4 Patenting Trends in India
Objectives
• To analyze the key patent filing trends across – World, India, DeepTech Start-ups
• To understand the hits and misses in the patent filing process in India and recommendations to make it better for various stakeholders
Approach
• The study has extensively sourced data from annual reports of WIPO and Intellectual Property India, among others.
• Data sourced from Indian Patent Office is for financial year ending March, while data from WIPO is for year ending December.
• DeepTech start-ups’ analysis is based on a sample set of 364 major DeepTech starts-ups in India for which 922 patent families were identified through Questel Orbit
database. Sagacious is the knowledge partner for this exercise.
• For some start-ups, the patent data was extracted using their legal/parent name. The country of origin data is based on first filing of the patent family in the
mentioned country.
• The analysis is performed based on ‘Patent Family’. This implies that if a particular patent family has two members, only one patent reference has been taken into
account for the analysis. The distribution is based on automated numbers generated by the patent database using logical combination of key-words and
classification based strings.
• The data was extracted during March 2024. The count may vary for individual start-ups as many applications may not have been published yet in the public
domain, as there is a window of approximately 18 months from the filing date to the publication date.
• The mapping of patents to one specific domain/ application area is not mutually exclusive, as a single patent may be tagged in more than one technological/
application domain.
• The legal status trend is shown based on legal status of first filed application in the respective country.
• Discussions and surveys were conducted with key stakeholders to understand the patent filing process in India, existing challenges and recommendations.

After India, USA has been the key country of origin
for patents across major DeepTech start-ups in India.
Key reasons in comparison to India include:
• The average patent grant time is ~2X lower
in USA
• For funding aspirants, investors in USA give more
weightage to patents, making it an added
advantage
• In terms of experimenting with the new DeepTech
technologies, US is more advanced making it a
key market for new inventions
Consequently, around 4% of the start-ups analyzed
had USA as their headquarters

Improvements in Indian Patent Search Portal
(inPASS)
• Make the patent search portal more user-friendly and comprehensive in line with international best
practices. This will allow patent filers to search for existing inventions in an efficient and exhaustive
manner.
Simplification of the patent filing procedure
and appointment of more domain and
technical experts at the Patent Office
• Improvements in the e-filing portal to simplify the process of online filing. For example, a
helpdesk/chatbot can be created for guiding filers through the application process.
• Increase in number of examiners with domain expertise across new-age technologies and niche areas
• Leverage technology for faster and efficient processing of applications. For example, using
technology to help in the classification of applications and subsequent allotment to examiners
Clarify the patent eligibility of computer
programs
• Establish clear and consistent guidelines for examining the patentability of computer programs to
avoid uncertainty and arbitrariness in the patent system
Facilitate International Patent Filing • Implement bilateral and/or multilateral cooperation programs, such as patent prosecution highways,
to fast-track the processing of patent applications
Create a supportive legal ecosystem • Provide more granular details regarding the list of attorneys on the IP portal to highlight their
technical expertise in different domains
• Establish adequate mechanisms to ensure that reimbursement claims are processed in a timely
manner
Shift in focus from IP Awareness sessions to
Quality of IP
• Focus on conducting training sessions to educate potential applicants on drafting quality patent
applications

Central Platform for open innovation and
technology transfers between Industry and
Academia
• A central online open innovation platform to enhance the visibility of granted patents with the
academia, supported by the government (central, local, and other administrative authorities)
accessible to both Academia and Industry facilitating Industry-Academia collaboration
Modify/Re-evaluate the methodology for
NIRC ratings
• In the NIRC ratings methodology, give more weightage to patents granted and
commercialised/licensed than patents filed
• This will increase the quality of patent applications that are filed and help in increasing the efficiency
of patent offices, as bogus filings will reduce
Increase collaborations with start-ups • Partner with suitable start-ups across government departments ensuring business opportunities and
growth. Government needs to lead by example
Create a unified DeepTech IP discovery tool • Create a unified DeepTech IP discovery tool to improve IP discovery and drive open innovation
opportunities

Do not wait for ‘going to market’ before filing
an IP
• File the patent application once you have a mature idea, before you take it to the market
Focus on drafting the patent in techno legal
language
• Drafting the patent in techno legal language, which conveys the whole idea well to the examiner is

34. Glossary
Patenting Trends in India
34
• Dead: Patent that is no longer active or enforceable due to one of the reasons such as expiration of
20 years term, non-payment of maintenance fee, abandonment, or the like.
• First Filed: The initial patent application submitted for an invention. The first filed application
establishes the priority date for the invention.
• Granted: The term refers to a patent application that has successfully passed the scrutiny of the
patent office, leading to the issuance of a patent. This grant affirms that the invention is novel, non-
obvious, and useful, meeting all patentability criteria.
• PCT: The Patent Cooperation Treaty (PCT) assists applicants in seeking patent protection
internationally for their inventions, helps patent offices with their patent granting decisions, and
facilitates public access to a wealth of technical information relating to those inventions. By filing one
international patent application under the PCT, applicants can simultaneously seek protection for an
invention in a large number of countries.
• Pending: Patent application that has been filed with the patent office but is yet to be granted.
