executive Order No.
292 Section 1. Non-
Teaching personnel in
DepEd are entitled to 15
•Teachers engaged in actual
classroom teaching are
under Teacher’s leave
basis. Teachers are NOT
entitled to the usual
vacation and sick leave
•Teacher who are
designated to perform non-
teaching functions and who
render the same hours of
service as other employees
shall be entitled to vacation
and sick leave.
•(Provided under CSC MC No. 41,
LEAVE OF
ABSENCE
•Granted to
officials and
employees not to
report for work
TYPES OF LEAVE OF
ABSENCE:
• Sick
• Vacation
• Maternity (EML/RA 11210)
• Paternity
• Rehabilitation
• Solo Parent (RA 8972)
• Magna Carta of Women (RA 9710)
• Study Leave
• Calamity/Emergency
SICK LEAVE
•Granted only on account of
sickness or disability on the
part of the employee
concerned or any member
of his /her immediate
VACATION LEAVE
•Granted to officials and
employees for personal
reasons, the approval of
which is contingent upon
the necessities of the
THEREARE TWO (2) DIFFERENT VACATION
LEAVE:
(Sec. 6 & 25 of the Omnibus Rules on Leave)
•1. Vacation leave for
teachers – shall not be
entitled to the usual
vacation and sick leave
credits but to Proportional
Vacation Pay (PVP) of 70
days summer plus 14 days
•Vacation leave for Non-
Teaching Personnel –
Employees with 10 days or
more vacation leave credits
shall have a five days
forced/mandatory leave. It
shall be forfeited if not taken
during the year.
MATERNITY LEAVE
•Granted to female
government employees
legally entitled thereto in
addition to vacation and
EXPANDED MATERNITY LEAVE (R.A.
11210)
•Increasing the maternity leave
period of 105 days for female
workers with an option to
extend 30 days without pay
and additional 15 days for
PATERNITY LEAVE
•Granted to a married male
employee allowing him not
to report for work for seven
(7) days while continuing to
earn the compensation
REHABILITATION LEAVE
•Application of officials and
employees for leave of absence on
account of wounds or injuries
incurred in the performance of
duty. The agency concerned shall
direct that absence shall be on full
R.A. 8972 SOLO PARENT
•Parental Leave – In addition to
leave privileges under existing
law, leave of not more than
seven (7) working days every
year shall be granted to any solo
parent employee who has
MAGNACARTAOF WOMEN UNDER R.A.
9710
•Special leave of a maximum of two
months with full pay based on gross
monthly compensation provided she
has rendered at least six (6) months
aggregate service in any or various
government agencies for tne last
twelve (12) months prior to undergoing
STUDY LEAVE
Granted to teachers rendered
at least seven (7) years in
service. Entitled to at least
65% of monthly salary
provided he/she takes regular
study load & passes at least
VACATION SERVICE CREDITS
•Leave credits earned for
services rendered during
activities authorized by proper
authorities during summer and
christmas vacation. These
credits are used to offset their
Activities Eligible for the Grant of Service
Credits:
Registration and Election days
Calamity and Rehabilitation
Remedial Classes during vacation
Early Opening of the School Year
School Sports Competition
Training/Seminars
Teaching Overload/Non-formal education classes
Conduct of Testing Activities
Special DepEd Projects and Activities
Procedure in the Grant of Service
Credits:
Head of office/school
recommends
approval of request.
SDS Approves/disapproves
request.
Documents shall be accomplished
•Granted for services
rendered beyond the
required working hours
during school days, which is
exclusive of the 15 days
limitation under DepEd
Designated Sch./Dist. Property
Custodians
•Required to render services
during the summer vacation to
conduct properly inventory.
Service Credits of not more
than 15 days, also exclusive
of the 15 days limitation.
ALS Mobile Teachers
•Provides equal opportunities and
standard implementation. The Mobile
Teacher/ALS and District Coordinator
(DALSC) follows a flexible teaching
schedule without summer vacation to
meet the learning needs of the
learners. They are entitled to earn
PROPORTIONAL VACATION PAY
(PVP)
•Teachers shall not be
entitled to the usual
vacation and sick leave
credits but to PVP of 70
days of summer vacation
EFFECT OF UNAUTHORIZED
LEAVE
•An official/employee who is absent
w/out approved leave shall not be
entitled to receive salary
corresponding to the period of his
unauthorized leave of absence, it
shall no longer be deducted from
his accumulated leave credits, if
LIMIT OF LEAVE WITHOUT
PAY
•Granted not exceeding one
year. Leave w/out pay in
excess of one month shall
require the clearance of the
proper head of agency.
EFFECT OF ABSENCES
WITHOUT APPROVED LEAVE
•Leave for at least 30
working days shall be
considered on absence
without official leave
(AWOL) and shall be

  • 2. WHATYOU SHOULD KNOWABOUT TEACHER’S LEAVE? •Teachers are entitled of leave privileges for the continuous service in the government, enable to rest, recuperate and to regain energy. For this purpose, leave laws are provided to serve as guide in processing leave and availing leave benefits.
