Sabrina Ragland, a medical assistant with 12 years’ experience, works for a gastroenterologist, Dr. Tim Taylor. She comes from a family heavily involved in the medical fi eld. Her father was a surgeon and her mother was his offi ce assistant. Two of Sabrina’s sisters are nurses, and her brother is a respiratory therapist. Her husband, Joe, is a biomedical technician, and his mother, Elsa Ragland, has been an RN for 40 years. For more than half of her career, Elsa has worked for a local internist, Dr. Royce Berry. A casual comment at the Ragland family picnic resulted in a medical professional liability lawsuit based on violation of patient privacy. Sabrina and Elsa’s careers were jeopardized by a simple exchange of what seemed to be innocent information. Vivian Adams, a 42-year-old hospital insurance biller, saw Dr. Berry in his offi ce for pain located in her lower left quadrant. Ms. Adams was not a new patient but had not visited the offi ce in approximately 2 years. When she arrived for her visit, she was presented with the offi ce privacy policy and was asked to sign the document. Vivian glanced through it, signed it, and saw the doctor. He performed an examination and found that Vivian was likely suffering from irritable bowel syndrome and prescribed medication. Ms. Adams called the physician 1 week later complaining that she was no better. Dr. Berry changed her medication without seeing her and did not hear from her again, other than her requests for refi lls of the medication. After 6 months with no improvement, Ms. Adams went to Dr. Taylor; after several diagnostic tests, she was told that she had colon cancer and was given a bleak prognosis. She told Dr. Taylor that she blamed Dr. Berry for not being more thorough in his testing. Sabrina was in the room and heard the comment. That weekend at the picnic, Sabrina mentioned Ms. Adams to her mother-in-law and stated that the patient might sue Dr. Berry, although the patient never said those words. Elsa defended Dr. Berry and proclaimed that he was a good doctor, then expressed her hope that Ms. Adams would not sue her employer. One week later, Elsa was in a grocery store and saw Ms. Adams. Elsa immediately expressed her sympathy about her diagnosis, and then asked if there was anything she could do. Her intent was to be kind and try to avert litigation against Dr. Berry. Her gesture might have been well received had Ms. Adams’ daughter, Terri, not been standing with her. Terri was not yet aware that her mother had been diagnosed with cancer. Ms. Adams had told no one about her illness at that point. After the incident at the grocery store the fi rst person Ms. Adams told was her attorney. Should Nurses Blow the Whistle or Just Keep Quiet? Carolyn Buppert, MSN, JD June 24, 2014 Confused? I'm Not Surprised Apparently, a lot goes on in healthcare that makes nurses uncomfortable, because I am asked this question, in some form, frequently. The answer is complicated. People may differ in their opinions of what falls into the realm of incompetent, unethical, or unsafe practice, and the laws of every state are different. And even though I read law every day, I had trouble figuring out what to advise, given the current law governing nurses. No wonder nurses aren't sure what to do. Nurses are told that they have a duty to protect patient safety. They learn this from language such as this, in one state's (Maryland) nursing regulations. Under "Ethical Responsibilities," it says: "A nurse shall...Act to safeguard a client and the public if health care and safety are affected by the incompetent, unethical, or illegal practice of any person."[1] The implication is that when a nurse becomes aware of a patient safety threat, the nurse is supposed to do something. Maryland is not alone in making such pronouncements. Here is language from the Texas Board of Nursing Website: Situations involving potential risk of harm to patients or the public are referred to as "violating the nurse's duty to the patient" because all nurses have a duty under Rule 217.11(1)B to maintain a safe environment for patients/clients and others for whom the nurse is responsible.[2] It makes sense to tell nurses that they are expected to safeguard patient safety. It would be even better if nurses who try to do something were better rewarded for their efforts. However, according to nurses I hear from, when a nurse reports a patient safety problem, the nurse often is surprised to find that he or she is considered the "bad guy." A nurse who raises quality issues that require a change of policy, practice, or staffing can be seen as a disruptor rather than someone who is making constructive criticism. Some nurses who have identified problems have found themselves out of a job. This is bothersome. It's perfectly legal for a hospital to terminate a nurse, for any reason or for no reason. The only job protections are those granted by contract between the nurse and the hospital (whether it is an individual contract or a contract offered through a labor union) and those granted by the US Constitution and civil rights laws. The latter include the right to be free of discrimination on the basis of age, sex, national origin, race, sexual orientation, and religious preference. If the hospital isn't firing the nurse because of age, sex, national origin, race, sexual orientation, or religious preference, in general the firing is legal. A possible exception is a whistleblower law, which may, in some situations, provide protection for nurses who report patient safety problems. We will get to that shortly. Protecting patient’s information is a crucial element of respect and essential for patients' autonomy and trust in the organization — the US healthcare industry currently facing patient mistrust that is caused because of a lack of trust. When patients experience a lack of confidence they do not share their information with a healthcare professional that causes ineffective treatment. In a 2018 study, Levy, Scherer, Zikmund-Fisher, Larkin, Barnes, & Fagerlin concluded that approximately 81.1% of people withheld medically relevant information from their health-care providers. Patients fail to disclose medically relevant information in front of their clinicians undermine their health and cause patient harm (Levy, 2018). From perceived inefficiencies in the tax system to cultural norms and trust deficits in governmental institutions, our research identifies a myriad of factors contributing to tax evasion behavior and reluctance to join ATL. Furthermore, our study offers valuable implications for policymakers, tax authorities, and business stakeholders seeking to enhance tax compliance and foster a culture of transparency and accountability in Pakistan's taxation landscape. By addressing the underlying drivers of tax evasion and promoting the benefits of ATL membership, policymakers can design more effective strategies to broaden the tax base and promote sustainable economic development. In conclusion, our research paper represents a comprehensive endeavor to deepen our understanding of tax compliance dynamics in Pakistan and elucidate the complexities surrounding ATL enrollment. By unraveling the intricacies of tax evasion behaviors and attitudes, we hope to contribute to informed policymaking and foster a culture of tax compliance and integrity in Pakistan's business and taxation environment.
