In 2008, a program was launched in selected districts in India with the aim of improving the quality of maternal and neonatal care. This program came to be known as Yashoda, named after a well-known foster-mother in Indian mythology. To establish the effectiveness of this program a study was carried out; a group of women were put under the care of Yashodas while another group which formed the control experiment was left without them. Results of their progress were collected and compared. Mothers who were under the care of Yashodas received enough counseling on family planning, breastfeeding, nutrition, immunization and danger signs. Those who are in control districts less of the same services. As a result, this program became popular and was embraced by most mothers and health workers. This program is recommended in health facilities where there are high volumes of deliveries. It is an effective intervention in ensuring that mothers get quality maternal services to benefit them and the newborns. Through this program even the cases of death of newborns and mothers before and immediately after delivery reduced. Some of these cases happen because quality services are not provided especially in cases where the volumes of the women who require them are high.
Modern India has been quite silent on the role it plays in international law and this situation remains unexplained. The history of India and international relations dates back many years ago. Various scholars have debated the role of Buddhism in international law. However, it has been established through the works of scholars that Buddhism has contributed a lot to international law. In addition, according to new research there is a possibility that environmental, natural resource and humanitarian law will be developed from Buddhism. There is a lot that the international law can borrow from Buddhism and Indian mythology and therefore, the future of international law has a lot of contribution from India and even other states in Africa which have felt left behind. For example, principles of Panchsheel of ancient Indian are likely to be used in European Court of Justice (ECJ) (section VII). Moreover, there are several sets from Hinduism that are currently contained in the completed sets of international law and relations.

In 2004, the Inter-agency Gender Working Group (IGWG) published The “So What?” Report: A Look at Whether Integrating a Gender Focus into Programs Makes a Difference to Outcomes. The 2004 report presented evidence of the value of integrating gender into programs for promoting positive reproductive health (RH) and gender outcomes.
The purpose of this new 2009 review is to assemble the latest data and update the evidence as to what difference it makes when a gender perspective is incorporated into RH programs. The review focuses on five components of reproductive health programs, including interventions related to: n Unintended pregnancy; n Maternal health; n HIV/AIDS and other STIs; n Harmful practices, including early marriage, female genital mutilation/cutting, and gender- based violence; and n Youth.
The authors examined gender-related barriers to each component of reproductive health and the strategies undertaken by programs to address the barriers. Out of nearly 200 interventions reviewed, 40 are included here as examples of programs that integrate gender to improve reproductive health outcomes.
The interventions selected for inclusion were limited to those that have been evaluated— meaning they established criteria for assessment that were related to the goals of the intervention and followed an evaluation design—and that used accommodating or trans-formative approaches. The results of these pro-grams suggest that the field is evolving toward a deeper understanding of what gender equality entails and a stronger commitment to pursue this equality in reproductive health programs. Reducing Unintended Pregnancies Several of the projects to reduce unintended pregnancy countered the traditional practice of aiming family planning (FP) services at women only; they encouraged husbands and other males to take more responsibility in this area.
The strategies included enlistment of men who hold power, such as community or religious leaders, to support FP; influencing husbands to encourage their wives to use FP services; and providing a male-controlled contraceptive method. Other projects encouraged joint decision making, shared responsibility in FP, and the institutionalization of gender into RH services.

In 2004, the Inter-agency Gender Working Group (IGWG) published The “So What?” Report: A Look at Whether Integrating a Gender Focus into Programs Makes a Difference to Outcomes. The 2004 report presented evidence of the value of integrating gender into programs for promoting positive reproductive health (RH) and gender outcomes.
The purpose of this new 2009 review is to assemble the latest data and update the evidence as to what difference it makes when a gender perspective is incorporated into RH programs. The review focuses on five components of reproductive health programs, including interventions related to: n Unintended pregnancy; n Maternal health; n HIV/AIDS and other STIs; n Harmful practices, including early marriage, female genital mutilation/cutting, and gender- based violence; and n Youth.
The authors examined gender-related barriers to each component of reproductive health and the strategies undertaken by programs to address the barriers. Out of nearly 200 interventions reviewed, 40 are included here as examples of programs that integrate gender to improve reproductive health outcomes.
The interventions selected for inclusion were limited to those that have been evaluated— meaning they established criteria for assessment that were related to the goals of the intervention and followed an evaluation design—and that used accommodating or trans-formative approaches. The results of these pro-grams suggest that the field is evolving toward a deeper understanding of what gender equality entails and a stronger commitment to pursue this equality in reproductive health programs. Reducing Unintended Pregnancies Several of the projects to reduce unintended pregnancy countered the traditional practice of aiming family planning (FP) services at women only; they encouraged husbands and other males to take more responsibility in this area.
The strategies included enlistment of men who hold power, such as community or religious leaders, to support FP; influencing husbands to encourage their wives to use FP services; and providing a male-controlled contraceptive method. Other projects encouraged joint decision making, shared responsibility in FP, and the institutionalization of gender into RH services.

STATISTICAL TECHNIQUE IN REVIEW
Most studies describe the subjects that comprise the study sample. This description of the sample is called the sample characteristics which may be presented in a table or the narrative of the article. The sample characteristics are often presented for each of the groups in a study (i.e. experimental and control groups). Descriptive statistics are used to generate sample characteristics, and the type of statistic used depends on the level of measurement of the demographic variables included in a study (Burns & Grove, 2007). For example, measuring gender produces nominal level data that can be described using frequencies, percentages, and mode. Measuring educational level usually produces ordinal data that can be described using frequencies, percentages, mode, median, and range. Obtaining each subject's specific age is an example of ratio data that can be described using mean, range, and standard deviation. Interval and ratio data are analyzed with the same type of statistics and are usually referred to as interval/ratio level data in this text.

Introduction
Troy and Dalgas-Pelish (2003) conducted a quasi-experimental study to determine the effectiveness of a self-care intervention (Tiredness Management Guide [TMG]) on postpartum fatigue. The study subjects included 68 primiparous mothers, who were randomly assigned to either the experimental group (32 subjects) or the control group (36 subjects) using a computer program. The results of the study indicated that the TMG was effective in reducing levels of morning postpartum fatigue from the 2nd to 4th weeks postpartum. These researchers recommend that “mothers need to be informed that they will probably experience postpartum fatigue and be taught to assess and manage this phenomenon” (Troy & Dalgas-Pelish, 2003, pp. 44-5).

In 2008, a program was launched in selected districts in India
with the aim of improving the quality of maternal and neonatal
care. This program came to be known as Yashoda, named after a
well-known foster-mother in Indian mythology. To establish the
effectiveness of this program a study was carried out; a group of
women were put under the care of Yashodas while another
group which formed the control experiment was left without
them. Results of their progress were collected and compared.
Mothers who were under the care of Yashodas received enough
counseling on family planning, breastfeeding, nutrition,
immunization and danger signs. Those who are in control
districts less of the same services. As a result, this program
became popular and was embraced by most mothers and health
workers. This program is recommended in health facilities
where there are high volumes of deliveries. It is an effective
intervention in ensuring that mothers get quality maternal
services to benefit them and the newborns. Through this
program even the cases of death of newborns and mothers
before and immediately after delivery reduced. Some of these
cases happen because quality services are not provided
especially in cases where the volumes of the women who
require them are high.
Modern India has been quite silent on the role it plays in
international law and this situation remains unexplained. The
history of India and international relations dates back many
years ago. Various scholars have debated the role of Buddhism
in international law. However, it has been established through
the works of scholars that Buddhism has contributed a lot to
international law. In addition, according to new research there
is a possibility that environmental, natural resource and
2. humanitarian law will be developed from Buddhism. There is a
lot that the international law can borrow from Buddhism and
Indian mythology and therefore, the future of international law
has a lot of contribution from India and even other states in
Africa which have felt left behind. For example, principles of
Panchsheel of ancient Indian are likely to be used in European
Court of Justice (ECJ) (section VII). Moreover, there are
several sets from Hinduism that are currently contained in the
completed sets of international law and relations.
Indian mythology is a main theme in both articles (Indian
religion and mythology cannot be easily separated). In the first
article about Yashoda program, it is mentioned that the program
was named after a woman known as Yashoda, a legendary foster
mother in Indian mythology. Yashoda was the foster-mother to a
god known as Krishna and the wife of Nanda in Hinduism. The
second is article about international law and religion. Religions
such as Christianity and Islam have formed the basis of
international law although other religions such as Buddhism are
featured too. The article sheds light on the contribution of
Indian mythology in ancient and modern international laws.
Both articles have their discussions rooted from Indian
mythology, although they do not share the main point of
discussion. Comment by Dipanjan Maitra: The effectiveness of
the myth of Yashoda in increasing quality of maternal care in
India remains unclear. Would you say that the myth or the story
of Krishna’s mother helped mothers realize their problem, or
was effective in drawing their attention? If that is the case, then
that would have to be argued further. You could focus on the
role played by myths in increasing social awareness etc. Also,
cite your articles clearly at the end.

Abstract
Background: The Yashoda program, named after a legendary
foster-mother in Indian mythology, under the Norway-India
Partnership Initiative was launched as a pilot program in 2008
to improve the quality of maternal and neonatal care at
facilities in select districts of India. Yashodas were placed
mainly at district hospitals, which are high delivery load
facilities, to
provide support and care to mothers and newborns during their
stay at these facilities. This study presents the results from
the evaluation of this intervention in two states in India.
Methods: Data collection methods included in-depth interviews
with healthcare providers and mothers and a survey of
mothers who had recently delivered within a quasi-experimental
design. Fifty IDIs were done and 1,652 mothers who had
delivered in the past three months were surveyed during 2010
and 2011.
Results: A significantly higher proportion of mothers at
facilities with Yashodas (55 percent to 97 percent) received
counseling on immunization, breastfeeding, family planning,
danger signs, and nutrition compared to those in control
4. districts (34 percent to 66 percent). Mothers in intervention
facilities were four to five times more likely to receive
postnatal
checks than mothers in control facilities. Among mothers who
underwent cesarean sections, initiation of breastfeeding
within five hours was 50 percent higher in intervention
facilities. Mothers and families also reported increased support,
care
and respect at intervention facilities.
Conclusion: Yashoda as mothers’ aide thus seems to be an
effective intervention to improve quality of maternal and
newborn care in India. Scaling up of this intervention is
recommended in district hospitals and other facilities with high
volume of deliveries.

Introduction
Providing health care services, especially maternal and newborn
care, is increasingly understood to be a dynamic system of
entitlement and obligations among people, communities, provid-
ers, and governments. The paradox is that global community
still
concentrates on efforts to attain health-related Millennium
Development Goals (MDGs) based on national strategies to
reach
high and equitable coverage of health services. The coverage of
health services, though absolutely necessary, is not sufficient to
attain the goals. The quality of treatment and care provided by
health system can be complementary to the global efforts to
reach
and maintain coverage of health services. However, straight-
forward indicators that can measure the quality of care are still

be identified 1].
The Janani Suraksha Yojana (JSY) launched by the Govern-
ment of India in 2005 under the ambit of the National Rural
Health Mission (NRHM) has resulted in unprecedented increase
in institutional deliveries in India. The JSY beneficiaries
increased
from 700,000 in 2005–2006 to 9.23 million women in 2009–
2010
2]. This dramatic increase in facility births, although a
significant
public health achievement, has now put tremendous pressure on
the health institutions. The public health facilities lack
infrastruc-
ture, manpower and other facilities to coordinate and ensure
quality service delivery.
As a response, in 2006, the Norway-India Partnership Initiative
(NIPI), a joint venture between the governments of Norway and
India, was launched to provide catalytic and strategic support to
NRHM in five focus states (more details available at
NIPI.org.in).
7. The specific aim of NIPI was to improve child health and
related
maternal health service delivery quality and access through
facility
and community-based interventions and through techno-manage-
rial support at district and sub-district levels. NIPI introduced
an
innovative concept of a facility-based support worker or birth
companion in facilities with high delivery volumes, named
Yashoda

of this paper.
A Yashoda’s main role was to support the mother and the
newborn child and assist the nurse in providing various non-
clinical activities from the time the pregnant woman enters the
facility till she leaves the hospital with the baby. The Yashoda
thus is
8. envisaged primarily as a mother’s aide and birth companion.
During this period, the Yashoda is to:
N Support the mother for immediate and exclusive
breastfeeding;
N Orient the mother about basic newborn care and immuniza-
tion;
N Assist the nurse in various postnatal care activities for
making
the newborn and the mother comfortable.
N Counsel the mother on family planning options, newborn
care,
nutrition, feeding practices, and hygiene.
The rationale for the Yashoda intervention is found in concepts
such as baby-friendly hospital and mother-friendly health care
complemented with continuum of care approach 3]. The
evidence
about the usefulness of birth companions who provide support
to
women during childbirth, range from psycho-social support to
assistance with information and procedures 4,5]. Birth compan-
ions were traditionally community women or family members
who
comforted and supported a woman emotionally as she went
9. through the stressful experience of childbirth.
Research since the 1970s has shown that the presence of a birth
companion is extremely beneficial in easing the trauma of
childbirth for the mother and in helping her cope with her
experience 6]. Birth companionship was found to be positively
associated with reduced length of labor and improved maternal-
infant interaction 7]. A Cochrane review of 16 trials involving
female birth companions found that women who had continuous
intra-partum support were likely to have: slightly shorter labor,
spontaneous vaginal birth, and less likely to have intra-partum
analgesia 8]. Birth companions’ presence is also likely to lead
to
fewer newborn complications 9].
In India, the Government of Tamil Nadu initiated a ‘‘birth
companion’’ scheme in 2004 in all public hospitals in the state,
under which women getting admitted to facilities could
nominate a
female family member to be their birth companion. A study
there
10. showed that the presence of a birth companion in the labor room
may have reduced the likelihood of abuse by providers of
women
in labor 10].
This study is aimed to understand the space of a birth
companion, Yashoda, in the limits of the maternities in select
districts of Rajasthan and Odisha. The objective of this study
thus
was to assess the effectiveness of the Yashoda intervention in
improving maternal and newborn care in Rajasthan and Odisha,
two states of India. In Rajasthan, the Yashodas were placed in
the
district hospital (DH) as well as in some community health
centers
(CHCs) with high delivery load (300 to 1000 deliveries in a
month); however, in Odisha this intervention was restricted to
DH
only with a delivery load of 500 per month.
Methods
This independent evaluation study was conducted from January
2010 to September 2011 and used a multidisciplinary approach
11. within a quasi-experimental design (intervention and control
districts) to assess and evaluate two NIPI interventions – the
Yashoda program and the home-based newborn care support
provided by ASHAs (Figure 1). The current paper focuses on
the
Yashoda intervention. The intervention districts where the
Yashoda
program was fully functional were Alwar in Rajasthan and
Anugul
in Odisha; control districts with no Yashodas were Sawai
Madhopur
in Rajasthan and Bargarh in Odisha (Figure 2). The control
districts were matched with NIPI intervention districts using
DLHS III and census 2011 data 11,12] based on socioeconomic
and epidemiological indicators (population density, literacy
rates,
rates of antenatal care and institutional delivery) (Table 1).
During
the study period (2010 to 2011), other than the routine programs
of the National Rural Health Mission (NRHM), no other
interventions were being implemented in the study facilities.
12. Data collection methods included ethnographic studies, in-
depth interviews (IDIs), focus group discussions (FGDs), and
community survey. Community survey remained the main
source
of evaluation data. Ethnographic studies were conducted in two
communities within the same district in Rajasthan where two
fieldworkers lived, observed, and participated in community
life.
The two communities, though similar in economic status and in
access to health care services, differed clearly in utilization of
health care services.
The IDIs and FGDs were conducted by pre-trained facilitators
and were based on a semi-structured guide covering the various
issues to identify missing or weak links (bottlenecks) in the
functioning of NIPI interventions. Local languages were used in
all
interviews and groups discussions, later translated and
transcribed.
The taped discussions were translated into English and
transcribed
13. into Microsoft Word by the facilitator and note takers’ teams.
Thematic analysis was coded and done manually by three
investigators. The themes were initially analyzed in the form of
role-ordered matrices, based on qualitative frameworks
suggested
by Miles and Huberman 13]. Saturation was achieved on the
main
themes. Findings from interviews help guide the survey
question-
naire.
The community survey was conducted between March to May
2011 in all study districts. For the community survey, the study
participants were defined as ‘mothers who delivered at district
hospitals in the last three months preceding the survey.’ To
calculate the required sample size for the community survey,
the
proportion of mothers who initiated breastfeeding within one
hour
of delivery (IBF1) was assumed to be 60 percent. To
demonstrate
at least a 25 percent difference between the intervention and
14. control groups (with 80 percent power and a = 0.05), the
minimum sample was estimated to be 216 mothers per arm. A
design effect of two was assumed, increasing the sample size to
432
per arm.
The survey conducted in two states included a total sample of
1,728 mothers across the intervention and control districts. A
detailed questionnaire was developed for the community survey,
divided into thematic sections. Mothers were specifically asked
regarding receipt of practices or services that were specific to
Yashoda’s tasks (listed below).
Based on the job profile of the Yashodas, the primary indicators
for the program included:
1. Counseling of mothers on exclusive breast feeding, family
planning, nutrition, danger signs, cleanliness;
2. Facilitation of immediate postpartum care for mother and new
born;
3. Initiation of breastfeeding within one to five hours after
delivery;
15. 4. Weighing of the baby.
5. Immunization with birth dose of Polio and BCG.
Explanatory variables included indicators of demographic and
socio-economic status and maternal and child outcomes. Details

pregnancy history and birth experience were also collected,
including antenatal, intranatal and postnatal care, quality of
care
(cleanliness, availability of toilet and drinking water), trust and
emotional support, cost of care and awareness and receipt of
JSY
scheme.
The survey data was analyzed using SPSS version 18.
Descriptive analyses and bivariate analyses were followed by
binary logistic regression analyses to estimate the effect
(through
adjusted odds ratios) of Yashodas on maternal and newborn

maximum likelihood estimates of the logistic regression coeffi-
cients. Adjusted odds ratios were reported as increased or
decreased likelihood of occurrence of an event. Eighteen
specifications have been used for each state: Six counseling
17. variables (exclusive breast feeding, family planning,
immunization,
nutrition, identification of danger signs, hygiene); Six
postpartum
care variables (blood pressure check, temperature check,
perineum
check, episiotomy check, check for injection, and saline check);
and Six newborn care practice variables (mothers who took
measures to keep newborn warm, were provided with food and
water at PNC ward, initiated breastfeeding within one hour,

18. Ethics Statement
For in-depth interviews (IDI), most health care providers gave
written consent; mothers in the community gave verbal
informed
consent after the purpose and proceedings of the study were
explained to them, for some participants who did not want their
conversations recorded, researchers took notes. Written consent
was obtained for almost all IDIs with providers. Some doctors
were not comfortable with providing written consent so we took
verbal consent and clearly told them (as well as all others) that
they
are free to stop the interview or not answer any question if they
did
not wish to. It was clarified that in the final report or in
publications, no name will be identified.
For mothers, an information sheet about the study was read,
and told that they are free to answer all or part of the
questionnaire and at any time they felt uncomfortable, they can
stop the interview. Since most mothers were illiterate or had
minimal education it was deemed not useful to collect written
19. consent. ASHAs and Aganwadi workers (community level
workers) were informed regarding the survey and they were
asked
to inform mothers about the same and were provided with a
study
information sheet.
For IDIs with providers, signed written consent forms were
collected, for the two doctors who did not provide written
consent;
the interviewer noted the same in the recording. For survey of
mothers, each data collector noted in the information sheet that
verbal consent was taken.
The Institutional Ethics Committee at the Public Health
Foundation of India was provided with a copy of information
sheet and informed consent forms. The ethics application form
clearly stated that for the survey of mothers in the community,
verbal consent would be obtained after informing them about
the
study and their ability to stop the process at any time. The
committee approved the research protocol, including the consent
20. process.
Results
Characteristics of the Sample
The community survey provided valid responses from 1,652
women (out of the 1,750 mothers interviewed), 810 in
intervention
and 842 in control districts, with a response rate of 94 percent
(Table 2). The median age of respondents ranged from 22 to 24
years, education levels were similar across intervention and
control
groups within a state, however quite different between
Rajasthan
and Odisha. Within Rajasthan, Alwar with its more urban
population reported slightly higher levels of educated women
than
the control area (25% of women in Alwar reported having more
than eighth grade education compared to 14% in Sawai
Madhopur. A larger proportion of mothers in Rajasthan reported

living in pucca houses than those in Odisha. Women in
intervention
district, Alwar (Alwar is more urban than Sawai Madhopur)
reported higher levels of education than in control district of
Sawai
Madhopur. Nurses conducted 70 to 84 percent of the deliveries,
with no significant differences between intervention and control
23. groups. Family members influenced place of delivery for most,
and
the biggest reason for choosing a place of delivery was the
perception of ‘good facility’ as reported by 66 percent
respondents;
cost was the second important factor. More mothers in Odisha
than in Rajasthan (83 percent to 86 percent vs. 57 percent to 69
percent) received more than three ANC visits (Table 2).
Yashoda Characteristics
As envisaged by NIPI, Yashodas provided care and support to
mothers and newborns in select district hospitals in Rajasthan
and
Odisha. They were provided a pink apron or sari to ensure a
separate identity at the facilities. One Yashoda attended five to
six
mothers and their newborns during an eight-hour shift. The
median age of a Yashoda was 33 years in Odisha and 35 years
in
Rajasthan. The adopted remuneration model was different in the
two states. In Rajasthan, payment to Yashodas was based on the
number of deliveries in the hospital (an incentive of 100 Indian
24. Rupees ($2) per conducted institutional delivery) with a
reported
median of Rs. 4,000 ($80) per month. In Odisha, a fixed amount
of
Rs. 3,000 ($60) per month was paid to them. Most of the
Yashodas,
however, preferred a combined model for remuneration—a fixed
amount plus incentives linked to performance rather than to
number of deliveries.
Most (75 percent) of Yashodas received two to three days
training
on counseling and on the nature of her supportive role at the
facility for mother and newborn. The Yashodas found the
training
sessions helpful in defining their role clarity and dispensing
their
duties. Most of the Yashodas recommended continued refresher
training to upgrade their skills.
‘‘Through this training we got knowledge about family
planning,
immunization, breast feeding, diet of the mother, how to receive
a mother
25. and child after delivery, how to maintain hygiene within the
hospital,
what are the problems that a mother faces after delivery etc.’’
(IDI,
Yashoda, Alwar and Anugul).
In both the states, the supervisors (generally a retired auxiliary
nurse midwife or nurse) were appointed either along with or
before
the Yashodas were appointed and provided support to them.
This
was very much appreciated by the Yashodas.

Counseling and Support in Facility
Yashodas spend most of their time, almost forty percent, in the
28. labor room and in the postnatal ward. Although, one of their
responsibilities was to be available as a mother comes to the
facility
for registrations, almost no interactions with mothers were
reported during the registration process. Eighty one percent of
mothers in Alwar and 93 percent in Anugul reported interacting
with Yashodas only in the PNC ward. In the PNC ward,
Yashodas
reported spending most of their time on counseling mothers on
breastfeeding, nutrition, family planning, hygiene,
identification of
danger signs, and on immunization. This was corroborated by
mothers too–mothers in the intervention areas were two to nine
times more likely to receive counseling on these topics than
those
in control areas (Tables 3 and 4). The proportion of mothers
who
reported receiving counseling messages, however, varied across
the
topics. For example, exclusive breast-feeding was the most
discussed among the six topics, with 95 percent of the
29. respondents
in Alwar reporting having received information on it (9.07 [95
percent CI 5.71–14.41]); however, only 55 percent of mothers
reported receiving any information on danger signs at the
facility.
This variation was much smaller in Anugul, the intervention
district of Odisha, where the proportions of counseling by topic
ranged from 83 percent to 97 percent (Tables 3 and 4).
Yashodas facilitated some of the essential postnatal care such as
checking the temperature, blood pressure and perineum for
mothers at the facilities: 48 percent of the mothers in Alwar DH
reported checking of blood pressure compared to 14 percent in
Sawai Madhopur (29 percent in Anugul, 20 percent in Bargarh).
Similarly, mothers at the Alwar DH were 5.95 times (95percent
CI
3.54 to 10) more likely to have their temperature checked than
those in Sawai Madhopur without any Yashodas; mothers in
Anugul were 2.49 times (95 percent CI 1.64 to 3.78) more likely
to
have their episiotomy stitches checked compared to mothers in
30. Bargarh (Figure 3).
Neonatal Care Practices
Some of the neonatal care practice indicators (keeping the
newborn baby warm, providing food and water at the PNC ward,
initiating breast feeding within one hour and immunization) did
not always show significant differences between the
intervention
and control districts, especially in Rajasthan (Tables 3 and 4).
In
Odisha, some significant differences were observed in between
NIPI intervention and non-NIPI areas, for example, neonates in
Anugul were 5.26 times (95 percent CI 3.08to 8.99) more likely
to
receive birth dose BCG and OPV compared to those in the
control district (Table 4).
The impact of Yashodas were most apparent for mothers with
C-section delivery; 76 percent of respondents who had C-
section
delivery in the intervention districts reported that they initiated

35. breast feeding within five hours compared to 44 percent
(P,0.001)
in the control district (Table 5).
This was mainly attributed to the support provided by Yashodas
to position the baby in a less-painful manner and aiding early
breastfeeding.
‘‘Yashoda told her the right way of breast feeding and about the
family
planning methods also. Yashoda continuously monitors for
problems and
checks if mother has any discomfort’’ (IDI, Caregiver, Anugul).
Similarly, more than 95 percent of the respondents who had C-
section delivery reported that their C-section scar was checked
and
that their dressings were changed compared to 83 percent and
72
percent in the control districts for the same indicators.
Women reported improved or better overall experience at
facilities with yashodas compared to those without Yashodas.
Mothers and families felt that the presence of Yashodas was
36. beneficial to them in several ways. Mothers reported being more
comfortable within the hospital environment, in the presence of
Yashodas. It was pointed out that ‘‘….even people from high
socio-
economic status don’t want to stay in (an exclusive) cabin
because there are no
Yashoda services in the cabin.’’
Yashodas were eager and quick to help mother’s breastfeed the
newborn babies. They emphasized the importance of exclusively
breastfeeding the baby to everyone including mothers-in-law
and
relatives. Existing nursing staff at the facilities also appreciated
this
new cadre of support workers.
‘‘..After the coming of Yashodas at the hospital, we have got
much help
from them, because, now we do not need to worry about
mothers as
Yashodas take care of the mothers…’’ (IDI, Staff nurse, Alwar
DH).
Sometimes Yashodas also acted as change agents.
37. Discussion
This study found that Yashodas provided support and care to
mothers and newborn babies; mothers and families felt that the
presence of Yashodas increased the comfort level at facilities. A
significantly higher proportion of mothers who delivered at
facilities where Yashodas were present reported having received
counseling on a variety of maternal and newborn care issues
when
compared to respondents who delivered at facilities where
Yashodas
were not present. More importantly, for mothers who had a
cesarean section, presence of Yashodas significantly improved
their
ability to initiate breastfeeding within five hours of delivery.
Yashodas also enabled a significantly higher proportion of
mothers to receive postnatal checks at the facility. However,
this
proportion that received basic postnatal checks at the
intervention
facilities is still quite low (ranging from 20 percent to 40
percent).
38. This reflects the poor quality of PNC care currently available at
these facilities. Improving postnatal care for mothers and
newborn
babies in all facilities would have a significant impact on
maternal
and neonatal mortality and morbidity. Although, the presence of
Yashodas has improved the level of care, there is an immense
scope
for improvement in immediate postnatal care inside maternities,
which should be universally received by mothers at all
facilities.
Some of the neonatal care practice indicators (keeping the
newborn warm, provision of food and water at the PNC ward,
initiation of breast feeding within one hour and immunization)
did
not always show significant differences between the
intervention
and control districts and were reported by almost 80percent of
mothers. This perhaps depicts the impact of efforts under
NRHM
to improve these neonatal care indicators across all facilities in
India. NRHM programs have focused extensively on newborn
39. care practices, mainly on initiation of breastfeeding and keeping
the newborn warm.
It is important to note that the level of respondents’ exposure to
health personnel including the Yashoda is dependent on the
length
of stay at the facility. The community survey showed that 82
percent of mothers who had a normal delivery in Alwar and 24
percent of those in Anugul, stayed at the health facility for at
least
48 hours after delivery. The length of stay at the facility
therefore
impacts the level of Yashoda exposure and the associated
benefits.
The length of stay however, is influenced by a variety of factors
ranging from type of delivery, health system issues and
influence of
family members.
In both intervention and control districts 70 percent of mothers
expressed confidence in the health facility by opining that they
would go back to institutional delivery for their next pregnancy.
40. The positive experience at the facility was an important reason
for
mothers in Rajasthan, especially in intervention area (73percent
in
Alwar versus 32 percent in Sawai Madhopur); whereas in
Odisha,
the incentive received through JSY was an important reason for
women to return to facilities for their next delivery.
The strength of this study is its multi-method approaches with
ethnography, qualitative (IDIs, FGDs) and quantitative (survey)
methods. This study also has a few limitations: one of the main
limitations was lack of baseline information on the selected
indicators; however, this was partially addressed through the
selection of control districts that most matched the intervention
district. Another issue was the limited analysis on mothers who
had
cesarean section due to the small sample size. Contrary to our
expectation, the number of mothers with C-sections was not
very
high at district hospitals. The study was designed to measure
impact of Yashodas on maternal and neonatal care practices.
41. Thus,
the interpretation of the findings from this study thus should be
limited to the impact on these indicators and not on neonatal
mortality outcomes. A study modeling the potential impact of
Yashodas on neonatal mortality is described elsewhere 14].
Yashodas thus appear to be an important cadre of workers who
provide significant support to mothers and newborns in institu-
tions—through improved counseling and facilitation of
important

42. postnatal care. Their support has shown to result in significantly
higher levels of information among mothers (through
counseling)
and in improved immediate postpartum care. However, it is
important to suitably highlight Yashoda’s role as a mother’s
aide,
possibly illustrating the importance of emotional support
required
for a satisfactory delivery experience and her crucial role in
ensuring the same. This would help the Yashoda and the staff to
understand and appreciate their role and create a unique identity
for Yashodas in the facility.
This study suggests that Yashodas when placed at high delivery
load facilities like a district hospital, provides support to
mothers
and new born; provides counseling to mothers on maternal and
newborn care practices; and also facilitates immediate
postpartum
care to mother and newborn. Thus, the Yashoda intervention
appears to be an effective intervention in improving the quality

maternal and newborn care during institutional delivery and
could
potentially have an impact on neonatal and maternal mortality.
Thus, a scale up of this intervention especially in high delivery
load
facilities across India is highly recommended.

What Can International
Law Learn from Indian
Mythology, Hinduism and
History?

Modern India has been rather silent on its role in international
law. This reticence
remains unexplained in the comparative literature on
international law. India’s
history with international relations theories date back to ancient
times. Various
Hindu texts from some eight millennia ago passed over to
generations by the method
of “shruti”and manuscripted later, contain one of the most
complete sets of
international laws and relations. “Dharma”remains the central
aspect to this
discourse. The opinions of the International Court of Justice
(ICJ) in the Nuclear
Weapons cases, particularly those delivered by Third World
judges, cited these
Hindu scriptures as sources of international law. This paper
theorizes that modern
international law needs a cross fertilisation from Hinduism and
Buddhism to become
48. a universal construct. The role of India in the centre-periphery
analysis of
international law begs a collective answer from the Vedas, the
Bhagavad , the
Manu Samhita and the . In the post-WWII period, India came
quite
close to resurrecting the Hindu/Buddhist international law of
peaceful co-existence.
In an imitative reversal of European discourse in the Panchsheel
Agreement with
China, India succeeded in establishing new principles of
international law. This
paper offers an account of the ancient Hindu international laws
of India and
discusses the possibility of Indian contribution to international
law.

If you read any recent periodical or newspaper, you are likely to
see more and more
coverage of conflicts involving religion and state. This
troubling pattern is specifically
acute in Asia, where the relationship between religion and
society is particularly tense.
Pathology of this situation reveals that sovereign and religion
are not at ease with
today’s Asian society. This is striking given that many of the
founding fathers of
modern international law were naturalists and religious
scholars. International law in
Europe emerged form the works of religious naturalist scholars
like Spanish Francisco
Suárez (1548-1617), Italian Alberico Gentili (1552-1608), and
Dutch Hugo Grotius (1583-
1645). In his works, Gentili premised that the God was the
legislator.1 Such premise is
not uncommon of the legal scholars of that time.
50. Gentili’s first book on international law, “De Legationibus Libri
Tres,”was published
in 1582. Suárez entered the Society of Jesus at Salamanca,
studied philosophy and
theology, and wrote “De Triplici Virtute Theologica, Fide, Spe,
et Charitate”(The Three
Theological virtues, faith, Hope and Charity). Gentili and
Suárez wrote long before the
treaty of Westphalia in 1648 and Grotius cited the works of
Gentili in his “De jure belli ac
pacis libri tres”(On the Law of War and Peace: Three books).
The forefathers of modern
international law, therefore, were mostly naturalists and
religious scholars.

A. Gandhi and International Relations: the Making of Modern
India and the Role of Hindu Polity
The discussion above brings into light the role and importance
of religion, particularly
Christianity, in the making of international law. The question
now is whether the
contribution of Christianity is enough to make international law
complete and
universal. Are there possibilities of contributions from other
major religions of the
world? India, with a Hindu population of over 80 percent,
continues to be the largest
secular democracy. This fact points to the inherent secularism
and universalism of
Hinduism. After the end of colonisation, India survived the
scare of fundamentalism
from its division based on a “two nation theory”in 1947, the
assassination of Gandhi in
1948 by a Hindu extremist, and the existence of the then only
Hindu state, Nepal, on its
border. Pakistan, on the contrary, has not been able to cultivate
secularism. The Islamic
theology with its military nexus has undermined the growth of
Pakistan as a
democracy. This dichotomy suggests that Hinduism has played a
subtle role in the
secularisation of the Indian polity and legal system.
52. The Indian concept of Gandhian thought is never spoken of as
contributing to
international law, but it does have a bearing on international
relations and political
science. International law and international relations, as
disciplines, cross-fertilise each
other. In fact, Gandhi’s very effective and rather novel ideas of
passive resistance in
Ahimsa (non violence) and Satyagraha (truthful request) come
directly from the
cumulative matrix of Asian religions with major contributions
from Hinduism. The
universal appeal of his thought and possibility of application
was proved by Gandhi
himself in South Africa. In fact, he tested his indigenous tools
in a foreign laboratory to
eventually use it in India.2 It is therefore not surprising that the
modern Indian
intellectuals, irrespective of their discipline of research, from
Amartya Sen to Ashis
Nanday, have gone back to ancient India and to Gandhi to
discover the self-belief of
modern Indian cultural consciousness.3 This exuberance of self-
discovery needs to be
translated into international law as well.
This narration puts the role of ancient Hindu polity into the
spotlight. Hindu
international law differentiates itself from modern international
law in its agelessness,

begins by discussing the role
that Christianity played in shaping modern international law in
Europe (Section II). The
paper then discusses the legal counters of Hindu international
law, the role of
mythology and history in its evolution (section III), and the
importance of the
and Bhagavad (Section IV and V). With a descriptive historical
approach to Hindu
international law, our article mentions the international natural
resource law of
Buddhism as a part of the Hindu perspective of international
law. In so doing, the article
views Buddhism as a subset of Hinduism, from both a historical
and an international law
perspective.4
The paper mandates only a referential and not a detailed study
of international law
in Buddhism (section VI). It then cites, as an example, the most
recent case of the
application of ancient Indian principles of Panchsheel by India
55. translated into
nonalignment policy of Nehruvian times and how this principle
could be used in the
European Court of Justice (ECJ) (section VII). The article also
seeks to re-establish the
origin of these five principles of peaceful co-existence, as
legally established principles
from Asia, in the larger call for accommodation and
appreciation of the oriental “others”
(all that was non European was considered “other”for the
purposes of defining the
boundary of the civilised world). The paper posits a
comparative note on Hindu
Dharmayuddha, Muslim Jehad and the Christian Crusade
(section VIII). Finally, and most
importantly, the paper ends with suggestions of how to apply
Hindu international law
under existing body of international law, particularly in the
International Court of
Justice (ICJ) (section IX). This paper seeks to break the
academic hibernation of Indian
lawyers and social scientists in contributing to the making of a
true universal
international law from an Indian perspective.
56. II. The Nature of Modern European International Law:
Between Christianity and Colonialism
A. Manufacturing Modern International Law
Modern international law, as the name suggests, is rather new.
As late as September 8,
1873, eleven men met at the Town Hall of Ghent in Belgium,
adopting the Statute of the
Institut de Droit International, defining the organisation as the
organ of the juridical

conscience of the civilised world.5 But the politics of semantics
explains why a
particular civilisation was considered superior over “others”that
existed in different
57. time and geography. The non-Europeans continued to remain
obscured in the
occidental narrations of cultural contribution to the making of
laws of the civilised
states. One can also debate and refute the self-defining narrow
European construction of
the “civilised”states, which apparently excluded Asian, African
and Latin American
cultures.6
The history of modern international law, as discussed below,
explains why it is
dominantly European and therefore Christian in origin. In fact,
the Americans only
entered into this elite group after the vagaries of two World
Wars and consequently,
when the concept of sovereignty was determined by
international relations and not only
by international law.7 The modern international law was
enriched by both Universal
Catholicism and Protestants. For example, Jonathan Fox
explains that religion,
surprisingly, is an overlooked aspect of international relations.8
There are, nonetheless,
recent cases, like in post-war Taiwan, of religion acting as a
58. factor of state creation,
supporting the view that the religion plays a dominant role in
the creation of states and
their laws.9 So why does Hinduism, the most ancient religion of
the world, occupies
only a marginal role in the shaping of modern international law?
The history of
colonisation, perhaps, has the key to this secret.
Both international law and international relations are tied to
religion; however,
geography explains the importance of a particular religion to a
specific state or nation.10
The treaty of Westphalia, arguably, is a symbol of constructive
connection between
Christianity and European international law.11 Martti
Koskenniemi articulates the birth
of this international law from a historical perspective:
. . . [m]uch of the substance of international law has been
received from Roman law.
Its origins are profoundly influenced by Catholic universalism
of the 16th and 17th
centuries and its basic notions have been developed by Dutch

the theoretical
articulation of the nature and problems of modern international
law comes from the
tradition of German public law .. 12

Modern European international law was born from a defence of
secular absolutism
against theology and feudalism in the modern age, and
therefore, the concept of
sovereignty in Europe is newer than in the Indian traditions.
The Republics in India
were as old as the Vedas.13 The modern “other”(i.e., all that
was non-European)
international world led by European explorers, thereafter,
became a natural extension of
61. sovereign European governments, as their colonies.
B. Christianity and Colonisation: The Nexus Explained
In Europe, feudalism was fighting with theology and anarchy
prevailed throughout
Europe. Scholars and international lawyers were struggling to
establish a rule of law
that was secular in nature. But the creation of the category of
religion and its
demarcation from politics, contends Elizabeth Hurd, is a highly
politicised decision that
is not subject to a final settlement, and the pretense of a final
settlement exacerbates
international conflict rather than diminishing it.14 The treaty of
Westphalia of 1648 was
one such inadvertent effort. Some European scholars argue that
the Westphalian treaties
successfully solved the:
. . [d]eep religious disagreement by imposing proto-liberal
religious liberties on the
estates of the Holy Roman Empire, which left the subjects with
exclusively secular
duties towards their authorities. The Westphalian constitution
62. (...) addressed the
issue of compliance with its religious provisions by establishing
a secular procedure
to adjudicate religious disputes that excluded religious
reasoning from the courts.15
This secular happiness of religious exclusion in Europe,
unfortunately, was not
contagious enough. The newfound love for secularism in Europe
against political
theology drove the clergy out of business. Religion had to find a
new audience and fresh
markets for their product. After all, the industrial revolution
was promoting
materialism in modern European society.16 The factors of
production were creating new

classes with uneven distribution of profits and subsequent
accumulation of wealth from
64. the industrial revolution. Christianity could not be sold in
Europe anymore: in the
Marxist vocabulary, the bourgeois state and Christian clergy
clashed in the beginning,
and then worked out a formula of mutual benefits. In its wake,
the colonies would soon
become the laboratory of colonisers’empathy where the class
difference in social
structure would soon reinvent itself as bourgeois and proletariat
struggle.
The old laws of discrimination and the (so-called) savage
customs found in the
oriental world would soon find solace in the enlightened
wisdom of social equality from
Europe. This wisdom brought in their wake a package of
Western civilisation. The
traders of religion evaluated the occidental “others”(non-
European) as primitive and
ahistorical. They assumed a burden to give civilisation to the
savage, history to the
ahistorical, and modernity to the primitive.17 This colonisation
obscured the native
indigenous knowledge. Unfortunately, the ancient wisdom of
the colonised paid the
65. price for this Christian adventure. The colonial hypocrisy and
disrespect, however, is
not the story for this paper.18 The narcissistic period of
colonial denial of other religious
values explains why modern international law is not as
universal as it could have
become.19 There was a method to the colonial madness - a
purpose to be achieved - to
find raw materials and cheap labour. Preaching theology in the
colonies was a vocation
for the jobless Christian clergy fired from Europe. The
Christian empathy, while
creating cheap factors of production, cajoled the colonised
proletariat into the arms of
servitude and cultural surrender. How could the native
international law have
survived?

III. Hinduism and International Law
A. Hinduism: Sources and Legal Contours
The vast potential of Hindu and Buddhist contributions to
international law, in the
evaluation of centre-periphery dynamics in international law,
rightly dispenses with the
focus on a single Indian scholar: a single figure is neither
capable nor entitled to wisdom
accumulated in about eight millennia.20 Hinduism, unlike Islam
and Christianity, has not
been a religion promulgated by a single saint or prophet? it is a
way of life with
considerable freedom of belief. Its vast contours are not limited
by Quranic or Biblical
commandments. It is a family of four Vedas, eighteen Puranas,

( and Ramayana), various Neetis, Bhagavad , Manu Samhita (or

comparitively recent and other big and small texts with
regional flavours of the same grand narration to which the
concept of dharma remains
central.21 The ancient scriptures are rich in the areas of family
law, international
relations, statecraft and even, surprisingly, environmental
law.22 Binoy Kumar Sarkar
elaborates the comparative Hindu theory of state:
The Hobbesian “law of beasts and birds”or the Naturprozess of
Gumplowicz is the
logic (nyaya) of the fish (matsya) in India. Should there be no
ruler to wield
punishment on earth, says the ’(c. B. C. 6oo-A. D. 200), “the
stronger
would devour the weak like fishes in water. It is related that in
days of yore people
were ruined through sovereignlessness, devouring one another
like the stronger
fishes preying upon the feebler.”In the Manu Samhita likewise
we are told that “the
strong would devour the weak like fishes . . . The Ramayana
also describes the non-
state region as one in which “people ever devour one another
69. like fishes.”And a few
details about the conditions in this non state are furnished in the
Matsya-Purana.23

The true possibility of finding international law of ancient India
requires the
scientific re-reading of all these texts collectively. The answer
to questions of how stable
or persistent might be the notion of India as peripheral in the
international legal
imagery, notwithstanding its obvious power in contemporary
geopolitical, economic,
and cultural terms, rests upon the possibility of exporting
ancient Hindu secular values
to international law.24 The Indian approach to international law
teaching, scholarship
71. and practice ought to be based on extracting those ancient
values from obscurity of non-
use and building both: laud and muted dialogues, depending
upon situations, at
different academic and judicial fora.
B. Hindu International Law: the Semantics of Mythology and
History
Indian mythology, which spans eight millennia, has been able to
establish a direct
dialogue with the higher wisdom of the Indians for centuries
through its constant
conversation with India’s history.25 It has been achieved by the
method of Shruti: to
listen and then pass on orally to the next generation. With the
invention of ink, the
writing began and the “shrut”(Sanskrit root meaning hearing)
wisdom was transcribed
in various forms. The precise sources of international law of
ancient Hindu India are:
Rig Veda (c. 2000 BC), Yajur Veda, and Atharva Veda (1000 -
800 BC).26 Other sources are
the dharmasutras, Manu-Smiriti,27 Upanishadas and
Yajnavalkya-Smiriti and other secular
72. works as Purana and (science of ways and means).28 This paper
identifies three main Hindu sources of law and international
relation theories: the
Manu-Smriti, the Bhagavad and the .
The rich tapestry of ancient Hindu international law comes from
what we call the
Indian mythology and Vedic history. Dharma is pivotal to this
narration.29 Let us clarify

that neither the word Hindu nor India is Sanskrit in origin.30
Hindu, as a name, came to
be known in Greek and Persian literature, referring to those who
lived on the other side
of the river Sindhu, (or Indus) which now flows through
Pakistan.31 Even though the
Ganges is the all important river in Hindu mythology and Indian
religious life, the river
Indus dominated the Greek version of the oriental narration of
India? because
Alexander did not cross the river Beas for the fear of nine
thousand strong elephant
army of the Magadha Empire; Alexander could never reach the
Ganges.32 The nation
now known as India is also a completely different nomenclature
from the ancient and
original Sanskrit “Aryavarta”(the place of the Aryans) or
Bhartvarsha (the place of sons of
King Bharat).
75. Alexander later had to reckon his strength with the powerful
military republics in
his march through the regions Punjab and Sindh (326 BC). The
most important of the
republics were the Arattas, the Ksudrakas, the Khattiyas, and
the Malavas. The political
constitution of the city of Patala, near the apex of the delta of
the Indus, was, according
to Diodorus, drawn on the same lines as the Spartan.33 As in
this community the
command in war vested in two hereditary kings of two different
houses, while a council
of elders ruled the whole state with paramount authority. The
republic of the Arattas
(Arajayaakas, i.e. kingless) came to the help of Chandragupta
Maurya when a few years
later he commanded a successful war against the Greeks
succeeded by Alexander.34
Binoy Kumar Sarkar wrote in 1918:
There are, however, sentiments of a more directly democratic
character in oriental
political philosophy . . . the Hindu neeti-shastras (treatises on
state- craft), dharma-
76. shastras (treatises on law), and epics (especially the ) contain
frequent
discussions as to the restraints on royal absolutism, the
responsibility of ministers,
and the authority of the people.35

independence until the fourth
century BC. These are mentioned, not only in Buddhist and
Jaina records, but also in the
Greek and Latin literature on India and Alexander,36 as well as
in the Sanskrit epics and
treatises on politics.37 The Hindus of the Vedic age were
familiar with republican
nationalities. In the language of the Aitareya Brahmana, among
78. the Uttara Kurus and the
Uttara Madras, the “whole community was consecrated to
rulership.”38 Such states were
called Vairajya, i.e. kingless states. Thus, the existence of laws
of republics or sovereign
state in ancient India should not come as a surprise. Since there
existed republics, they
had an extensive network of laws and corresponding
administrative system to govern
the country and its foreign relations.
Ancient India had a simultaneous system of Monarchy with jana
or tribes as the
political units extending to villages bonded by a common
language (Sanskrit), race
(Aryans) and religion (Vedic). It was a mix of the Aryans who
settled across the Indo-
Gangetic belt and extended in the borders of Afghanistan in the
west.39 The Non-Aryans
or the Dravidians lived in the south of the country as
sovereigns. Buddhism marks the
boundary between the mythology and history of Hindu
international law in India. As
Buddhism grew stronger in the country, (400 B.C.
approximately), it signalled the era of
79. stronger nation states. Sanskrit was supplemented with Pali and
Prakrit, a derivative of
Sanskrit as the common man’s lingua franca. Sanskrit gradually
grew unpopular with
the common people; particularly women, and only people with
higher education could
read and write it. This Pali-Prakrit- Buddhist era witnessed
about sixteen identified
sovereigns, composed of both Aryan and Dravidians.40
C. ““Manu””and Hindu Law
Manu, the father of all Manav (the Sanskrit for man), is the
most authoritative author of
the moral code of conduct in ancient India. The Brahmanas
narrate the stories of Manu,
such as his division of inheritance and other family laws. He
has been depicted as the
primary law-giver. Discussing Manu and his laws, Hopkins
opines that:
. . . having originated from the circumstance that his reputed
acts (such as the
division of property) were first quoted as authoritative
precedent; and then, with the

81. growth of legal literature, the primeval man, whose acts were
thus quoted, grew into
a personal authority on legal points, whose words on law (of
course invented)
attained the influence which citations from such an eminent
authority would
naturally induce. The law-Sutras (keeping ‘law’as the most
general and at times . . .
fitting translation for dharma) were those earliest attempts at
collecting the rules on
duty of every sort . . .41
The Hindu code of Manu also made formal efforts to prescribe
rules of warfare and
informal attempts to regulate armed conflict. These are reflected
in the Rajput code of
medieval India following the Gupta period of Buddhism.42 The
governing rules of
interstate conduct and diplomacy, peace and war, were based on
the concept of
Dharma.43 Manu smiriti is the major codification of the laws
governing personal and
national life - a comprehensive set of civil and criminal code.
82. The semantics of this all
important word, dharma, plays a more important role than
expected particularly by the
Western audience. Dharma in Sanskrit means both religion and
duty. However, it is the
second meaning, duty, which is of primary importance for
understanding the Hindu
law of ancient India.
The Manu smiriti, however, also provides the occasions when
the dharma could be
deconstructed in the instances of apada, or crisis, as an
emergency clause.44 One should
note that the often romanticised role of a Kshatriya - second in
the four fold division of
Indian caste system - to fight , is actually an apad dharma (apad
dharma in Sanskrit means
duty during an emergency) and not of one’s own will or for
material pursuits; rather,
one should go to war for the defence of the state, women, and
the disabled. Reading the
implicit contradiction in Manu’s text, like in the World Trade
Organization’s laws on
trade liberalisation and its explicit exceptions to trade in Article
XX and Article XXIV,

(ksudha) . . . Apad- dharma is the ultimate . . . realism in Hindu
law.45
The fulfillment of the prescriptive side of dharma was mostly
impossible; and the
descriptive aspects of the ‘principles of life’were necessarily
constituted as one large
set of ‘emergencies.’Manu is not so much a text on dharma as it
is on apad dharma-
the principles of life led in a perpetual state of crisis.46
Surprisingly, Doniger’s deconstruction actually expounds the
obscured but inherent
maturity of Manu’s laws. An effective law is a law that reflects
the social emergency in
its implementation as laws are not applied in a social vacuum.
85. Doniger attempts a
critical deconstruction of Hindu law from a socio-legal
perspective. The very fact that he
has reasons to believe that Manu’s laws are more an apad
dharma or laws with exception
than formal directives reflects the functional maturity of this
law.
Any body of international law today, which is also functional, is
replete with
exceptions. Those exceptions are permitted derogations from the
main objective of the
whole legal text to accommodate the reality of our collective
existence. For example,
Articles XX and XXIV of the General Agreement in Tariffs and
Trade (GATT) 1994, or
Article V of the General Agreement in Trade in Services
(GATS) are exceptions from the
most favoured nation (MFN) obligation of all the WTO
members. These provisions exist
to ensure derogation from the main objective of Member states
in exceptional
circumstances like national security. It is a permitted derogation
of the central objective
of MFN treatment. Likewise, the exceptions in Manu’s laws are
86. recognitions of
pragmatism and denunciation of impractical idealism that often
plagues novice
constitutions and other legal rule books. It represents a certain
level of maturity in
civilisation and its complexities that law makers have to
accommodate in the process of
rule making. Manu’s laws are the positive Hindu law of
personal, family and property
issues with inherent exceptions to these rules for unforeseen
situations.
D. The Nature of Hindu International Law
Hindu international law has a major noticeable difference from
the early Grecian law
with respect to treatment of foreigners. Unlike the narcissist
Grecian law, which bluntly
disrespects and disregards other civilisation in an act of self
love, Hindu international
law is natural and universal in its application47 irrespective of
the size of the national
states, religion or civilisation. It does not discriminate between
foreign and the domestic

in terms of enforcing justice. This is in sharp contrast to:
[c]lassic notions of antiquity [that] had very imperfect notions
of international justice.
With the Greeks and Romans, ‘foreigners’and ‘Barbarians’or
‘enemy’were
synonymous in language and in fact. By their rude theory of
public law, the persons
of alien were doomed to slavery . . . Grecian philosophers
88. gravely assert that they
[barbarians or foreigners] were intended by nature to be the
slaves of the Greeks.48
In fact, one of the current authors Prabhakar Singh, supra note
19, opines that:
Vedic India actually had a ‘natural international law’, which
advocated the
equitable distribution of natural resources building a culture of
assimilation rather
than that of military and political subjugation and territorial
conquest. The entire
Vedic vocabulary denies entry to ‘positivistic principles’and
promotes natural law
morals and values.49
Even the expansion of an empire in Ancient India, by a Hindu
King to become a
Chakravarty (world conqueror) performing Rajasuya Yajana
(ritual of holy fire), could be
done keeping the sovereignty of the defeated state intact - a
mechanism rather unseen in
any system of the world. This clearly distinguishes Hindu
international law from the
89. Jihad of Islam and Christian Crusades where the aim has been to
extend religious states at
the expense of welfare and peace. In fact, in , as explained
further in the next
section, , the advisor of mighty Mauryan King, Chandagupta,
says that the
subjugation of the weak by a sovereign should be done by
conciliation.50 These rules are
wonderful expositions of the moral responsibility of a king who,
while powerful, has a
duty of compassion towards other leaders and their citizens.

IV. and his : the Indian
Machiavelli or Bismark
A. : The Most Ancient Treatise on
Positive International law
is often called the India Machiavelli. However, referring to as
the
Indian Machiavelli does not reflect the true merits of his work.
In terns of the depth and
coverage of international relations, he was definitely more than
Machiavelli as an author
and Bismark as a practitioner. This is how the West discovered
him in the early 19th
century.51 Chanakya, or Vishnugupta, is generally spoken of as
as his most
popular name. was the key adviser to the Indian king
Chandragupta Maurya (c.
317-293 B.C), who defeated the Nanda kings, stopped the
91. advance of Alexander’s
successors, and for the first time ever in the history of ancient
India, united most of the
Indian subcontinent into the Magadha empire. Immediately,
could be credited
with two wonderful successes: halting the juggernaut of
Alexander’s successors and
uniting India into one Magadha Empire with borders extending
to Afghanistan. These
are not insignificant achievements in terms of statecraft and
strategies of war.
In addition to these accomplishments, , was also a profound
writer. Written
in about 300 B.C., the is a science of politics intended to teach
a
wise king how to govern with elaborate positive international
law.52 This is the most
ancient treatise on positive international law. In this work,
offers wide-
ranging and truly fascinating discussions on war and diplomacy.
This includes his wish,
probably having seen and met Alexander, to have his king
become a world conqueror.

any
modern treatise on diplomacy can boast to offer including: an
analysis of which
kingdoms are natural allies and which are inevitable enemies,
his willingness to make
treaties he knew he would break, his doctrine of silent war or a
war of assassination

According to one author:
[One of ’s] [k]ey parts contain detailed provisions of civil and
criminal law, or recommendations on military tactics or the use
of magic. Others
discuss the duties of various government officials, and as such
are valuable as
sources of information . . . is, above all, a manual of
94. statecraft, a collection of rules which a king or administrator
would be wise to follow
if he wishes to acquire and maintain power. In inspiration it is
therefore close to other
digests of rules of statecraft and of advice to princes such as
Sun Tzu’s work on The
Art of War or Niccolo Macchiavelli’s The Prince. But unlike
The Prince, which had
little if any influence on the behavior of the ruler to whom it
was dedicated,
work is part of a larger literature disseminated by “schools”and
was
intended to be learnt, often by heart. Like other Sanskrit
writings it has verse
passages and such easy-to-learn classifications as the eight
elements of sovereign or
six types of foreign policy.54
discussion of problems of foreign policy is based upon the
analysis of the
seven elements of the state (prakrti): the King, Minister,
Country, Capital, Treasury,
Friend and Foe.55 Max Weber has also recognised wisdom. He
thought that
95. was much more than the radical Machiavellianism.56 In his
famous lecture,
‘Politics as a Vocation,’Weber stated that Machiavellism “is
classically expressed in
Indian literature in the (written long before the birth of Christ):
compared to it, Machiavelli’s The Prince is harmless.”57 put

B. The Conception of International Relations
The conception of the international system was embodied in the
idea of
mandala, commonly translated as the circle of states.59 The
concept of mandala occupies a
prominent place; both in Hindu and in Buddhist writings, but in
relation to international
politics it has been most fully developed in the . It has been
described as a
bi-centric international system.60 According to , the king’s
98. status determines
his foreign policy. devotes a chapter to ‘sadhgunyas’or the “six-
fold policy”
which represents a typology of foreign policy which is based
upon the status of the
actor. The six-fold policy consists of: accommodation (sandhi);
hostility (vigraha);
indifference (asana); attack (yana); protection (samsraya); and
double policy
(dvaidhibhava). The policy differs according to whether it is
being directed toward kings
who are superior, inferior, or of equal stature. The bulk of the
international portions of
the are a discussion of the policies that may be appropriately
pursued by
‘superior’or ‘inferior’kings. Having to choose between them, an
inferior king pursues
accommodation, seeks protection or resorts to double policy.
The superior king,
however, can afford hostility or attack, while one facing an
equal king maintains
indifference.61 This six fold policy could be used to explain
why China and the United
States will not try to indulge in an armed conflict. The short

can also be explained
by the concept of relative strength of states codified as rules of
state behaviour in
. It also explains the double policy of Indo-American and
American-
Pakistan relationship. beautifully explains how the USSR was

The six-fold policy needs to be distinguished from the upayas
(or the four influence
techniques). The conception of upaya (translated as solution or
as ‘means of
policy’) is more systematic than those to sadhgunyas. The
upayas are contained in such

Settlement Understanding
(DSU) seemingly works on sama. In the case of non compliance,
the retaliation is danda.
Breaking coalitions with meta-trade tactics is bheda.
In the Indian tradition, the world conqueror, or Chakravarti, was
not one who
conquered regions beyond the borders of India. In short, India
did not include the land
of “barbarians”or malecchas, those outside of Indian culture.
But the history is witness to
the fact that India never adopted aggression as its foreign policy
to extend its
boundaries. However, Narasingha Prosad Sil notes that “for a
world conquest
is the true foundation for world peace.”64 Nonetheless, ancient
Hindu India never
produced an equivalent of Alexander though Chandragupta had
the capability,
historically and militarily, to achieve such a feat.65 The
104. greatest kings of India actually
focused on the conquest of within and there lies the greatness of
those kings.
V. The Bhagavad and the Nuclear Proliferation:
From Oppenheimer to Weeramantry
A. The Bhagavad and Robert Oppenheimer: the Father of
Nuclear Bomb
In her native Hindu cosmos, the Bhagavad (celestial hymns) is
an appealing,
divinely beautiful and altogether wisest daughter in the large
family of Sanskrit texts.66
The Bhagavad , part of , is a pre-war narration of the concept of
dharma
and the logics of just war.67 There are, however, various kinds
of dharma.68 These are
the words, the legend says, spoken by the Lord Vishnu Himself
in an effort to persuade
his disciple and friend Arjuna to shun earthly emotions and
fight for just war, which is
105. his dharma or duty even if this means fighting his own
relatives.69 The Bhagavad is
the most extensive treatise of ancient oriental wisdom from
India.
In reference to the Trinity test of Atomic Bomb in New Mexico,
the father of atomic
bomb, Robert Oppenheimer, famously recalled the Bhagavad :
“If the radiance of a
thousand suns were to burst at once into the sky that would be
like the splendour of the
mighty one. . . . Now I am become Death, the destroyer of
worlds.”70 With these words
from the Bhagavad , the architect of the nuclear conflagration,
anointed the birth of
the Kaliyuga (age of Kali). How fitting, indeed, that when the
sun rose from the east to
steal a look upon the charred and stillborn desert of New
Mexico, it brought in its wake
a wisdom from the ancient land of India.71
It remains a matter of debate whether Oppenheimer
misunderstood the overall
import of Bhagavad . However, he did misquote a particular
verse as a half-truth
106. under an impression that the Bhagavad is a treatise on war and
peace only. The
non-ephemeral message of the Bhagavad is something more
fundamental, with
sublime universal prescriptions, in the overall perspective of
civilisation, and cosmic
and earthly order of which the question of war and peace is only
a chapter. Moreover,
