ONLY A YEAR FOR TRANSITION
ARRANGEMENTS TO BE MADE.
THE REGULATION REQUIRES THAT ALL
PRODUCTS ARE CERTIFIED BY 21 APRIL
2019.
THE CHANGES IN BRIEF
The new Regulation imposes a few additional requirements, including:
• New responsibilities for importers and distributors
• Products that protect from heat for private use (oven gloves) are now PPE
• Some products which were Category II are now Category III
• An assessment of the risks against which the PPE is intended to protect
• Changes in requirements for product marking, including manufacturer name,
registered trade name or registered trade mark, and postal address
• Changes in requirements for instructions for use to include the internet address
where the EU Declaration of Conformity can be accessed

In preparation for the new Regulation,
we have identified key dates and
action points. Following appointment
as a Notified Body, we can now offer
certification services against the new
requirements for Module B, EU type-
examination, which replaces the previous
Article 10 and Modules C2 and D for
production certification replacing Articles
11A and 11B.
Key dates:
• Directive 89/686/EEC was repealed
on 21 April 2018
• All products put on the market from
21 April 2019 must have a valid EU
type-examination certificate (Module
B) with five year validity
• Products with an 89/686/EEC EC
type-examination certificate (Article
10) and already placed on the market
before 21 April 2019 can continue to
be sold
• Notified Bodies can issue EU type-
examination certificate (Module B)
with a valid from date of 21 April
2018 when they have been approved
against Regulation (EU) 2016/425
• For Category III products,
manufacturers must have a valid
Module C2 (old Article 11A)
or Module D (old Article 11B)
certificate by 21 April 2019. With the
appropriate checks, these can be
issued with a validity date from 21
April 2018
SIMPLE TRANSITION
SGS has developed a simple procedure
for transition from the PPE Directive to
the Regulation provided that the “state
of the art” (harmonised standard) has
not changed since certification under
the PPE Directive. Our questionnaire
and document submission process will
enable you to achieve continued product
certification.
To use this procedure the name and/
or address of the certificate holder, or
where the product is made, must not
have changed. Also, there must not have
been any modification to the certified
product(s), including materials, sub-
components or sub-assemblies, labelling
or marking other than required for the
Regulation.
NEW PRODUCTS
Products new to the market, from 21
April 2019, must be assessed against
the Regulation 2016/425 and receive an
EU-type examination certificate. The EU
Commission recommends that all new
products from 21 April 2018 are certified
to the Regulation.
