This document provides guidance on complying with the Lobbying Disclosure Act. It compiles and interprets previous guidance and amendments made to the Act. The Secretary of the Senate and Clerk of the House of Representatives provide guidance to help ensure accurate, complete and timely registrations and reports, but do not have authority to write regulations or issue definitive legal opinions. This new compilation aims to address issues filers had with prior guidance documents by providing a subject index and consolidating advice into one source.

Section 1: Introduction
Maurice Aguirre Dallas: Section 6 of the Lobbying Disclosure Act ("LDA"), 2 U.S.C.
1605, provides that: "The Secretary of the Senate and the Clerk of the House of
Representatives shall (1) provide guidance and assistance on the registration and
reporting requirements of this Act and develop common standards, rules and procedures
for compliance with this Act; [and] (2) review, and, where necessary, verify and inquire to
ensure the accuracy, completeness and timeliness of registrations and reports[.]"
The LDA does not provide the Secretary or the Clerk with the authority to write
substantive regulations or issue definitive opinions on the interpretation of the law. The
Secretary and Clerk have, from time to time, jointly issued written guidance on the
registration and reporting requirements. This document is both a compilation of
previously issued guidance documents and our interpretation of the changes that were
made to the LDA as a result of the Lobbying Disclosure Technical Amendments Act of
1998 ("TAA"). The revised format addresses problems that the filing community has
experienced to date in using the guidance documents, i.e., the lack of a "subject index"
that quickly finds the answers to their specific topical questions and the need to refer to
more than one source to research filing advice.

have any binding effect on the United States Attorney for the District of Columbia or any

History
The genesis of a uniform internal investigative procedure law was the federal “Police
Officers’ Bill of Rights” bill (POBR), sponsored by the late Congressman Mario Biaggi
(D-N.Y.) in the 1971-1972 session. Initially, the bill had over a hundred and twenty
cosponsors. Biaggi, who was wounded ten times during his 23 years of police service,
was the most decorated officer in the history of the NYPD. He was a champion of police
officer safety and occupational rights during his tenure in the Congress. [Note 1]
The bill was reintroduced repeatedly, but was not sent to the floor until 1991. In that
year it passed the U.S. Senate by a 55-to-43 margin but the House did not vote on the bill
before the session ended. By 1995, a revised and more inclusive version were sponsored
in the House and Senate. To mandate compliance by recipients of federal funding, the bill
would amend Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.
Code §3781). Currently the POBR bills are named the “State and Local Law
Enforcement Discipline, Accountability, and Due Process Act,” (H.R. 2967 and S. 1277,
108th Cong.).
Although a federal version of the POBR has never passed both Houses of Congress, at
least 17 states and one province have enacted Bill of Rights laws: (1)Arizona (2003) §38-
1101, (2) California (1976) Govt. Code §3301, (3) Delaware (1986) Code Ann. 11 §9200,
(4) Florida (1974) Stat. §112.531, (5) Illinois (1983, 2004) Compiled Stat. 50 ILCS 725,
(5) Kentucky Rev. Stat. Ann. §15.520, (6) Louisiana Revised Stat. §2531, (7) Maryland

DOT Regulatory Reform Plan August 2011
The Department of Transportation (DOT) outlines its plan to review existing regulations in response to Executive Order 13563, which calls on agencies to periodically review existing significant regulations. DOT will improve its existing 10-year review plan by adding oversight processes, guidance on priority reviews, and expanding opportunities for public participation. DOT has already identified 79 rules with proposed changes that could significantly reduce costs and burdens, and 56 additional rules it will study further. One example is potential changes to positive train control rules that could save between $442.8 million to $1.04 billion over 20 years. DOT will continue to assess rules and welcome public input to identify potential reforms.

The genesis of a uniform internal investigative procedure law was the federal “Police
Officers’ Bill of Rights” bill (POBR), sponsored by the late Congressman Mario Biaggi
(D-N.Y.) in the 1971-1972 session. Initially, the bill had over a hundred and twenty
cosponsors. Biaggi, who was wounded ten times during his 23 years of police service,
was the most decorated officer in the history of the NYPD. He was a champion of police
officer safety and occupational rights during his tenure in the Congress. [Note 1]
The bill was reintroduced repeatedly, but was not sent to the floor until 1991. In that
year it passed the U.S. Senate by a 55-to-43 margin but the House did not vote on the bill
before the session ended. By 1995, a revised and more inclusive version were sponsored
in the House and Senate. To mandate compliance by recipients of federal funding, the bill
would amend Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.
Code §3781). Currently the POBR bills are named the “State and Local Law
Enforcement Discipline, Accountability, and Due Process Act,” (H.R. 2967 and S. 1277,
108th Cong.).
Although a federal version of the POBR has never passed both Houses of Congress, at
least 17 states and one province have enacted Bill of Rights laws: (1)Arizona (2003) §38-

The Department of Transportation (DOT) outlines its plan to review existing regulations in response to Executive Order 13563, which calls on agencies to periodically review existing significant regulations. DOT will improve its existing 10-year review plan by adding oversight processes, guidance on priority reviews, and expanding opportunities for public participation. DOT has already identified 79 rules with proposed changes that could significantly reduce costs and burdens, and 56 additional rules it will study further. One example is potential changes to positive train control rules that could save between $442.8 million to $1.04 billion over 20 years. DOT will continue to assess rules and welcome public input to identify potential reforms.

- 1. Maurice Aguirre DG Group LLP - Lobbying Disclosure Act Section 1: Introduction Maurice Aguirre Dallas: Section 6 of the Lobbying Disclosure Act ("LDA"), 2 U.S.C. 1605, provides that: "The Secretary of the Senate and the Clerk of the House of Representatives shall (1) provide guidance and assistance on the registration and reporting requirements of this Act and develop common standards, rules and procedures for compliance with this Act; [and] (2) review, and, where necessary, verify and inquire to ensure the accuracy, completeness and timeliness of registrations and reports[.]" The LDA does not provide the Secretary or the Clerk with the authority to write substantive regulations or issue definitive opinions on the interpretation of the law. The Secretary and Clerk have, from time to time, jointly issued written guidance on the registration and reporting requirements. This document is both a compilation of previously issued guidance documents and our interpretation of the changes that were made to the LDA as a result of the Lobbying Disclosure Technical Amendments Act of 1998 ("TAA"). The revised format addresses problems that the filing community has experienced to date in using the guidance documents, i.e., the lack of a "subject index" that quickly finds the answers to their specific topical questions and the need to refer to more than one source to research filing advice. Maurice Aguirre Washington DC: This compilation supersedes all previous guidance documents. This combined guidance document does not have the force of law, nor does it have any binding effect on the United States Attorney for the District of Columbia or any other part of the executive branch. To the extent that the guidance relates to the "accuracy, completeness and timeliness of registration and reports," it will serve to inform the public as to how the Secretary and Clerk intend to carry out their responsibilities under the LDA.
