Preventive Detention
…is A system in which people can be detained by his/her government without having committed a crime.
Argument Preventive detention is a violation of human rights. Every person is entitled to a fair trial and should be allowed to know why he/she is being detained.
Problematic System Person can be detained indefinitely without being told why. Accused has no defense or trial. Accused is arrested on suspicion of being a threat, not for any specific crime.
United States Barack Obama proposed a preventive detention plan for the United States. He recently withdrew the bill from congress, but the United States already has a form of preventive detention that passed after 9/11.
UNCONSTITUTIONAL! Every person has the right to a fair trial according to the United States Constitution.
Counterargument Could possibly prevent a terrorist attack. Rids the streets of National Security threats.
Final Thought Stopping a crime before it happens is a tremendous feat; however, isn’t that “potential” criminal still a human being, and don’t all human beings deserve the same rights.
