issues thereof

Greetings from Nagpur! This is to bring to your kind notice va,rious issues w.r.t.
BMW management being Iiaced by many hospitals in the city. As you are aware,
all the hospitals in ttre Vidarbha region are being provided Bio-Medical Waste
management serrrices by Superb Hygienic Disposals {'Sewice ProviderJ, which
is responsible for pick-up, transportation & disposal of the BMW & is operating
a Central Bio-Medical Waste Treatment Facilifu fCBMWTP) at Bhardewadi.
Since trast one month, Superb Hygienic Disposals company had not been
collecting complete BMW from the hospitals, resulting in undue piling up of
remaining hazardous Bio-Medical Waste beyond the maximum prescribed limit
of 48 hours (objectionable to Maharashtra Pollution Control Board (MPCB) as
per Biomedical Waste Managenent Rules, 2016 & subsequent amendments),
This prolonged storage of BMW owing to non/partial pick up is potentially very
hazardous to health workers & patient/relatives etc. After a lot of
communications, the waste is slowly being cleared now. Ttre same thing has
happened in the past as well and if this continues & similar events happen in
future, we wish to reiterate that Superb Hygienic Disposals, owing to their
callous attitude, will be solely responsible for any biohazard that may happen.
Superb Hygienic Disposals has cited payment issues from hospital's end for
this siiuation, which is patently incorrect. In fact had tlle payment issue even
been genuine, in the larger public interest, tJre service provider cannot stop or
slow down (only partial collection) in an arm twisting ma'nner, which they are
duty-bound to, in line with the Biomedical Waste Management Rules- 2O16.

Interpart5r dispute can't be allowed to cause public harm, as has been ruled by
the honorable High Court in a few recent judgments.
All the concerned hospitals have been regularly paying the demanded
Biomedical hospital waste disposal charges as per the previously agreed
tripartite MOU dated 1O/O9/2OO4, signed between NMC, IMA-Nagpur &
Superb Hygienic Disposals and applicable for 3O years. The issue is pertaining
to not only the hiked up part of Non-Covid waste charges unduly levied by the
service provider but also the unjustified Covid waste disposal charges.
As per l,aw of the land, Superb Hygienic Disposals is at liberty to seek legal
recourse to resolve the dispute w.r.t- paJ&ent but can't stop t]1e service of
collecting BMW from hospitals as it q/ill result in larger public harm.
In view of the above facts, we request your good office to issue a reprimand to
the Superb Hygienic Disposals to henceforth not hassle the hospitals unduly &
illegally and ensure regular proper disposal of BMW as per the tripartite
agreement inforce.
